This contract contained three tenants including my friend, and another friend who would come into the states in a few days. We moved here on Oct. 2. On Nov.26,2011, My roommate's sister came to the unit, so the landlord increased our rent $1400 to $1550.

On June 4th, the landlord asked us to renew our contract. We did not want to renew it and we will move out upon the lease termination date 10/02/2012.

On Sep 1st. 2012, when giving a rent, we showed our will that we will move out next month. We thought we were done at that time. But the landlord stated we, tenants, must stay until 11/02 since there was no written notice to vacate filled out from us. We were never informed of the move out guidelines and did not know that this was a violate of the contract. So we have lived for Oct. And the landlord mentioned nothing about written notice when giving a rent for Oct. And the landlord knew that we, tenants, will move out. On Oct.24, the landlord asked us to send written notice. So I sent the written notice that day. And now, the landlord insists that we should stay one more month.

Without reviewing you lease agreement it is difficult to give you a definitive answer. However, under most circumstances there is no obligation to give written notice at the end of the lease when you are not planning to stay over. The notice is usually necessary when you want to stay, not when you want to move. It seems like your landlord has conned you.

Employer required me to work on projects outside of work hours without compensation, would force me to fraudulently alter documents before State audits to show that they were compliant with State regulations, and would approach me during the work day in front of the staff and scream at me at the top of her lungs. I would receive phone calls at all hours of the night with my employer set about something new and she needed someone to scream at. I had at least one meltdown at work a week where I had to isolate myself and just cry after being screamed at or belittled by my employer. My stress from the work day built up to the point where I was having regular severe acid reflux which was causing me to miss work and my anxiety grew to the point where I could not sleep and I would literally tremble when thinking about going to work. I loved the industry I was working in which is why I stayed for as long as I did. Eventually it got to the point where my physical well being was more important than working for that company. I was approached with an offer for a change in my position at the same company and jumped at it. The harassment by my employer did not stop even after I changed positions so I chose to look for other work in the same industry because I was still having severe anxiety, acid reflux, and began having nightmares. I found another job in the same industry and wanted to just let my former employer be and not bother with them anymore. A few days ago I received a letter in the mail at my new place of work from my former employer's lawyer stating that they found out where I am now working and that I am in breach of their no compete agreement and that they believe I stole their client lists and have been calling and stealing their clients, which I haven't. Now all the stress and anxiety is coming back, I can't sleep and I feel fearful and tremble of the thoughts of past harassment that I had gone through. While I worked with my former employer, I witnessed her sue at least 4 of her previous employees and the thought of her coming after me too is making my stress and anxiety spiral out of control causing me to suddenly start crying at the thought of it. I need to find out what I should do in this situation because I just want to be left alone.

He never had me fill out a W-2 or I-9 the week I worked there and then never put me back on the schedule.

I tried to contact him the next week, but I never heard anything back.

Then after about another week, he texted me and told me to bring in my identification so he could photograph it for the files. I refused so then he sent me the forms to print out and turn in. My fiancee turned in the W-2 and he text yelled at him for not including a copy of my ID.

After a few more days he started texting that if I bring in my ID for photographing, on his IPhone. I could get my check on the spot.

I went in with a b&w copy I payed for at kinkos and a letter requesting my tax information. He grabbed my ID copy and ran to the back room saying I'm not getting my check because of the tax info request.

The police were called but they said it was a civil matter.

He never asked for or saw the originals.

You won't find any laws on this; it's purely a matter of private contract. Many shopping-center leases give the first tenant in a particular line of business some kind of protection against the landlord renting to anyone else in the same line of business, or selling the same kind of goods. For example, the first frozen yogurt shop or the first shoe repair, will have a promise in their lease that the landlord will not rent to anyone else selling frozen yogurt or repairing shoes.

For some widely-sold products, maybe fast food hamburger places, the leases would not be so restrictive; Burger King and McDonalds are big enough to coexist without putting each other out of business.

The only way to tell if there is a prohibition against the restaurant selling bread, it would be necessary to ask the landlord if the bakery's lease precludes this. If it does, that's legal. In that case, I would suggest that if the restaurant wants to sell bread on Sunday morning, the owners of the two businesses should work out a deal. Maybe the restaurant could agree to carry bread from the bakery as well as its own bread in exchange for the right to sell bread at all.

Courts have OK'd clauses of this kind as not illegal restraints on competition, because there are so many shopping centers and the restraint is very localized in effect.

It would be foolish to not retain counsel. A lawyer may be able to negotiate a disposition where you would keep your license.

So you have two choices. Go to court, get a hefty fine and lose your license, or get a lawyer, who may get you a better disposition.

As per our divorce decree, my ex-husband was supposed to refinance his property within 6 months and take my name off the mortgage and title. The deadline was jan 31 2013 and it is more than a year since the financial stipulation, yet he has not refinanced or otherwise tried to take my name off the mortgage.

He bought another house last year before he refinanced the property that has both our names because it was to his advantage to show the he was not solely responsible for this property. He thinks I am not aware of it and now when I ask him about the refinance, he says his debt-to-income ratio is high due to his student loan and hence he cannot refinance but he will keep trying.

A mortgage broker that I know said she could try to work with him but he has not responded to it or provided me any other options or proof that he has even tried refinancing.

I cannot afford an attorney and will be representing myself.

How do I proceed? Do I need to file a new case now? Or can I write a letter to the judge that was appointed to our divorce case for a meeting to discuss options?

I understand that my tenants require 60 days notice under California law, so my question is whether the 60 day clock started from when I notified my tenants in writing 30 days ago or does it begin 60 days after the close of escrow?

Neither. Notice that you are selling the property is not notice of termination of their tenancy. Also, if they have a lease, rather than a month to month rental, they are entitled to stay until the end of the lease. If they are month-to-month and have been there a year or more, you must give specific notice that their tenancy is terminated. It is independent of the timetable for the sale and escrow. It is simply 60-days from when you give a proper notice of terminating the tenancy. Just notifying them of the sale is not notice that the tenancy is terminated, since the sale could be to an investor/buyer who just wants to take over as landlord. Also, unless a condition of the sale is that you get rid of the tenants, you really don't have to do anything. Just keep collecting rent up until close of escrow, and make sure to transfer the tenants deposit to the new owners. Then it's up to the new owners to deal with both termination of the tenancy and the deposit.

They have 6 years from the date of the offense to bring charges. It can take anywhere from 6 months to a year for the lab results to come back. It is probably not likely that they would file charges after 3 years if they have not done so already. However, they may very well have filed charges and you just don't know about it. You could very well have an active warrant. I would call the court to see if you have an active warrant for your arrest.

After 14 months the previous owner contacted me and threatening if I do not start to make payments she will report the car stolen. Since then she has obtain an attorney regarding this issue. Well, first of all, if you have not made payments in two years, you should be sued, and there may be a pretty good argument that you did steal the vehicle. Having said that, the attorney's communications with you likely are required to comply with the Fair Debt Collection Practices Act. Additionally, an attorney cannot threaten criminal prosecution to gain advantage in a civil matter. This does not in any way affect your responsibility for paying for the vehicle, however.

His DUI is more recent and he has been put on probation for that . A few days ago apparently he was pulled over for driving without a license since it was suspended or revoked due to DUI. His mom tells me he is in jail but will not give me any other information. However I called all the county jails he possibly could be held in and they said his name was not in the system and they didn't have him in custody. I just don't understand . My question is ... Is there any possibility of him not being in the systems but really being somewhere in custody? It's possible that when he was arrested he gave a false name. When one is arrested they take the arrestee's fingerprints and quickly find out the person's real name but he may have been booked under a false name. On a previous arrest he may have given a false name and he may be booked under that aka. It is also possible that he was booked under the name that is on his birth certificate and he goes by a different name. Another possibility is that he is on probation out of county and that he was transferred to the county where he is on probation. Jail's are notorious for getting names wrong.

The total amount of back taxes was around $12,000 and the amount witheld from my refunds was around $9,000 leaving about $3,000 owed to the IRS. To make sure I would not be responsible for any additional it was put in the divorce decree that my ex-spouse would be responsible for paying the remaining amount. Since the IRS does not honor a divorce decree I filed for innocent spouse relief and it was granted. My ex-spouse did not dispute it. I have since received a refund of the nearly $9,000 that was previously withheld. My ex-sopouse now is threatening to sue me if I do not pay this amount to him or the IRS. He is insistant that I have done something illegal by accepting the refund. The exact wording of the decree is as follows: "The parties owe a joint tax liability for 2007 and 2008. Wife paid the bulk of this debt when her 2009 tax refund was intercepted to pay it. By agreement of the parties, Husband shall be responsible for the remainder of the debt owed as of December, 20 2010, and shall indemnify and hold Wife harmless from all liability for that debt." Does he have a case against me? Have I done anything illegal by accepting this refund? (This divorce was granted in IN and I reside in FL.)

How did you obtain the refund? Did you request it or did it just show up? Innocent spouse post marital is usually a separation of the parties' liabilities. When they recalculated your income, obviously you were owed a refund, so I don't believe there is anything illegal about accepting the refund. They should have recalculated his income as well and whatever he owes he owes. I think it is possible that the divorce judgment has been rendered moot by the IRS action and he stood by and didn't contest it. In other words, the three thousand may have increased, gone away or gotten smaller due to the seperation of liability. However, you should consult your divorce lawyer as each state is different and divorce issues are very much in the discretion of the court.

I wrote an offer to purchase a home on a standard CAR form. It turns out that the property was going to auction shortly and I was to deal with the auction company instead of the lender. The auction company has their own contract of which is very exclusionary; in other words, you basically have no rights to inspect, ask for a termite report, ask for a reduction in cost due to defects or condition and it supposedly supersedes the CAR purchase contract. Since I had inspected the property beforehand, I was okay with the exclusions, however, a couple of the conditions I requested were a termite report and an equal split of the escrow charges.

I never received a formal acceptance of my offer and didn't know for sure where I stood until I received escrow instructions approximately three weeks later. There was no evidence of the escrow charges being split and my portion was going to be $1100. I am a paralegal student and buy and sell homes to help finance my education and I have never paid more than $750, so I thought this to be exorbitant.

The day before we were to close escrow, my dad unexpectedly passed away. Thinking I was going to have to help pay for burial due to an extreme financial hardship, I asked for a reduction in cost to help cover the cost of escrow and whatever my mom felt she would need to assist with the plans. I know this is not a legal argument, however, all they had to do was accept, reject or counter.

I have yet to hear from this auction company and the last I heard, they cancelled the sale and put the home back on the market. I am still waiting for a cancellation of escrow and the return of my deposit or some kind of communication of their intent. I am still interested in purchasing this property, so at the direction of my realtor, I submitted another addendum indicating that I would proceed at the original agreed upon price. In addition to this, I asked for them to waive the per diem for extending the closing and I asked for an extension until the end of this week. Still no response.

You don't have a legal problem, and have not asked any legal question. It seems to me you have a real estate agent problem. How can you be in escrow and not know if your offer has been accepted? How can you be making last minute changes to the terms and timing of the escrow and not know exactly what's going on? How can you not know if the sale has been cancelled or not? It's your real estate agent's job to keep track of all that and keep you informed.

I used the UPS store to ship a floor buffer to an address less then 75 miles. The machine never reached its destination and was returned to me with the metal handle snapped wires ripped. UPS claims they attempted delivery but the recipient says they never did. They also claim i improperly packed a fragile item. I purchased bubble wrap from them and used my own box. I did not purchase insurance. I want to take UPS store and UPS to small claims court. Are they liable?

Just remember for anyone considering SCC: It can take multiple visits. Is it worth your time? You could be making more $ just staying at work. And big corporations are GREAT at getting things delayed and excuses as to why the previous decision s/b overturned. It took 4 trips to get a HUGE Bank I beat 3X in a row PLUS contacting the CEO to get the money I was awarded 3X, which just showed up 20 minutes ago after a year. Yes, there is only supposed to be one bite at the apple but that often does not happen in SCC AND the poor staffers are very overworked and you show up multiple X only to be made to come back. I wish I could say this was an exception-it is not, and it happens with all size defendants but esp big corps. And yes, these big corps have delays down to a science at every level of litigation. The judge will usually ask the DA if he or she will stipulate to the return of the property, so it is prudent to ask the DA to so stipulate to the property's return. I trust your case is resolved if you are asking for the property back. If your case is not resolved, it will be very tough to get the property back. Be sure to check, too, with the police agency holding the property about any type of form you must fill out to request the return of the property. Otherwise, your failure to assert this request may be deemed a waiver or abandonment of the property if not asserted within a certain time.

You do not say whether you have a court-ordered parenting plan. If so, you both are bound to abide by its provisions, unless you agree in writing signed by both of you to change it. You can enforce the parenting plan by filing a motion for an order to show cause why she should not be held in contempt. You can also show the plan to the police and have the police arder her to comply.

A better option than either of those is to negotiate a new plan that is mutually convenient and both of you sign it.

She cannot refuse to allow you to see your son if you go the ordered meeting place at the ordered time.

If you don't have a parenting plan in your court order you should petition the court to get one.

I take it you have been on the job a very short time -- you still have time to find an occupation that doesn't involve hurting children and families. Your sense of ethics is admirable but quaint. This follow-up answer is in response to attorney Becker's remark that he found my answer "unhelpful and offensive."

Somewhere there may be a child welfare agency at which decisions are made according to the best interests of the children, and not according to what decision minimizes the agency's liability, or what decision maximizes the agency's funding. Unlike Mr. Becker I do practice in this area of law, and I have yet to find such an agency.

It is far less likely than you imagine that you, or your agency, would be successfully sued. Follow your sense of ethics.
