If I suffer an injury by slipping on a private sidewalk but elect NOT to sue for medical costs, does my insurance company have a right to sue in my behalf or in their behalf?



Answer

If your insurance company compensate your for medical bills and/or other damages, your insurance has the right to sue the person at fault to get reimbursement for that which they have paid.
