my landlord says is willing to stop writ of possession upon payment today. But sheriff already has it. What should I ask for from landlord as proof so that he doesn't just take my money and still send sheriff to evict me?
Answer
He is going to need to stipulate with you to recall the writ of possession. The writ of possession is an order for the sheriff to comply with the court judgment by giving the landlord possession of the premises. This will involve both of you going to court on an ex parte basis immediately.
