No the state will not make you child an orphan. The only way to have his rights terminated is for the child to be adopted. This is done by having your new husband adopt the child and you would adopt your child as well. Otherwise we would have to see if the reason he was in jail was for violating an enumerated.offense. If you are concerned that the father is using illegal drugs while have custody of the children, then you should contact the police or CPS to ask for information on how to proceed. Bear in mind that if they do an investigation and no evidence of drugs is found, then you will end up looking bad, for making a false report. It's not uncommon for one parent to try to report the other to CPS for violations of the law, that may not be the case. So just keep that in mind when making any reports. You should be absolutely sure that some illegal behavior is going on.

This subtenant is now refusing to pay rent because Couple B moved in. Couple A and Couple B are having problems and do not get along. My uncle is saying that because Couple A signed a contract that says if they don't pay rent, my uncle has the right to lock them out. I strongly advised my uncle against locking doors whatever the contract says because I'm pretty sure that's against the law.

What is my uncle's relationship to Couple A now that the master tenant has moved out? What will the eviction process look like for Couple A? What kind of contract should he have Couple B sign?

The landlord can evict subtenants without the necessity of involving the master tenant, especially in a situation where there is no longer a master tenant. Your uncle is advised to bring an unlawful detainer action for nonpayment of rent. A term allowing the landlord to engage in self help would most likely be found void by the courts.

If your uncle wants to lease to new tenants, then he has them sign a lease or rental agreement.

In Ohio, the jail sentence does not void out the shared parenting agreement, but it does make it temporarily impossible to comply with the visitation therein. What it does do is constitute a "change of circumstances" sufficient to justify a motion to change the shared parenting agreement to a sole custody agreement with you ex-husband merely having visitation. Depending upon what he went in for and for how long, the court may agree with you.

Typically, this process can be continued because of ill health or family matters. In my experience, you also can withdraw at any time, which also may moot any hearing; i.e., they cannot proceed with a hearing if you are not a student or are absent because of ill health. With respect to tuition, unless you contracted otherwise, the school cannot accept unearned tuition for courses that you could not attend because of withdrawal or ill health. 2 - If you were charged with the DUI in Tennessee near the time of the offense, the statute of limitation has stopped running. Running of a statute of limitations is measured from the time of the offense to the time of the swearing of the warrant. In most DUI cases, that is a matter of hours.

3 - If you are asking "If I jump bond and don't return to the State of Tennessee to answer an existing Tennessee charge of DUI, how long does Tennesse have to come and get me?" the answer is:

A - Failure to Appear on a DUI is a new Class E Felony offense.

It depends on how the prosecutor and judge feel about your particular charge, what your whole record looks like, how long ago the first DUS was, and so on. My neighbor, a pre-revion owner recently applied for and was rejected for a 6 month rental. The reason given, was that if he had not exercised his option to rent prior to the 2008 revision, then he lost that option.

There was no 'use it or lose it clause' in the original or revised policy.

I addressed the Board as a pre revision owner and my plea to reconsider their decision was rejected.

If your license was suspended and you knew it was suspended, then you should not have been driving. Based on what you have written it is hard to tell if you have a defense. Keep in mind that driving with a suspended license is a very serious ticket. A first offense carries a fine of $500.00 plus court costs and a potential further loss of your license for up to 6 months. If it is a second offense the fines are higher and besides a further suspension you would face between 1 and 5 days in jail. A third offense would expose you to a mandatory 10 days in jail, plus severe fines and a further suspension. I have noticed several homes being advertised for ridiculously low sale prices on a certain website, and after contacting the realtor, they tell me the advertised sale price is for "monthly payments", not for sale. However, the website clearly states it as "For Sale".

Could this be construed as "bait and switch" or false advertising? Would I have any case to pursue against them?

There is a lot of information missing from this question, but the most important questions is how old is your brother. The process of settling a case for a minor (someone under 18 years of age) is much different and does take considerablly longer due to the requirments of having an SGAL (Settlement Guardian ad Litem) assigned to the case. It is odd for the attorney to take his fees prior to this happening. I would contact another personal injury attorney immediately so that your issue(s) can be discussed in more detail.

He needs to go to the consulate/embassy and inquire about a Returning Resident Visa where he shows that his period of absence was for circumstances beyond his control and that he maintained ties with the US. If he is not found eligible he will have to reapply for his Permanent Residency with you filing as the Petitioner for him.

If he did not enter, he will need to reapply for Permanent Residency again.

Your matter is in the hands of the State's Attorney's Office and it is up to them to make any decisions concerning your case.

To answer your question most simply, (a) it is not up to the "plaintiff" to drop the charges, and if you have been ordered to attend anger management classes, you will have to follow through with that.

Yes you do not have to live with her [probably better that you do not], you can move out of state, the amount of child support is based upon your income, you have no say as to whether she puts the child up for adoption or not. For giving in to the desire of pleasure without taking precautions [birth control] you will have to pay in many ways for the rest of your life; it is like getting into a drag race with another vehicle and you go off the road and injure yourself so that you can never walk again. But remember you have also changed her life for the worse, harmed both sets of adult parents, and harmed the baby. All you can do is try to soften the blow on everyone. You have to grow up and take into account the needs of others. Do not put pressure on the mother as you have already hurt her for life and should not force her to do something that she does not want to do.

I called the number, learned of our situation and immediately began taking steps to file for divorce. Soon after being served with the Petition for Dissolution, my husband was arrested for domestic abuse with injury. Our 17 year marriage was plagued with his abuse, and escalating narcissistic behavior for years. The state imposed a no contact order prior to his release from jail. After his release he immediately filed a mail forwarding request with the Post Office, and cleaned out our business , personal, and our children's bank accounts. To top it all off, his request to the courts for a order to preserve assets was granted. The business I started 17 years ago; my soul source of income was ordered to cease from operating. I was unaware of the hearing because the hearing notice was forwarded directly to his p.o box. In the blink of an eye, I lost everything. Having him gone from the house finally allowed me access to our financial documents. Nearly every monthly bill, including credit cards were in default and I learned that our taxes hadn't been filed since 2008, and as best I can tell even the filed 2008 return is incorrect. I found banking slips, canceled checks and other evidence of hidden bank accounts and a safe deposit box key. Hindsight revealed that he had been taking steps to go back into the construction trade for some time. He was now self employed as a contractor and hiding his income, and assests by not leaving any paper trails. A house he had been looking into purchasing as an investment property was now showing as being purchased by his uncle who lives thousands of miles away. He washed his hands of all responsibility the day he was arrested, including the support of our children. Temp mediation agreement was totally ignored resulting in disconnection utilities, repossession of my car, and my inability to qualify for home modification relief. My house goes to auction in less than a week. Goverment housing has a 2 year wait list for assistance, and because my oldest just turned 18 I am only elidgable for less than $270 in food assistance a month. I have found a entry level job, but am literally penniless, soon to be homeless and will no doubt be forced to allow my children to go with their father. My business is destroyed,all my retirement funds have been depleted and I just received $13k bill from my less than effective attorney. If your car pulls to one side when you release the wheel it could be one of a few different things. Most commonly this means it needs an alignment. There are three different alignment settings...toe, caster, and camber.

Toe is the most easily adjustable and is the most often needed adjustment. It is the measurement from the front of one tire to the front of the opposite side tire, or rear of one to the rear of the other. When you turn your wheel, the motion of the tires is the motion that toe adjustment sets, but it is in relation of one tire to the other and how straight they travel down the road in a parallel relationship to each other. This setting will cause tire wear, but it is a common misconception that it will cause a car to pull. It will not cause a pull. It will however cause your steering wheel to be off center, or crooked.

Camber is the adjustment of the top of your wheel leaning in or out in relation to the bottom of your wheel causing the tire to ride more on the outer edge of the tread, on the inner edge of the tread, or squarely on the center of the tread as the tire was intended. This setting will cause tire wear, will cause a car to pull one way or the other, and in extreme cases of being out of manufacturers specs can cause unstable and erratic handling. Some cars have adjustments from the factory for camber, though an increasing amount of cars require purchase of aftermarket cam bolts or bushings in order for the camber to be adjusted. This is particularly true of a lot of imports like Toyota and Nissan though it varies my make and model.
Caster is the least needed adjustment and is in some cases not adjustable on some makes and models. It is the measurement of the angle of a line drawn through your upper and lower ball joint in relation to the ground. Imagine a line traveling from the top of your tire to the bottom that is straight up and down. If you leaned the top of that line toward the front or the rear of your car, that would be the movement of the caster. The rake angle on a bike is the same thing. Caster adjustment affects the straight line stability of a car and how quickly and easily a car will turn into a corner. Caster does not cause cause tire wear and will not usually cause a pull, except in extreme cases of caster offset between one tire and the other.

Sometimes a manufacturing flaw in a tire will make it cause a pull even when the tire is brand new and with a perfect alignment. This is commonly called a radial pull. To diagnose a radial pull, swap the front tires and drive the car again. If it is a radial pull, the car will now pull on the opposite direction as it did before.

Some other causes are tires already irregularly worn from a bad alignment, worn shocks, or lack of proper rotation. Also, mismatched size tires on each side, uneven tire pressures on each side, and early signs of tire malfunctions such as a broken or separating belt inside of the tire carcass. Broken or separating belts are most commonly accompanied by a shake or vibration and may or may not cause a pull.

A lot of things would have to go wrong for the bank to do that. First of all, I am assuming that the only security for the loan is the deed of trust on the "old house." A lender can only put a lien on the new house if you consent, or if they obtain a judgment.

Most lenders in California foreclose nonjudicially, at a trustee's sale which does not involve a court hearing or lawsuit at all. It takes about 4 months from start to finish (assuming there are no postponements). California law has anti-deficiency provisions. The one that comes into play here is set forth in Code of Civil Procedure section 580d. That section prohibits a lender from obtaining a deficiency judgment after exercising the power of sale in a deed of trust by way of a trustee's sale.

For a lender to get a deficiency judgment, the lender would have to file a lawsuit to foreclose. Those are incredibly rare, because they are expensive and time consuming. There are other anti-deficiency provisions that apply to these types of sale, such as a prohibition on a deficiency judgment for any purchase money loan. (See Code of Civil Procedure, section 580b.)

There are, of course, exceptions to these rules, such as lawsuits for fraud or bad faith waste, but they are also rare. As I mentioned at the start of this answer, a lot of things would have to go wrong for that to happen.

If he didn't receive the summons, then he wasn't summoned to court. If the person who issued the summons wants a court order, they must prove service of the summons. If the summons was properly served and ignored, the person who was summoned is subject to arrest. However, if it was never served then it is if the summons doesn't exist.

The very same day the 3 day notice to pay or quit case was dismissed by the court a 30 NOTICE was then served. Again, no rent is due. These notices are all generated by the homeowner. I have no contact or contract with this out of state homeowner. I am an authorized month - month Subtenant. The master tenant has an active, valid lease with 5yrs remaining and never a deliquency or ever any lease breach issues. Is this considered a retaliatory eviction since the only problem noted was my defense of the (bogus) 3 day notice to pay a nonexistent debt?

No. The eviction is not retaliatory based on what you have provided. It would be retaliatory if you had exercised the repair and deduct remedy, complained about the condition of the unit to the landlord or a public entity (like the Department of Housing), filed a lawsuit based on the condition of the unit, or caused a public entity to issue a citation to the landlord. (See Civil Code section 1942.5.)

You will have to break out a small area of the surrounding concrete first. Then you will use a Heavy Jack and Chain to pull the pole out of the ground. If the chain will not stay fixed when wrapped several times around the Pole, you may have to drill a hole through the Pole and put a Rod or Bolt through to secure the chain.

Or, you can contact a concrete cutting service. They have boring saws that will easily deal with the thickness of the concrete of your garage floor (after cutting the pipe off). Takes about an hour, is so much easier, and leaves a much smaller, easier hole to fill.

With all these additional fees, that are not part of the lease we signed over 15 years ago, is this legal? In my opinion we should have been asked to sign a new lease when the park was sold, or even when they decided that trash was no longer to be included in the rent we were already paying. The lease that we signed stated that these fees were part of the monthly rent.

I'd have to see the lease to make this judgment, but it sounds like their actions are not legal. They may be in breach of the lease, which would entitle you to recover the payments for trash pickup and for a declaration that they may not charge you for water meters.
