Can I still apply for a returning resident visa? The rule says that I can apply for it if I had the statue of a lawful permanent resident when I left the us.so is this endorsement on the visa can be counted as a permanent resident?

You should have applied for advance parole before you departed the U.S. Since you did not, you might be considered having abandoned your U.S. permanent residency. You should re-enter with your actual "greencard" & be prepared to explain why you left the country for such a long period of time without having obtained advance parole first. It would also be helpful to have evidence on hand to prove you did not intent to abandon your resident status when you left (such as U.S, bank accounts, U.S. real property owned, job in U.S., family in U.S., etc.).

Today he was looking at his checking account online and saw a $250 charge for cable and internet. When we called the company, they confirmed that it was for his wife's address and that his bank account number had been used to pay for it during a time that he couldn't have possibly done it himself. Is what she did against the law? What is the punishment for a first offense?

No, it's not a crime, because technically they're still married and those are still marital assets. He can likely dispute the charge though with the bank, since he didn't authorize it.

I would recommend that he talk to his divorce attorney about it and see if he can get her held in contempt if there are any temporary orders in place that concern the division of their assets during the pendency of the divorce.

The email was not sent to me until 2:30 today for the Thursday hearing and I didn't read it until almost 4pm. 1. Was giving him one week's notice sufficient that I was not going to attend the depo and sending him the quash notice? I could not find anything in the rules that say a time line for canceling a depo. 2. Even though I am pro se, doesn't he have to give me at least 5 working days notice or at least try and coordinate a time with me that is convenient? 3. I only have tomorrow to do anything. If I have to file something disputing his "one day" notice for a hearing, what type of filing would that be?

If you are a party to the cse they are entitled to take your deposition. You cant just file a motion and expect it to be cancelled. You will lose on this issue.

Why are you trying to quash the notice of deposition? Do you have any legal grounds to stop the deposition? Why did you wait until just one week before the deposition to file your motion to quash? Did you expect his attorney to give you a great deal of notice on setting your motion to quash when the deposition is just a short time away? You don't need to file anything, you just need to appear before the magistrate and have a really good legal reason why you can't appear at the deposition and testify with as many records as you can gather together. If you are wasting the magistrate's time, you may end up paying a portion of his lawyer's fees. Litigation is not a game.

While it is always better to get something in writing, people are mistaken when they think a contract cannot be formed orally. We have some exceptions that require a written contract but we don't seem to have that here. Contracts can be formed by one's behavior and/or specific language, such as saying "I'll take it", moving in and living in an apartment. We then would have a month-to-month tenancy but even though there is no written document, such as a lease, there are certain rules. You could be liable for damages and if you don't give proper notice, for rent. I always tell people to take videos and pictures of a place when they move in, then before they leave. Document your notice to the landlord that there are these problems here. Think about what the rental car companies do where they make you circle on a line drawing of a car where there is damage, and if you don't circle anything and the car comes back damaged, YOU are responsible (and let's face it, all rentals have at least some beating up-I draw wide circles myself after careful inspection).

We have not had our land surveyed since we received a copy of the original survey from the mand we purchased it from. Now the land developer wants to take 30 feet of our property, saying the original survey was wrong. He had his land surveyed, but not ours. Some lady hit my car when she ran a red light at an intersection Feb. 25. I have police report and a witness on my side.

I filed a claim with her insurance and not mine cuz everyone told me not to. The claim adjuster on her insurance took her time on finding her at fault even though I had a witness. My car was towed at the scene, i gave authorization to the body shop but they couldnt fix the car until they got the check from AAA (her insurance). Now they wont cover the car rental from Feb. 25 to March 9th because they say i could of had my insurance fix the car and therefore it wouldnt have taken so long.... Technically, i dont have to file a claim with my insurance if im not at fault so why wont they pay?

I mean why should a law abiding citizen have to pay out of pocket and miss paying her rent when the reckless driver doesn't have to pay a dime? Can they do that?

P.S. It's April 3rd... still no car.

Actually you ARE required to make a claim with your own insurance. The other driver's insurance "technically" has ZERO obligation to you. They don't even have to process your claim at all. Insurance companies owe NO duty of any kind to anyone but their insureds. In auto cases, they usually are happy to deal directly with the other driver when their insured is clearly at fault, because that saves everyone money and is a service to their insured. But from a legal standpoint they have no duty to you of any kind, and "technically" they don't even have a duty to their insured except to indemnify them for losses and liability incurred. Your claim is only just that, a "claim" of liability. Her insurance could sit back and wait for you to sue her before doing anything, if they really wanted just to follow the absolute minimum duties under the law. And "technically" YOU have a duty to minimize your losses, including making a claim on your own insurance if it is going to run up your rental bill if you don't. It's called mitigation of damages.

Also, your comment about probate; is there a probate? Are the cars included as debts of the estate? Is the estate solvent? Has the estate been admitted to probate? Did the PR publish notice to creditors?

If the PR published and the creditors did not file a claim then it is possible that the PR doesn't have a duty towards those creditors.

However, this whole question concerns me. If you have been handling this estate without counsel, now would be a good time to lawyer up.

To assist with any probate needs, contact an attorney who handles probate administrations.

This type of situation happens often and it comes down to a question of reasonableness and probabilities. In other words, how reasonable is your neighbor's demand, and what are the probabilities that any harm will occur to property or people?

You should decide how much you care about keeping this tree and what it will cost to remove it. If it is really not a big deal to you, and considering how much it would cost you if it fell down as your neighbor has now put you on notice that it could, then I say get rid of the tree and protect yourself. Maybe you can even negotiate with your neighbors to have them pay part of the removal fees since it is done in part for their benefit.

On the other hand, if you really value the tree or have other reasons to try and avoid cutting it down, then perhaps you should hire your own arborist, have them inspect the tree and issue a written report addressing your neighbor's concerns. You will practically be required to do whatever the arborist suggests, otherwise, if you don't and something happens, then you will have no place to hide. You will have been put on notice of the dangers by both your neighbor and your arborist.

If the tree falls, and your neighbor has put you on notice with a certified letter of the danger, then you are going to be liable. Your insurance company is likely to deny the claim unless you give them a copy of the letter (sent by you to the insurance company by certified mail also) on the basis that you were aware of a particular risk and purposely hid that information from them.

As for how fast you should act, that is also a variable question. My answer is, act before the next storm to reduce your risks. Whether it is necessary to cut down the tree will be based on whether you can neutralize the problem without cutting it down. For example, can you trim enough branches so the tree can survive yet not be unstable or a risk to fall over in a storm?

Before you respond to your neighbor, my suggestion is that you consult a local attorney, have them read the neighbors' letter, and perhaps decide if they ought to respond on your behalf to protect your interests.

On the 18th hole of Pelham Bay (NYC Municipal course), I hit a shot that went left toward the road that runs along the course. From my vantage point, it appeared that my shot was going at the fence, but below the fence line. When I arrived at the spot, there was a gentleman standing at the fence saying that his car had been hit by a golf ball. I told him to pull up to the clubhouse and I would meet him there to inspect the car and we could exchange information. His windshield was cracked and it certainly looked like it could have been from being hit by a golfball. The windshield definitely needed to be replaced.

The gentleman texted me about an hour later saying that the cost to replace his windshield would be $860 and he sent me a picture of the quote. He also told me that his car insurance company would not pay for the damage as it was not his fault and that I would need to cover the whole cost. I do not have any insurance, as I live in Manhattan and do not drive a car. I did some research and found that the typical price to replace a windshield for his make and model of car was about $300. I called the gentleman and told him that I wanted to do the right thing, and that while neither myself or my playing partners saw my ball strike his car and he did not produce my ball that supposedly hit his car, I was prepared to pay for half of the cost to replace the windshield based on the quotes I had received. I made this offer in good faith and as a fair way for both of us to move past this incident. So, my offer was $150 towards his windshield repair, and I provided him with 3 different quotes from reputable automotive shops in the area that were $300 or less. He ended up choosing another option that cost $400 and he is trying to stick me with the entire bill for repair.

Ultimately, I am still prepared to pay the gentleman $150 based on the assumption that what he has told me is correct. Assuming that he is correct, am I actually liable for the full cost to replace his windshield? Doesn't he assume some risk for driving down a road that is directly adjacent to the golf course? Does the golf course, which is a municipal course of NYC and located in a NYC public park, not have any liability in this situation?

You specifically and your group generally may be liable; however, proof has to be adduced to squarely place the negligence on your shoulders. I believe your offer is generous. In your heart, you know whether or not your ball hit the car. I believe doing the right thing will bring you more good karma than you bargained for. Ultimately, $300 is more than generous if he takes it. Offer it once; have the plaintiff put it in writing that he agrees to the sum even though you deny liability and no proof of involvement. Do not communicate again if he fails to respond to your offer and tell him to stop his phone calls. Dealing with liability on the part of the Golf Course is a whole different factor; you may come across some very interesting case law in New York State dealing with the specific facts through Google search. The City will deny liability until Kingdom come!

My attorney attend a readiness hearing for depositions and trial. My attorney told the judge he had an expert ready for both, when in fact he didn't. He even made up a fake name of the expert and charged me a retainer. Because he could not provide that expert, he removed the case to Federal Court,to buy time, where the Federal Judge sanctioned me, and remanded back to state court, because a plaintiff cannot remove a case.

The Civil Court judge dismissed all of my experts, then ruled a non-suit and dismissed the case, because I could not prove my case without an expert.

My question is, can I use this fraud on the court in an appeal, or am I stuck based on the rule that a client is responsible for his own attorneys actions.

You can't appeal the trial judge's decision based on fraud that your own side committed. You need to see an attorney as soon as possible about suing your attorney for malpractice. You may also need to file a complaint with the State Bar.

Since you were married at the birth of the child, your husband is the presumed father. You need to file a "Suit Affecting the Parent-Child Relationship" in your county and ask the court to find that the biologic father is the legal father of the child. Once it does that, then the court can order that you and the father have certain rights and duties, that you and the father will have a possession schedule, and that one of you will pay child support.

The simplest answer is for her to wait until she is 18. However I doubt that you would be posting if that was the plan.

Before she is 18, her parents are responsible for her and have the right to keep her home.

Also the person she is living with could be charged with the offense of harboring a runaway.

If she wants to leave before she is 18, the best option is for her parents to agree to let her spend the summer with her friend. Otherwise, she takes the chance that her parents will force her to go back.

Perhaps she can be a counselor at a summer camp.

The Mother started dating, got engaged and eventually got married to another man. Shortly after the marrige she asked my brother to stop visiting for a while to give them time to adjust to being a family. Which he did. Until your brother exerts his legal right to visitation, there is nothing any attorney can do for you. Visitation is laid out in 750 ILCS 5/607, and until motioned for, he is not entitled to it (or any other family member for that matter).

I was recently tried in juvenile court for "possession of a controlled substance" (marijuana) and "possession of a drug paraphernalia" in which I plead guilty. The judge sentenced me to 3 months of drug testing. If this was completed the charges would be dropped, but if I failed to complete the sentence in the allotted time I would be unable to apply for a driver's license for a year. It has now come to my attention that despite the judge only saying that I must complete 3 months of drug tests, I now have to complete a 3 month drug awareness program along with it. Is it legal to add on to a sentence after it has already been given in the court hearing with no notification? The only reason I am aware of this addition is because the form they gave me that listed local drug testing centers also listed program centers, and my parents called the court center to make sure this wasn't part of my sentence. That is when we were notified of the additional 3 month program. I find it hard to believe the court can legally add on to a sentence once it has been given, especially without notification. Is this legal?

You weren't sentenced. You were given an option that would result in the charges being dropped. Unless you want to actually be sentenced, you do what they say.

First, file a police report. This will help identify who was involved and to what extent. If they have a sample of the water and do a toxicology report that will help confirm there was poison in there. Is he on the birth certificate? Did he sign a VAP? If the answer is no to both, then he must file an action to be declared the father and seek either custody or visitation. If the answer to both is yes, he still has to file a Petition seeking custody or visitation. He may be liable for child support back to eh date of birth, but will be responsible for support back to the date he files anything. So he should be putting 20% of his net income away for the support of the child. Her income is really not relevant unless he gets custody and is seeking support from her.

Not sure I understand your question. A dependent would be the child. Usually the parents are paying for medical bills and typically, the spouse that pays the bill would be entitled to at least partial reimbursement from the non-paying spouse. However, this requirement and any child related obligations, would usually be included and defined in the Property Settlement Agreement and/or the Final Judgment of Divorce. A review of those documents would be needed to properly answer this question.

In general, trust agreements are not recorded or public information. One does not know if the creator of the trust decided to revoke or cancel the trust, and you don't know if the creator of the trust ever put any assets into the trust (titled assets in the name of the trust). You should search the records, title of record to the house, bank or brokerage statements and see if anything is in the name of the trust. If you can find a brokerage account in the trust name, they should have a copy of the trust and can tell you who the successor trustee would be.

A person that has assets and income may not qualify for state assistance, and if those assets and income are in the trust, it is treated the same as if the assets and income are in her hand.
