Banks have no obligation to pay checks more than six months old:

HOWEVER, the "drawer" of the check is certainly still obligated to pay you. Just ask him/her for a new check. If they refuse, you'll want to document the fact that you presented them with the check, made due demand that they honor it and pay you, but yet, they still refused.
Then, if they still refuse to pay, you can bring them to court.

They do not trust either set of grandparents to take care of him the way he needs to be taken care of. Our issue is, can we make a document with them signing and notarizing it giving me custody to where them nor the grandparents can just walk in and take him without hiring a lawyer? There is a statute that provides for a specific power of attorney that lasts up to a year and then can be renewed. I would have to research whether the parents being minors would prevent them from legally signing such a document. Also, there is a statute which allows a Court to grant custody to a third party under certain circumstances. In any event, the situation calls for an attorney. How important is this child to you? Important enough to find a way to come up with legal fees and costs? Or, not?

It has been said that unrealistic TV (i.e. cartoons that show violence etc.) are bad for children's health but realistic programmes like documentaries can be good. Of course it is a case of checking the content- some documentaries aren't suitable for children so be causious with regards to what they watch. Also be careful with the timings they watch TV for- TV should be watched in moderation- (i.e. don't let them watch hours of TV a day). A maximum of 2 and a half hours of TV a day would be plenty.

Now years later, the letters have resurfaced and a WWII memrobilia website. The are photoed and detailed and the website is offering them for sale. I asked the owner where he got them and he said that he bought them from 2 homeless men. Is it legal for him to sell these letters? They contain personal information that my family does not want out. Please help.

You might ber able to get an injuction to stop the sale of these letters and possilby to prevent their contents form being divulged. This woudl force the seller to prove that he "bought" the letters and they they were not stolen.

My father and brother passed away in 2010 with his girlfriend of 3 years shortly afterwards. They had no assets together as far as I am aware. My father had a very small insurance policy left only to his girlfriend. She was never issued due to the timing of her death. The girlfriend had no other family except a distant cousin who did not even bother to obtain her ashes. She blankly stated she wanted nothing to do with her death. Her close neighbors got involved and would not allow my family to enter the home to obtain the rest of my father's belongings. As a year shortly passes, I am trying to properly handle this matter. I have obtained the Renunciation form for both my dad's girlfriend and her deceased mother since the home is in her name. I recently found out that as administrator of the estate I am only entitled to 5% of each estate: house and life insurance. I am very disappointed with this whole matter because a) I do not even know what is left in the home since it has been 11 months with the neighbors have full access and b) the total of the 5% would not even be one month's salary for me. I was hoping to receive the whole policy to help cover my father and brother's funeral. My family was unable to obtain his girlfriend's ashes until no one claimed it 8 months later. The distant cousin and her did not talk over 30 years. She stated multiple times that she had no family but us as well as she would burn the home before giving it to her cousin. After my father's death, she told me she was going to use some of the money to transfer the home into her name and leave it to my siblings and I. My question is: Is it legal to obtain a letter from the cousin saying with the renunciation forms she does not wish to receive any of the assets and they would be transferred over to me? Can I purchase a plot for the girlfriend with her assets before anything is distributed out? Can I make donations to charities that I know she felt passionately about? With the Renunciation form, without being sworn in yet, can I access the home to see if anything is left? If I do not want to move forward, what happens?

You have raised separate issues. The insurance policy is a non-probate asset ordinarily. What this means is that the benefits go directly to the beneficary named on the policy, not to your father's estate. It was up to your father to name some kind of contingent beneficiary. You do not indicate the timespan between your father's death and the girlfriend's death; you will have to read the policy as I don't know if there is any type of length of time for survivorship in order for a beneficiary to receive the proceeds.
If there is, then the girlfriend would have to survive the required length of time in order to receive the benefits. If she did not meet the requirements. the proceeds would be paid to your father's estate as no contingent beneficiary was named. If there is no survivorship requirement or the girlfriend met the requirements, then the benefits on the policy would be paid to the estate of the girlfriend. The insurance proceeds would be distributed as per her will or, if none, then via the state intestacy laws. If she did not want her assets to pass to distant relatives then she needed to do some estate planning by making a will or trust.
I assume that you have obtained the renunciation form for the estate of the girlfriend and, if you are the administrator, then the girlfriend did not have a will at all.
I do not know why you allowed the neighbors to interfere. First, when your father died, you should have arranged to get your father's possessions. Second, when the girlfriend died, the neighbors had NO authority to do anything and if they were somehow obstructing you, you should have obtained a lawyer, if necessary, and obtained access to the home to retrieve your father's possessions. You should have been appointed as the personal representative of your father's estate to accomplish this purpose.
What you propose is not permissible as you have outlined. If the cousin renounces her right to receive assets, then the assets will not pass to you but to the next of kin, if any. At some point, state law provides a cutoff point beyond which heirs cannot inherit and the estate of the deceased person goes to the state.
However, the cousin can receive her share, which will be whatever is left AFTER the estate is administered and bills are paid. The cousin then can make a gift to you in whatever sum he/she chooses. The cousin can gift up to $13,000 per year free of gift tax.
You ask if you can purchase a burial plot. I do not understand why as you state that the girlfriend was cremated. Do you mean a place to keep her ashes? Funeral/burial expenses are the responsbility of the estate. If there is not enough money, these are among the items that are paid first. You can only use the insurance funds for the girlfriend's funeral expenses but not your father's and brother's funerals.
Regardless of what the girlfriend said she would do, the fact remains that she did not do this and unless you have some kind of written agreement with the girlfriend or unless she made a valid will leaving the home to you and your siblings, then the home will be distributed as per her will (if any) or as per state intestacy law.
You can do what you want with any money that you have in the name of the girlfriend. However, unless the girlfriend made a will leaving money to charities or to be dispersed to charity at her personal representative's discretion, then you cannot use funds of the girlfriend's estate for this purpose. It doesn't matter how much the girlfriend hated her cousin. If she felt that strongly, she would have bothered to make a will or trust.
You cannot do anything UNTIL you are officially appointed by the court as the personal representative (called an administrator if there is no will or executor if there is a will).
Depending on how much money will be in the estate, it may be wise for you to retain the assistance of counsel to help you with the process. However, you should speak to the probate court first to see if that will be necessary.
If you do not administer the girlfriend's estate it will be up to her heirs to do so. I don't see that it is any of your concern other than to make sure that you get something out of it. If you want to access the home, the person who is the personal representative of your father's estate would have the authority to do that but would have to get permission from the personal representative of the girlfriend's estate. From that standpoint, it may be simpler if you were to handle the girlfriend's estate as you can then access her home, take an inventory of what she owned and remove any items belonging to your father.
The commission allowed is what it is - its not a flat 5% but it is graduated depending on the size and complexity of the estate. If it will not be enough to compensate you for all the aggravation, then don't do it. People serve as personal representatives, not because of the commission, but because it is necessary to wind up the affairs of the deceased person in an orderly manner. Usually, this task is performed by loved ones who have a vested interest in seeing that the assets are transferred from the dead person to the dead person's heirs properly. However, if you don't want to do it, there may be someone (an attorney in town) that the court can recommend.

As a Franchise Attorney I can only say the following. If the contact says the deposit is nonrefundable, which you appear to say is the case, that's it. The 10 days is a separate issue - it is the period they are holding it for you and presumably will not sell to someone else. You may be able to get what's called a Certification of Trust from a Financial Institution that has an account belonging to the Trust.That would at least identify you as the successor Trustee. That will at least give you authority to act on behalf of the Trust. It usually doesn't identify who remainder beneficiaries are. The 'new' will is in the hands of a local attorney who has told his children that they have "no right to see what the will says". Supposedly, everything in the estate is going to my brothers "visiting nurse" who just happens to be the attorneys sister. The attorney told his children that "they will be allowed to see the will in six months, after it has gone thru probate". Can this possibly be true? The children are not privy to ANY information?

Almost all of that is completely wrong. Fist, whoever has possession of the original Will (attorney included) has a duty to file the Will within 30 days after death. Once filed, it is public record for anyone to view.
Withing 14 days after opening a probate estate, the executor named in a will admitted to probate must mail notice to all heirs, whether or not they're named in the will. Your brother's children are his heirs. They are entitled to notice. They then have a total of 6 months to contest. The executor cannot hide the will/probate for 6 months to defeat the children's right to contest.
If the Will truly was drawn up 2 weeks prior to death by an attorney whose sister and visiting nurse is named as beneficiary, then there are some serious problems here. The children need to contact a probate attorney immediately.

If so, in addition to all the nasty things that go along with a felony, you would likely lose the car you were driving. At 17 you are probably not able to successfully negotiate a plea bargain with the ADA so you need an attorney. If this is a situation where you are trying to handle things yourself on the down low to keep mom and dad from finding out - don't do that or you may find yourself in jail. Bite the bullet, let mom and pop know what's going on and hire an experienced criminal law attorney if you don't - you are likely to have a very bad day in a couple of weeks.

I am a little confused about your question, but I will throw in my two cents worth. You stated that you have already filed, but a judgment and order has probably not issued yet. If you are planning on staying in the house you will need to refinance and remove her from the mortgage and title. You can't expect her to pay for half of a house that you will be living in and will probably sell someday. Everything is negotiable, but I find it hard to believe that a judge will sign off on your agreement if you are awarded the house and she is responsible for half of the mortgage.

I work for a major retail store and recently discovered that a department manager gave everyone in his department (5 associates) raises just days before he transferred to another store (to my knowledge he asked to step down from management to become a sales associate at a store closer to his home for personal reasons). The associates work in that department but we all help in every department. I have asked for a raise a couple of times in the last month and I was told by the store manager that he is still waiting for approval from the district manager. This smells of favoritism and discrimination. Do I have any legal rights here? Is there anything I can do?

Favoritism and politics is NOT illegal, but a mere fact of life and business. Giving "everyone" a raise, and not you, would not be 'discrimination' unless you also worked in that department under that manager, and can prove you are in a protected class or race, age, sex, religion, disability, etc., and they weren't. You'd have to prove that you were being singled out for 'discriminatory' reasons as the 'motive' for the treatment. It is also your constitutional right to refuse consent to a search, remain silent and not admit to anything (like underage drinking). You should hire an attorney or if you can not afford one, request that counsel be appointed to you at your initial appearance.

So I had a 1000 credit card with BofA 10 years ago, which I defaulted when I was laid off. Apparently they sold the debt to Midlund Funding, whom I never received anything from for several years. Then I got a letter from Howard Lee Schiff on behalf of Midland threatening court. So I worked a deal, and have lived up to it. I recently got a promotion and was almost turned down because a credit check said midland funding had a public record I was completely unaware of. The total also didn't take into fact the payments Ive made to HLS. On top of that while Im paying HLS 100 a month for the Midland account. How can Midlund report a public record I was unaware of and the liability amount as far as my work is concerned hasn't gone down in a year of paying HLS. It is the same account and one is reporting me while Im paying someone else. Its really been a huge hassle with work. Neither will give me much of anything in writing. Should I keep paying HLS? and will this come off my report once its paid(or no because Im now paying a different person)? How can one company say they represent Midland and work out a deal while Midland is adding public records to my credit. Not to mention the balance is now in a third parties hands and is double what it was. Any feedback would be truly appreciated

There is not enough facts to answer your question. First, obtain copies of your credit report from all 3 credit bureaus. Generally, any negative reporting will stay on your credit report for 7 years + 6 months from the date of the original default. Beware of any re-aging by debt buyers (Midland Funding). "Public record" is a phrase I've seen related to law suits. You wrote that Schiff threatened suit. It may well have followed through but you got confused with all the paperwork. Or I may be mistaken. Best to call Schiff to see if a suit was ever filed.

The asset you are planning to acquire may be covered by a security interest in favor of the company that earlier sold the asset to the small software company. When hubby went back to work we contacted the original company and we were told they had sold the loan so we went to bmv to see who held the Lien on it. The company was closed so the bmv told us to send a certified letter asking for a settlement and if it came back unopened then they would issue us a new clear title. We did that and it did come back unopened. The BMV issued a title and we fixed up the van and I resumed driving it. Now I have another company harrassing me saying that they still have a Lien against it, even though the bmv says there is no lien and that they have to do a thorough title search for liens before they issue a title. They are threatening to take it to court, can they do that?

Your rights derive from common law, i.e., not statutory law, so there may be no written "law" that applies. I
Common law is a law of "fairness" taking into account the rights and responsibilities of all parties and generally holds that where there is a wrong there is a corresponding remedy. It is defined and applied by judges in court rulings.
As for your case common law holds that "natural" run-off is not actionable, i.e., there is no remedy for damage caused by "natural" run-off. However, if someone changes a grade so that run-off course is changed to the detriment or damage to a neighboring land owner, there may be a remedy but that would be through a court or threatened court action.

There are several issues involved in your question....
First, when did they get a Final Judgment? A FJ is only enforceable for 7 yrs. unless the Plaintiff re-records it with the clerk of Court. Did Plaintiff get the Jdgmt. after the debt was too old to bring the suit?
Another issue: No one can garnish wages, etc. of a debtor that provides at least 50% of the support for a dependant.
There may be other issues involved which could be identified with more info about the law suit.

The seller probably 'jumped the gun' in selling (or taking deposits) before the project had its final Department of Real Estate (DRE) approvals. The question now is whether the deposit money you put up is in an actual escrow account, and if so, what the terms of the purchase and the escrow affecting your right to a refund may be.
The issues here may be moderately complex. I assume you had no buyer's agent to help you. At this point, your easiest effective next step may be to initiate a discussion with the DRE staff in charge of permitting condo promoters to issue "white paper" to would-be buyers.
Before going to the DRE, consult one more time with the developer, to ask where your money is escrowed, why there is a hold-up on the white paper, and whether they are willing to give you a full refund (if that's what you want) before you initiate discussions with the DRE.

My brother lives with my grandmother, and he has a lease agreement with her. However, he does not pay rent, and he is in violation of his lease terms, although she hasn't made any move to evict him.

My brother has stolen from me many times before, so I went into his room looking for my things, found them, and removed them.
Later on after my brother had returned to the house, he found out that I'd gone through his room and got upset. He denied taking my things. My boyfriend said something on the order of, "you know you took them", my brother got even more upset and assaulted my boyfriend. My boyfriend is pressing charges against him, and there is a warrant out for his arrest.
My grandmother suggested that my brother might retaliate by charging me with trespassing, since he has a lease on his bedroom and bathroom, and I went in without his permission.
I just want to know if there's any way he could bring charges against me, given that I had her (the property owner's) permission to be in the house, given that neither of them told me not to go in his room, it was not locked, etc. I feel like any charges he brought would be a stretch, and I'd like to believe that this is too frivolous to be taken seriously by a judge or a magistrate, but I want to be sure. Any help or information would be greatly appreciated.

He could always try to take out tresspassing charges but I agree with you, it is very unlikely that these charges would be taken seriously...it is very likely that the magistrate will decline to issue a warrant. He coudl go tot he magistrate and tell a different story than you told.
Having your boyfriend as a witness and your story that you had no idea there was a lease and that you did not know you didn't have permission to enter certain parts of the house, coupled with your finding your stolen property in the room will make any District Attorney decline to prosecute.

He is taking home $1217/mth & I assume 17% is what I'll be getting of child support since he has a new child to support (which is fine) but will a judge be more inclided to drop 1/2 child care on top of child support? In our original orders he is paying C.S & 1/2 child care. Also should I get a lawyer for the temp orders? I don't have that much money as it is, aparently he has money coming from somewhere if he got the biggest lawyer in Austin to represent him ... I don't know exactly how to word this question but I don't see how a judge could award him a reduction ... if it's set at $450 now and possibly change it to $200 which wouldnt help me at all... I don't understand how that's right. The questions you ask are why you need a lawyer. But from what you're saying the child support will be aabout $200 a month calculated on the formula which you know about. Nothing in the family code requires him to pay any more - not even for child care. If you going to have any chance at that (and I don't think it's very great), you better get a lawyer; otherwise I predict that you will lose that one. That's why your husband got a high priced lawyer. He's going to save $4000-$5000 a year, which is plenty enough to pay a lawyer.

Yes, if done correctly. Whether it is a good idea, or accomplishes what you want to accomplish, is another question. A local real estate lawyer will be able to handle the deed and your questions for a relatively small cost (especially compared to the expense of doing it wrong).

My lawyer requested a copy of the deed, which my aunt refused. She controls my father's part of the deed and feels that the land will be taken away. My lawyer told me that taking my name off the deed is legal normally, but not in bankruptcy law. He also stated that he has to see the deed. I haven't declared bankruptcy because of finding out about my name on the deed after the initial interview. Is there a way to get another lawyer later on? Is there a period I can wait after my name is removed from the deed to legally declare bankruptcy?

Your aunt cannot take you off the deed. And I don't know why she is controlling your father's part. Is she some kind of a trustee, perrsonal representative or power of attorney?
You have to convey your interest in the land to someone else. I don't know what the property is worth or what your interest is worth. Someone can buy this from you and you won't have to wait, but if you just give your interest away, then you have to wait 1 year.
What your lawyer told you is correct and I don't know why you feel you need another lawyer unless you are trying to commit fraud. If you do that and lie and the bankruptcy court finds out about that (they are going to ask you), then the bankruptcy court will dismiss your bankruptcy petititon. So please, do this legally and do this right.
Its easy to get a copy of the deed. Where is the land located? Go to the register (some states call this the recorder) of deeds in the county/state where the land is located. Look under the grantees using your name or under grantors using the name of the property owner. Or have your bankruptcy lawyer do this.
Then you will know in fact whether you are on the deed and the steps that you need to take to have your name removed. If you structure this as a sale of your interest for the fair market value and have the documentation to prove it there should not be a problem with the bankruptcy court. Otherwise, you will need to wait a year.

You say "on the deed" which implies that the owner of property, with no liens, executed and delivered to you a deed of conveyance to you that vests some interest in real estate. Recording is an effective delivery for these purposes. Thus the deed image is available with the county recorder and is a public document. If it has not been delivered or not recorded, then you are not vested with ownership. The reason this is important is that any interest that you own as of the date of filing a petition in bankruptcy is property of the estate and you must be able to exempt it or the trustee (in a Chapter 7) can take it and sell it to distribute the funds to unsecured creditors. The trustee can avoid any transfer, made without consideration, which occurs within 4 years of the filing of bankruptcy, that is, he can have a "return deed" set aside and sell the property anyway. In some cases, he can go back further if there is the intent to defraud creditors in a transfer for less than value.
However there are options that are legit in bankruptcy. 1. File a Chapter 13 and if your payments equal the non exempt asset, you keep the asset.
2. File the Chapter 7 and let the trustee take the property, or even sell it to family. 3. Sell or take a lien on the property to reduce your equity to what you can exempt. You still have to account for the money taken on the sale or mortgage. One way is to put the money, within limits, into a retirement account. A qualified retirement account does not count against exemptions.
It is important to know all the facts and details. There is not enough information in your question to address your real problems. You lawyer should have discussed these concepts with you. If this is new information, you need to seek an additional opinion.

If you are on property, and give it away, that can (1) prevent you from filing, (2) get the recipient of the property sued if you do file, or (3) land you in jail if you don't disclose it. This could, in some cases remain a problem for years.
Instead of wondering, talk to your lawyer. In many cases, people screw themselves trying to figure these things out. It may be, depending on the value of your interest, that you could keep it in bankruptcy but might lose it if you transfer it.
Regardless of what the outcome in, the worst two things you could have done were (1) conceal it from your lawyer, and (2) signed away the property without legal advice.
