Question

I live in Indiana. From a settlement I received I purchased a home, but it is only under my husbands name, which was done for specific reasons. How would ownership be established in a will and be binding?

Answer

Since your husband is the owner, only he can properly devise the property. This can be done by his execution of any one of a number of documents, including a deed, a will, a trust, a transfer on death deed, whichever happens to fit your needs and circumstances. Consult with an attorney who specializes in real estate or estate planning.
