I am assuming you have nothing in writing except the check.They can try to put a lien on your house. I doubt it is worth it for them to pursue that for $100.00. As far as whether them cashing the check is proof that they accepted payment, well sure it is. But, the issue is whether it is proof of payment in full. If you wrote on the check "paid in full" or something similar, then if they cash it they have accepted it as payment in full and you're done. However, there is no law preventing them from accepting partial payments until the job is completed and they may argue that is what occurred if you have to fight about it.

No -- even if you're right about how he got the information, which you might not be.

The Fourth Amendment limits the government's authority to conduct searches and seizures. It does not apply to private individuals or entities. Besides, merely showing up at your grandparents' home was neither a search nor a seizure.

If the process server improperly accessed restricted data about you then he may have broken some laws. You may have remedies available for any such violations. But he didn't violate the Fourth Amendment.

If you're hoping this will somehow undermine the legal papers he was trying to serve, you will be out of luck. If someone properly serves them on you later, the events you describe won't invalidate the service.

A common belief is that, when a child turns 14, s/he can decide with whom s/he will live. It's not true. No Montana law allows a child to be in charge of parenting issues. To every law, there's a "but ...". Here's the one for residential parenting:

Courts have allowed children as young as five to talk privately with the judge, or the child can speak with the court-appointed Guardian Ad Litem if you have one, on what life is like with each parent. The good thing about talking privately to the judge or the GAL is that no one ever knows what the child said. When the child meets with the judge, only the court reporter and maybe the judge's clerk are present (and the court reporter seals the transcript). The GAL can speak generally about the child's best interests but typically will not relay what the child said.

I don't know that there's much you can do about being terminated (unless the terms of your contract provided that you would only be terminated for cause). With respect to the bonus, you might have a claim worth pursuing. Without seeing the contract, though, it's difficult to give accurate advice. Student loans are very rarely discharged in bankruptcy. Unless you went through a trial on the issue of discharge, your student loans were not discharged in your bankruptcy. You will need to continue paying them.

If you don't pay, they will continue to accrue interest and penalties and eventually garnish your wages and take whatever money you have in a bank account. They will never go away.

He should send a letter to the credit agencies about the mistaken identity and a letter to each of the creditors. The letters should be notarized with an oath also indicating his date of birth, since the application for credit certainly contained a d.o.b. If I start a business with the cash and stock assests then transfer rights (books I published and 2 websites) to the business, will the business be protected in a Chapter 7 bk?

This question is difficult to answer. You cannot transfer rights to assets to a business, or anyone else, and think that they will be protected. That is called a fraudulent transfer, an effort to avoid, hinder, or delay creditors. And it is the trustee's job to find assets which are not exempt and seize them for liquidation. You can read about chapter 7 in a pamphlet available for download at my website. As to the 15000 you have, there are ways to convert it to exempt assets, the IRA would not be touched, but an annuity contract may be the solution. Student loans are largely regarded as undischargeable, but the 50000 in credit card debt and the car loan can be wiped off the slate.

When you filed for divorce in Washington, that by itself granted Washington personal jurisdiction over you. The state also has what lawyers call subject matter jurisdiction, meaning Washington has the power to decide how to deal with the dissolution of your marriage (divorce). Do yourself a favor and finalize the dissolution now that you appear to be ready to do so. The Court's personal jurisdiction over you will end upon entry of those final orders (assuming you have no children and all assets and debts are disposed of by these orders).

If however you are concerned about things I may not know about or you are still unsure of what to do, then contact local counsel and pay for them to review your paperwork. The hour you spend on that will be worth the peace of mind you get from knowing it was done right.

The Civil Code covers them; see sections 1813 et seq., but probably section 1847 is most appropriate to apply here. It basically says that upon reasonable notice followed by failure of the owner to retrieve the item, the duties of the custodian cease. As a practical matter, I'd give her one more notice, in writing. Then, if she fails to make and carry out arrangements to pick up her stuff, you can dispose of it in any commercially-reasonable manner, including advertising it for sale, taking it to a pawn shop or secondhand store, conducting a garage sale, or dumping it, depending on value and other factors. The money from any sale belongs to the ex girlfriend, minus selling expenses, of course. Keep records of how each significant item was handled.

(Alexandria is the only jurisdiction in the area as far as I know that currently offers first time offenders the option of completing a driver's improvement course in lieu of pleading guilty. As for Arlington, I'm not sure what they may now offer in this regard--if anything.)

The probation department will contact you and your family to do an interview & background check on you if the prosecution is considering this up front. If not, you may have to go to court (with a lawyer) and get the lawyer to convince the prosecutor to give you this.

You need to be flying right. You need to be in school every day working hard to make the best possible grades. You need to be doing your homework & following your parents' rules. He can however, agree for you to have sole legal and physical custody with no visitation for him. You can agree that you can support the children by yourself. This can be put in a judgment and unless the court thinks the children will suffer because you don't have enough of an income to support them; the court will sign off on the agreement. The upside for you and downside for dad, is that you can always change your mind about receiving child support and get a new court order. Its a lot harder for him to change his mind about giving up legal and physical custody.

You should contact another attorney. I do not think that you are getting a straight answer from your present attorney.

I will state that a felony plea can exhaust a very large retainer since the amount of work necessary to negotiate a plea of that magnitude is substantial. You are entitled to an itemized retainer when teh retainer agreement is for an hourly fee rather than a fixed fee situation.

You should send a written demand for an itemized invoice to the attorney. As for processing the release of the bond, I will need to know if the bonds were done through a bail bondsman or directly with the court.

I have been a buyer and occasional seller on ebay for about 10 years and last year started receiving notices from ebay that I could list 50 auction style items for free (pay when items sell). I started listing items and during the listing process, the items would show no charge or minimal charges (if I added extras) to my listing. But at the end of the month, I would get a whopping bill from ebay that included the full amount for the listing fees. Why is Ebay not required to notify sellers of the actual cost of the listings before the items are listed? They have a pretend 'free' cost on the listings page but then hit you with a huge invoice. Due to this deceptive ebay practice, I've paid almost more in listing fees than I've made from selling items on ebay. I've contacted Ebay on several occasions and was told that adjustments would be made in my account but none have ever been made. I was also asked if I read the fine print and said I thought I did. Ebay apparently uses the fine, fine print which nets them suckers like me.

Ebay should be forced to disclose the 'real' price of the listing before the item is approved for listing rather than the 'free' price that sellers like me are not going to get.

My mortgage that was originally in my mother's name remains in her name as the "estate of" due to the fact that i have never refinanced. They recently sent me an insurance check that is issued to "estate of ..." , meaning estate of my mother. Although I am listed as owner of the property they cannot issue the check in my name. The only way to deposit the check is to reopen an estate account. However since the original letters of administration were in both my brother and my name, I would need him to sign a co-fiduciary form stating he is no longer administrator of the estate so that I am sole owner, eventhough my documentation from when we split the properties already says this. The bank however still requires this co-fiduciary form. My brother refuses to get involved in the situation and does not want any part of it. Since he will not respond how can I proceed without him?

I am not sure why you had to move out. If you were on the lease you had the legal right to remain at the residence. In any event, you can meet with the landlord and explain to him/her that you no longer reside at the residence and provide the circumstances. If your husband moved someone else in, he should have listed that person as an occupant with the landlord. You really need to speak to an attorney prior to filing for divorce. People who try it on their own are often dissatisfied with the final result because the didn't know what they were doing.

It means the defendant is saying you don't have to formally serve him. Usually when a defendant files this type of waiver he has received the summons and complaint by a means that does not qualify as proper service but has decided not to make the plaintiff jump through all the hoops proper service requires.

Service of process is normally what subjects a defendant to the court's authority. It also starts the clock on the defendant's duty to answer or bring a motion attacking the complaint. A defendant who waives service thereby submits to the court's authority and agrees to respond to the complaint just as if he had been served. Aside from the fact that you didn't actually serve him, the case will proceed exactly as it would have if the defendant had been served on the date he signed the waiver.

Note to other readers: the waiver of service is a standard form used in federal court. California state courts have a similar document called a notice and acknowledgment of receipt. There are some differences between the two procedures, but they serve the same purpose.

There is a mistake in my prior answer. I wrote that "the case will proceed exactly as it would have if the defendant had been served on the date he signed the waiver." It will actually proceed as it would have if the defendant had been served when the plaintiff sent the request for waiver, not when the defendant signed it.

The defendant's time to respond in a California state court would begin when he signs a notice and acknowledgment of receipt, not when it was sent to him. This is one of the differences I mentioned previously between the state and federal procedures.

I was put on supervised probation for a crime I didn't commit, they think that I threw a deadly weapon at my sister and that I admit to doing it, but I never admit to it because it didn't happen. My lawyer lied to me and said it would be unsupervised probation. I also have severe social anxiety and thought I understood what was going on in the court room at the time but I was mislead. I couldn't really speak in court because of it and my anxiety caused me to agree with whatever they said. They said my case would be continued without a finding, and I thought that meant they didn't have any evidence besides my sisters word against mine. There was another incident less than a week later where my sister was on drugs and attacked my mother and then me, and I defended myself, hurting her in the process. It was self defense and I won that case because I had video proof of her being the attacker and threatening to kill my mother and me. Both cases were supposed to be dropped immediately until they spoke with my mother who very rarely sees me and knows nothing about me. She told them that she was afraid that I was going to hurt my family and that I may need anger management, which is all untrue because I've been helping my father with everything before and after he became handicapped (he lost his leg to a blood clot). My problem is that I never did anything wrong and I already have severe anxiety and social anxiety so I couldn't defend myself in court. Now my anxiety is so bad that I haven't been able to live a normal life and I'm more afraid than ever about what might happen to me within my probation term. I feel as if I was forced to do what they wanted me to do and not what I think I really should have done, which was explain the situation truthfully and how a lot of what was said about me wasn't true. There was no real communication between my lawyer and I, but I couldn't tell that to anyone in court from the anxiety. Is there any way I can have the case reopened and have it done the right way? Being on supervised probation is making my life so much worse and now everyone thinks I actually did do something wrong, and I lost almost everyones trust and support. I'm having a lot of nightmares from all of this and I feel like I can't live my life the way normal people should anymore. I'm scared of just about everything now and I don't think my heart or mind can take all of this torture.

I have told there mother she needs to clean her home and all there beding and she states that she is, my kids have been sent home from school sevearl time with head lice as well. I have contacted cps in the past about her cleanlieness and they do not do anything. My kids tell me that they go all week long without bathing, when they come over they stink and are very dirty. In my opinion, this is a tough one - since you have tried to resolve this outside of the courtroom, it appears necessary to let a judge handle it, through a petition for modification of the visitation arrangements. Although head lice is easily contagious from school, etc, it is also true that the home environment has to be completely cleaned (through heat or chemicals) to eliminate the lice and the eggs. You will probably need a social study and testimony from a health professional. It could become costly, but from what you describe, it appears to be your only solution. If you believe she would cooperate (or if your decree requires it) try handling this problem through mediation first. It seems a shame to spend so much money on a problem that should be easily corrected. (You will need to document the children's statements, and the incidences of recurrence). Good luck.
