One can say you should or you shouldn't use a legal agreement you find online. What I can say is that it is a "buyer beware" situation in that 1) you are not aware who drafted the agreement; 2) You are not aware whether the clauses/law the agreement is based on are still accurate; 3) you are not aware whether that is the right agreement for you; and/or 4) You dont have someone to provide any feedback concerning your needs.

A good example is if you make the mistake of purchasing a legal agreement to start an LP versus to start an LLP. That L makes a huge difference. My suggestion is always that there are somethings you can't cut corners on. Three are legal, accounting and medical services. It may cost a little more but its better to have an experienced business attorney assist you. Our office handles matters in Texas related to business but I know several Texas business attorneys who I can refer you to as well.

Rental agreements are contracts and until they are signed by both parties the terms can change. If you recieved one offer and did not accept it, the. You recieved a second offer with different terms then it is deemed that the first offer has been recinded or taken back and or has expired. Yes, until you renew the terms can continue to change. If you are going to renew you should have already given your landlord notice, probably per the expiring lease, if you went back and looked at it. If you are going to renew I would sign a lease as soon as possible or you may loose that option and have to move anyway. If you are not going to renew to save any deposit you have you need to carefully read your lease for a notice clause or if you don't give proper notice you may fortiet some or all of your deposit.

If you do not have a written contract outlining a restriction on competition, you are in trouble. There is old common law tort precedent for unfair competition, but it is mostly unheard of to process one of these claims now without a written contract. Perhaps another attorney who has reviewed those older cases has an opinion. I do not have anything to offer you without going to the law books and cases.

Of course to win you will have to be able to somehow prove this was 'illegal' retaliation because of either the disability or the EEOC claim, and prove that they 'didn't need to fill' the position, and prove that you weren't out on leave for longer than they were required to hold your job. It also says that I may contact the plaintive council. I want to execute a quit claim deed and remove a person from the necessity of signing off on the sale of real estate property. However, the current legal entity is not properly registered so it is " not in good standing". Can we execute a QCD even without the proper standing of the existing entity? The partner who was responsible for the entity is no longer able to administer to these needs and we would like to move the property into another LLC.

Your question intersects business and real estate law.

From the business side of things, to get an entity back in good standing, one simply needs to file any back personal property tax returns. If the entity has been forfeited by the state, it no longer legally exists and must be resurrected to be legally able to conduct business in this state.

If there is no desire to keep the entity, one option is to dissolve by agreement of the members. When an entity dissolves it should file Articles of Cancellation with the State - in that "wrap up" document a designated agent is appointed to wrap up the affairs of the LLC. The person so designated can usually sign off on deeds and such.

While the parties to a real estate deal can usually set the consideration, if the old LLC has creditors a transfer for less than full market value could create problems.

From a real estate perspective, a quit claim deed may not be the best route to transfer property. Even if the transfer is into another LLC with overlapping members, the parties should be prepared to deal with transfer and recordation taxes.

If the other "victim" in their police report or written statement that they filled out only wrote my first name (im not the only person in this county with my name) and where I worked in the reports is that enough for them to hone in on me and say that i was the one that was there and that I was the other victim? Also if the other victim testifys in court and says that I was there even though I wasnt how will they determine whos telling the truth? and if they favor the other victim can I get in trouble for not having the same story as the other victim even though I wasnt there? So do i have to give a written statement also? And when I was given my suponea the person who served it to me did not fill out the back where it says proof of service. BETH received Letters of Testamentary and was granted Executrix of his estate. She had nothing to pass along however; everyone else listed in the will got what they were supposed to.

So in 2008, BETH had my mother write her wishes on a pad of paper, after which BETH signed this "document." My mother is her daughter-in-law. In this Holographic Will, she wanted my mother SUSAN to take the house.

BETH has 3 children alive, one of them is my father, JOHN, one of them is my uncle, DAVID, and the last is my aunt, MARY.

Me an my parents currently live in Beth's house. We have been living there for the last 5 years taking care of her in her final years so she would not have to be placed in a nursing home. We paid for her funeral. We have been paying the property taxes on this house since 2005.

I understand that a holographic will must be written in the decedents own handwritting, and that an expert will have to verify BETH's signature on this document for it to be probated.

Either way, get a lawyer. Don't do this yourself. I spend way too much of my day fixing problems created by people trying to do stuff like this. The estate is >$50,000, so it would behoove you to make sure that it is done properly.

I don't know that the holographic will is going to pass muster, as it was not in her handwriting, and the only witnesses to the will were not disinterested. To answer your question, if the will is legal, Beth can give her property to whomever she chooses, whether or not they're blood related.

As for what to do, first, ask the people who would inherit under intestacy (Beth's children, and the children of any of Beth's deceased children) if they want to follow Beth's wishes. You may be able to accomplish her wishes with less expensive procedures, depending on whether or not the family wants to fight over her possessions. If you all can agree on what everyone is going to get out of this, then it can usually be done relatively cheaply.

The 50 year old son has rights as a tenant despite not having any ownership interest. I think, but again talk to a landlord attorney to be sure, that the only remedy would be to have the son evicted. Otherwise, the son has the same rights as any tenant: he can have a reasonable number of guests present that aren't breaking the law. If this other person is stealing or causing physical harm to someone then you need to call the police and report him.

Besides, has she even given you the ticket information so that you could use it if you chose to pay her? Also consider that even if you chose to pay her and then used it within 1 year, most airlines will charge you a change fee when you make the change, which is typically $150 (check your airline). The value of the ticket which you can apply to a future trip is therefore $150 less than the $606.57. Also keep in mind that the airline may allow the passenger to be changed on a ticket, if requested in writing and for a fee (perhaps the same $150 change fee). You should check with the airline about this. Therefore, you might consider that SHE keep the ticket to use within a year, that you agree to assist in changing the passenger name to hers, and agree to split the cost of the change fee. That should be a lot less than $606.57. If she has asked you not to communicate with her, then it may be best to honor that request. How does she expect you to give her any money if you can't communicate with her? So, I guess basically it's a matter of comparing what the contract says with what the buyer and the employee want to happen in the future, and if anything needs to be negotiated to avoid a breach of the contract, work it out between the three of you and write a new employment contract and/or deal with the employee in the contract for sale of the business.

If you did the oil change yourself, one way that could happen is if you didn't put any oil back into the crankcase before starting the vehicle. And then it would only overheat once, before the engine would seize up.Also, if you didn't put enough oil in the crank, its possible that there is enough oil to lube the main crank bearings but not enough to make it to the cylinder linings causing too much friction and heat. Not likely.Otherwise the two items are not related to one another, and this could be coincidental.If you had a Jiffy Lube or other service station do the oil change, it is possible that they fouled something up under the hood.I once had a jiffy joint change my oil in Great Lakes, IL. and I ended up with a bunch of cork gasket material in my crankcase causing my oil pump suction strainer to clog up and a subsequent loss of oil pressure to the engine. The main bearings were not damaged due to there being enough oil in the crankcase to splash lube them.Check your coolant level to make sure it is normal. Also check to see of the coolant is clean and free from combustion by-products. To do this, remove the radiator cap, start the engine and look for gasses escaping from the radiator or the coolant bubbling up and over. This would indicate a blown head gasket.Make sure the oil level is normal. If you have an oil pressure indicator, either a gage or a meter or an indicator light, check to see if the pressure is normal. If both the pressure ans level are normal, more than likely the problems aren't related. But like I said, whoever changed the oil could have accidentally broke something (not sure what) under the hood.[To check that your oil pressure indicator light is working, turn the ignition key to the run position (but do not start the car), and all the dash indicator lights should illuminate for a few seconds then go out.]

During the interview, the mother said she was planning on moving to Columbus to go to school. When asked what her residual income was going to be, she preceeded to say she was going to live off of student loans and my husbands child support. She was then informed that if she was moving there she would have to find a job. After we eatablished the child support, we were going to ask for visitation. The mother did not want this, so she moved to Columbus (3 hrs away from us) only giving my husband a 2 hr notice. She told him that if he asked for visitation that she would have to move back and then couldn't "better herself" for their childs sake. So, she would bring him over once or twice a month when she was in town so my husband could see his son. Well it has now came to our attention, that she still does not have a job, her boyfriend has moved in with her, and now she is pregnant with her 2nd child. She will not responded to any of my husbands messages and has not let him see his son on over a month. My husband wants to see his son, but doesn't know where to start or if he will not be granted anything, since he is now a year old. We think that we should be the custodial parents due to what we can offer the child compared to her, but we know that's not very likely. But, can she prevent him from getting visitation? In her words she will "not allow visitation and will think about it after she's done with school"

I was recently on medical leave for apx 4 months. I received FMLA and short term disability pay while on leave. Upon returning to work my employer raised my dental and medical premiums over 400% without any notice or authorization. When I questioned the additional deductions I was told that insurance premiums were not withheld from my short term disability pay and they were "catching up" on premiums. The net result of their "catching up" is OVER $700.00 SHORTAGE OF MY NET PAY. IS THIS LEGAL? WHO will pay my mortgage this month? I suspect there is more missing funds resulting from the switch to disability benifits and back to normal payroll. My wife and I are still trying to figure out how the transition check (disability pay week overlapped payroll cycle) was several hundred short itself. This is in ADDITION to the $700.00 plus in additional deductions.

Do I have any recourse or do I just refer the mortgage company to my employer's accounting department?

Your mortgage obligation is between you and you lender, not your employer.

As for the employment issue, request that your employer provide a full accounting. If they are making deductions from your pay they must follow Illinois law which provides:

"(820 ILCS 115/9) (from Ch. 48, par. 39m-9)

Sec. 9. Except as hereinafter provided, deductions by employers from wages or final compensation are prohibited unless such deductions are (1) required by law; (2) to the benefit of the employee; (3) in response to a valid wage assignment or wage deduction order; (4) made with the express written consent of the employee, given freely at the time the deduction is made; ..."

Also, for the portion that is FMLA, your employer is required to have made your insurance premium payments and you are responsbile only for your portion of the premiums. From the Department of Labor website:

A covered employer is required to maintain group health insurance coverage, including family coverage, for an employee on FMLA leave on the same terms as if the employee continued to work.

Where appropriate, arrangements will need to be made for employees taking unpaid FMLA leave to pay their share of health insurance premiums. For example, if the group health plan involves co-payments by the employer and the employee, an employee on unpaid FMLA leave must make arrangements to pay his or her normal portion of the insurance premiums to maintain insurance coverage, as must the employer. Such payments may be made under any arrangement voluntarily agreed to by the employer and employee.

An employer's obligation to maintain health benefits under FMLA stops if and when an employee informs the employer of an intent not to return to work at the end of the leave period, or if the employee fails to return to work when the FMLA leave entitlement is exhausted. The employer's obligation also stops if the employee's premium payment is more than 30 days late and the employer has given the employee written notice at least 15 days in advance advising that coverage will cease if payment is not received.

In some circumstances, the employer may recover premiums it paid to maintain health insurance coverage for an employee who fails to return to work from FMLA leave. http://www.dol.gov/whd/regs/compliance/1421.htm
