It depends on how the will/deed reads. If it says "I devise all the real property located at...", then I'd argue it means only the real estate and improvements, which would be the house and fixtures. If it says "real property, improvements and contents", then it would be different. But it also may depend on what the rest of the will says. Most wills would give the life estate in one paragraph, and would then have another paragraph saying something like "all the rest, residue and remainder of my property, whether real, personal or mixed, of whatever nature and wheresoever situated, I give, devise and bequeath to....". If that's in there, I'd say the furnishings don't go with the life estate.

However, if the children do not want to keep this arrangement and they can testify in court to their objections, then your child support will be based on the income of yourself and your ex-spouse only (not your new wife's income). Custody is now known as time sharing (there is no primary residential custody). The time sharing will determine the amount of support you will pay - how much time will you be spending with the boys - who is paying for schooling and supplies, sports and uniforms and after school care, tutoring etc.

Some traction control systems back off the engine throttle when a certain amount of wheel spin is detected; when over-done, this often makes the car feel as if the engine has stalled. My '05 Honda Accord Hybrid has such a system and it's bad to the point of being unsafe. You'll get halfway through an intersection and the car just stops moving. It won't start again until the gas pedal has been released for a second or two, but you have to turn off the traction control in order to get going in a reasonable amount of time. In a recent storm, the traffic light changed while I was trying to disengage the stupid thing. I should add that not all traction control systems behave this way; my '99 Chrysler LHS had excellent traction control that only had to be disabled once or twice a year (when the snow got really sticky). I've heard that the worst traction control systems are on Toyota Priuses.

While you did not ask a question, if any of the three heirs are concerned with the criminal activity, that sibling (be it your husband or otherwise) should have already seen a lawyer and made an appropriate probate court filing. You never address the only important issues. Is there an estate pending and who is the executor? The house should never have been emptied before the executor has had a chance to inventory and appraise items for tax purposes as well as distributing the estate. Obviously the executor has been lax here.

The executor immediately needs to apply for probate and failing that anyone else may do and get a restraining order preventing any further dissipation of assets. Once appointed, a personal representative will be able to compel return of the items and if not returned may seek other legal relief.

That lets me win the battle, however it is still $825 down the drain. The tenant is a serial complainer. He has been coming up lately every month with different defects in the house as a way to decrease his monthly payments. He also complained at the end of the month but today he sent a formal letter saying he is withholding the rent until all defects will be fixed.

I am tired of his behavior and simply want him out of the house.

I think you'll be better off with a 60-day notice. The tenant is probably sophisticated enough to know he/she has defenses to the unlawful detainer you'd have to file and would indeed raise those defenses. You might prevail, but probably the more certain route will be better overall.

Under the law, a tenant can only withhold rent after giving the landlord reasonable time to effect repairs and to the extent the tenant actually spent that sum of money, not to exceed one month's rent, for those repairs. The tenant can not say I will not pay the rent until you make the repairs but myself will not do any repairs. However, when the tenant is then brought to court in the unlawful detainer trial, he can assert a Green v. Superior Court defense that the building was sub-standard so the full rent is not owed. Judges often buy this as a argument and reject evicting the tenant but do tell them they have to pay a lesser amount.

If the tenant has lived there, on the date of service, less than one year you can give just a 30 day notice that you are not willing to renew the month to month tenancy.

Find out how long it will take to go to court and having a hearing; if you can not be heard any faster for a three day notice than a 30 day then going with the 30 day notice is faster.

I think my colleagues have missed a key question before answering yours: are the defects that the tenant complains about defects that render the premises not legally habitable. The tenant is only legally entitled to the premises as they were rented at the outset of the tenancy, provided the property remains habitable. The repair and deduct, or rent withholding remedies are only allowed A) if the defect makes the property not habitable under the law, or B) if it is some form of damage or deterioration not caused by the tenant, not normal wear and tear or tenant-responsibility maintenance, and that materially affect the value of the property compared to when it was rented. Old paint, worn carpets, and a host of other things that tenants may complain about are not grounds to withhold rent or repair and deduct, and a tenant who withholds rent without justification can be evicted. And you should read up on habitability. It doesn't take much to make a place habitable; basically running hot and cold water, working sanitation, mininum natural light, heat and electricity, and enclosure from the elements and vermin. Not much more. So unless you are a slumlord, give him a 3-day notice on the rent, and if he doesn't pay, evict him. We are settling an estate valued at under $300K. We were under the understanding that there would be no taxes due anyone. The attorney transferred the house out of the estate to the heirs (over 20 of us - we all own shares).

Now the settlement agent tells us we will all receive 1099's for the sale of the house. Now, if the home was left in the estate, the CPA we hired would have worked this out (taxable income or loss the estate incurred during the settlement process) without individual cost to the heirs. Also the attorney has already taken 3% of the value of the estate. He valued the house at $130K and it only sold for $65K. Are we being taken advantage of? How do we handle the 1099's and moreover why should we have to hire our own CPA's?

Without finding out more, you may very well have no issue at all! While a 1099 is always required, it doesn't automatically mean that any tax on a gain is due. Normally, the date of death decides the value of the realty, and a market value should have been received at that time. The original cost of the realy by the decedent is "stepped up" from its original cost basis to the market value as of date of death. That is the value that is used to determine if there is any gain on sale that is passed through to the beneficiaires. e.g. if the house was valued on date of death at $150,000 or more and it sold at the $60,000 then there is a loss, that is not re captured by any of you, but there also is no gain, and therefore nothing to worry about if it was done correctly.

Further unless the Will itself stated that the property must be sold first which would have prevented the closing of the probated estate, there might be a good reason for passing it out to all of the beneficiaries in kind. If the estate remains open due to requirement to sell the realty, or personalty by the Will itself, and it is a poor market for re sales, this could cause deaths or guardianships of the beneficiaires to further complicate everyone's lives in addition to costing a good deal more money. I have often drafted a temprorary 2-3 year trust (subject to extension) ageed to by all beneficiaires through signed consents, for the PR or someone else to become the Trustee, and then have the PR assign or convey the realty into said trust. This would permit very good flexibility and provide for subsequent death's or incapacity of the Beneficiaries etc. without tying up the probate estate and permit it to close in normal course.

Hope this helps some, if so pass it on to all the beneficiaires that may be complaining at this time.

I was leasing the duplex through a realty company and the lease contract ends in July 2012. I am fine with paying the rent until the duplex is rented out again, but the owner is demanding that the total of accelerated rent be due immediately. Everyone has already moved out and we made the house ready, and in better condition than when we moved in, for new tenants to move in. The owner has stated that if we do not agree, he will be contacting his lawyer.

In the lease it states that I will owe them if we were judicially evicted, but I do not know if that was the case or not. I was told over the phone because I had already gone home for break. The realty company is saying that because we signed a joint lease I am still responsible for everything.

You need to take the lease to a local real estate attorney. It sounds to me like you are liable for the rent until the place is released. In Texas, landlords have a duty to mitigate damages, which means they have to make commercially reasonable efforts to find new tennants. I would tell him that if he wants to call his lawyer, then do it. In the mean time, I'd find my own lawyer.

Landlords bully college student tennants all the time. Your own lawyer can carefully read your lease and tell you whether you're being bullied or if you need to write a check.

If the business owns or leases the outdoor area, then it can forbid people to smoke there. It's private property, and the owners get to make the rules. There are some limits to what the owners can require or forbid, but there is no law that requires them to allow smoking.

How far away do you have to be from the business before you can smoke? As far as the property line -- and even there, you can only smoke if the owner of that land allows it.

Can you be arrested for smoking if the police are called? That depends. But even if smoking can't get you arrested, trespassing can. That's what you're doing if the owners tell you to leave and you insist on staying.

There is no definitive answer to your question. Childcare is factored in as a part of child support when it is for the benefit of one or both parents to engage in gainful employment. The underlying purpose is so that the children are cared for by both parents.

The question is whether or not the cost of an Au Pair is reasonable and necessary for this purpose. That is for a judge to decide based upon the information presented. Since an Au Pair may cost more because the Au Pair would lives in the home and she would be present for the children 24/7 and not simply to ensure that each parent can work a full-time job. Depending upon the cost, the qualifications of the Au Pair, the extent of the special needs of the child, the reason for the need of an Au Pair from another country, the amount of the SSI, and the need and ability of each parent to pay for the Au Pair.

If both parents have joint legal custody or their is no court order setting forth the legal custody of the children regarding decision making, then you should rightfully presume that you and the father of the children each have a 50% say in the decision to hire an Au Pair and the details as well. You should not unilaterally hire the Au Pair and assume the father will be required to make any particular payment.

Is there a real issue with the child being with his grandmother on his father's time, or are you just trying to create conflict and push your ex's buttons? Unless there is a genuine objective problem with him going with his grandmother, or there is some doubt that your ex actually authorized her to pick him up, no court is going to side with you on this. Stiring up unnecessary problems and playing picky games is a sure fire way to get a court to side with the ex in any future custody proceedings. In fact if you and your ex are so filled with conflict that he thinks it's better to defuse things by refusing to do pick-ups in person and sends his mother instead, every judge I know will be very happy with him proactively taking steps to defuse and disengage, and you refusing to let the child go with his mother will be looked on very very badly. Now like I said, if there is a genuine problem with grandma, like she drinks and drives or is otherwise a danger to the child, or if there is a genuine doubt she was authorized to get the child, that is another story. But if you are just looking to push your ex around and make him come in person, you need to start putting your son first and find a way to get over things for his sake. The last thing he needs is a mom stiring up legal conflicts in his life to punish or get back at his dad.

To have liability, there must be a duty owed by the defendant to the plaintiff. While preventing crime is required to some extent, the landlord does not have to make the area a crime free zone. That is especially true where it is a mobile park so open to cars coming and going at all times. Filing a claim in the superior court might be a better way to go, because there is an attorneys fees provision in civil cases for wage violations which applies more pressure on the employer.

It's important to act timely, because of the statute of limitations that only allows to recover wages for 3 years and in some cases 4 years dating back from the day of filing a lawsuit.

Yes it's legal. Since you were on a VA driver's license, you will have to abide by their rules. Once you comply with VA rules, and you get the all clear from them, then you can get a FL driver's license. Generally speaking, such a clause is called "liquidated damages" and many times liquidated damages clauses are invalid unless it can be proven that the amount relates to actual damages sustained as a result of the breach. The other language you quoted is called "specific performance" and it typically relates to non-compete, non-disclosure and non-solicitation provisions.

I ran out of the store, stupidly forgetting my bag. I waited for about 20 minutes until the blond girl left. Then I took off my jacket and let down my hair, and went inside. I saw the store manager/security taking my bag away, and when they saw me they asked if it was mine. I said "YES!" and pretended to be relieved. They told me to come to a corner. They asked me where my black jacket was. I said "what jacket?" They repeated the question. I said I had no idea what was going on and had no jacket. I pretended to be angry.I said I forgot my bag in the store as my mom called me and I left CVS. I told them how I was so forgetful, quite convincingly and citing specific examples.The security told me that someone saw a girl in a black jacket stuffing something in her pockets. I said I had no idea what this was about, that I own no black jacket. The security asked the lady at the counter who waved to me before to identify me, and she said that I looked different but she wasn't exactly sure. I started crying. He said, before I give your bag to you, I need to verify this is your property. Show me your ID. I did not have any photo ID in my bag. He refused to give the bag to me. I told him I would do anything to get my stuff back. He was about to call the cops. The other lady stopped him and said "isn't there another way." Another shopper got involved and said "c'mon, the lady at the counter already said this wasn't the girl" The security guy said "okay, call your mom, I will speak to her" I was dailing the number but I stopped and said, "please, she's going to be so mad at me" he said, why would she be mad if you didn't do anything wrong. I said, because she hates how I forget stuff and a security guy is calling her. Then, his partner asked him to check the security tapes. Interestingly, the security guy did not respond. Instead, the security guy said I'm going to call the cops. He picked up my binder and asked "is this yours?" I said yes, open the first page of the binder. He looked at it and I read aloud everything on the first page from memory. It was my english binder and I correctly identified the AP English class, my teacher's name, what was in the pockets, and what high school I went to. My transcript was in there and I'm sure he saw my straight-A's and 4.8 GPA. He then let me go. I was weeping by that time. His partner led me out, and I said "I guess I can't buy anything anymore" and she said"no ofcourse you can!" and kind of smiled. As I left, the security guy asked the lady on the counter AGAIN if I didn't match up with the person she saw earlier. I did n't hear the response. I ran all the way home.

Basically, the blonde girl reported a girl with black jacket shoplifting or acting suspiciously. The store found a backpack next to the reported site. When I went into the store to retrieve this backpack 20 minutes later, I changed my appearance by removing the jacket and changing my hair. The thing is, if there were security tapes, and I did not see any cameras and again I stole discreetly at first until I became overconfident, will I be arrested or fined? The security guy might remember my name and knows which high school I go to. If there are security tapes, and again he was hesitant about viewing them in the first place for a strange reason but was ready to call the cops (hinting that there might be none, but then again his partner brought them up), these tapes will undoubtedly show the truth. I don't know what to do. Will I get Caught? I hate myself and do not know what possessed me to do such an act. I have been suffering and been bullied and ridiculed because of my dark cirlces, and that's why I went crazy when I saw products claiming to fix them. I am an immoral person and hate myself.

As long as you still have the title you can go get the camper but trespassing charges could be pressed. You can file suit to have the camper returned. Send a certified letter, return receipt requested to the buyer's address demanding full payment or return of the camper within 5-10 days. Even if the person fails to pick up the letter, the green card proves service. This along with the title, any written agreements and receipts will be your evidence for court.

OK I am currently receiving child support via support enforcement in Washington state. The NCP asked for it to be lowered and has filed with the court. During the first court appearance the judge order a continuance. in the last two weeks since the first court date I have not only recieved the expected amount of Money, but also two much larger amounts that have been applied to the arrears exactly 1 week apart, I have a feeling the the NCP has another employment. When I call up support Enforcement all that they will tell me is that it comes from a confidential source. What I need to know is whether or not I have a right to that information. I have requested copies of all payment to show to the judge to support my belief of a second income however I have no physical proof.

If the noncustodial parent has filed a petition to modify or just the child support order, after you file your response to that petition, you should try to get help drafting discovery documents. Discovery is where you can ask the other side to answer questions that you have and to produce documents that you request. So for example, in discovery you would write an interrogatory and ask what is the source of funds for all payments made for child support and back child support.

You can also ask the noncustodial parent to produce documentation showing the source of all payments made. This may not help you for a temporary hearing, but it will help you come the time of the trial. You should merely ask that the Commissioner who hears the temporary child support order motion notes in the temporary child support order that whatever figures are entered on a temporary basis, the issue of what child support will be in a final order is reserved and retroactive to the date of filing of the petition by the noncustodial.

when i am looking at buying a car i look at the pros and cons of it not just advantages. the pro is gas milage. the con's are you have to replace the batteries every 4 years witch is about the same cost as driving a car that gets 4 mpg daily for 20 years in gas. (its pricey to get the batteries replaced) believe it or not a semi pollutes less than a prius if they both drove a mile. so so far they are bad at a cost stand point and a pollution standpoint. sure they save some mpg but u have to pay double what gas would have been on a gas guzzler in order to change the batteries.

I am planning to purchase a Fannie Mae property from Fannie Mae, to live in as the owner occupant. My father will be an "FHA non-occupant co-borrower" on the loan. We've signed all of the documents together so far, but the contract has an "Owner Occupant Certification" Rider that says:

"This is to certify that consistent with the representation made by me in the real estate purchase addendum, section 4, I will occupy, establish and use the above referenced property as my primary residence within 60 days after the closing and will continue to occupy the property as my primary residence for at least one year after the date of occupancy...."

I do intend to live in the property for more than one year. But my father who is also supposed to sign this will not, as he already has his own house. Does this clause mean both of us have to live in it, or just me? There is a ten thousand dollar fine, so I want to make sure that if we both sign it as buyers, I'm the only one who is required to occupy it.
