Ca. Law /Lets say I am able to file a motion to reopen a criminal case and the presiding judge see's that what I say is true. Does he or she have the authority to Overturn my case or is this just the begining to a long drawn out process ? If I ask for Civil damages in my complaint, will it be dealt with immediately or do I need to file a seperate complaint for that ?



Answer

Its much more complicated than that. Among the information we would need to know is whether the case went to trial, was there a plea bargain, and how long it has been since the plea or the verdict. You really need to get a lawyer for this.
