Question

I have been renting from a property management company for the last 1.5 years. When I moved in I paid 1st months rent and $1950.00 security deposit to them. They called me today and said the homeowner has cancelled their service and that I would have to get in contact with the homeowner to get my deposit back. I did not pay the deposit to the homeowner I paid it to the management company and as far as I am concerned I am a client of the property management company and they must fulfill the obligation of the contract (lease) and do my walk through and return my deposit. Should I send a certified letter to them demanding they do the walk through and return my deposit? Or what if anything can I do?

Answer

Why not try contacting the homeowner, as suggested? You may be able to work everything out entirely hassle-free. The property management company, by the way, was probably acting as the agent for the owner, and if that fact is disclosed in your lease, you are actually in contract with the owner and must deal with him/her/them when the agency agreement is revoked.

Answer

Mr. Whipple is correct. Management companies virtually always specify that they are AGENTS for the landlord, not THE landlord. You have no more rights against them than you would against the individual employees if you lived in a big apartment complex owned by a company that manages with its own team of employees.

Answer

I agree with both of the previous responses. You need to deal with the landlord, not his or her former agent.

Question

I fell in my home on February 14, 2011 injuring my right shoulder. I underwent a repair of my rotator cuff on April 21, 2011. My employment was terminated on June 16, 2011. My insurance was terminated at that time as well. I was offered the option to continue the insurance at an alarming rate 1month later. I would like to know if this was an illegal termination and should the insurance have been offered prior to my termination and at the same rate as I was paying as an employee.

Answer

No one here knows the reasons for your termination, and you failed to tell us any facts about the termination (other than you apparently related it to the shoulder injury). No one can tell you whether it was "illegal" if you don't tell us what happened. As far as insurance, again, no one here knows the terms of the company policy but COBRA coverage normally costs more than the coverage that is subsidized by the employer. The employer is not going to continue paying for your benefits after your termination (absent a contractual obligation to do so). If you want a meaningful response about your termination, you need to either post ALL the facts, including the reasons given by the employer.

Question

I am a boat captain for an individual who pays me as a sub-contractor. I pay my own payroll taxes as well as quarterlies. Is there any situation where I could be liable for any sales tax to the government in providing a service for this individual?

Answer

No. Your description of the situation indicates that you are an independent contractor, receiving a 1099 each year from the individual, paying quarterly estimated taxes for income and any unemployment insurance. Sales tax is not relevant to your situation as described.
