I filed for divorce in Jan 2008, my husband refused to sign any of the papers but last month he decided he wanted the divorce since he was now engaged. I didn't sign the papers (apparently I forgot to sign my portion) and he went to an attorney and filed the paperwork to have a judge sign the divorce decree. The final divorce decree was issued September 30, 2011.

I have two questions:

1) How do I find out when a new marriage license was issued? Because he got remarried September 24, 2011....6 days BEFORE the divorce was final.

2) The paperwork that was filed at the Prothonatary's office states that the attorney that filed the paperwork was the attorney for the plantiff (which would be me since I am the one who initiated the divorce proceedings) and infact the attorney that filed was my ex-husbands attorney. The clerk at the Prothonatary's office told me that I needed to get an attorney since the paperwork was incorrect; making the filing invalid.

If the attorney listed himself as representing the wrong party on the paperwork, does that make the filing invalid?

Interesting question. I have not researched this specific issue, but I'm pretty sure the answer is "no." Life insurance is not an inheritance, per se, and passes outside the estate of the decedent. So it does not come under the "inheritance" rule that makes it separate property, not community property. I am very sure, however, that it falls under the "gift" rule that gifts also are not community property, unless and until commingled with community property or made a gift to the community.

Only rebuttal witnesses need not be disclosed. Example: You expect the other party's witness to lie and say he never used steroids while he played for the Yankees. You have a witness who will testify he saw the other guy inject steroids in the Yankees' clubhouse after playing the game. This is a rebuttal witness. All other witnesses need to be disclosed (except expert witnesses which is a different subject). If you forgot to list a witness on your interrogatory responses, consider serving amended responses.

You need to disclose your witness list (minus rebuttal witnesses, as Mr. Stone notes) before trial. But the disclosure is not part of the discovery process, and its due date is usually after the discovery cutoff has passed.

However, if the other side *asks* you for this information during discovery, you usually must disclose it. Generally such questions take the form "Identify all persons whom you contend have knowledge of" particular allegations in your pleadings.

If you call a witness to testify about something but did not identify that witness when asked during discovery, the court is likely to forbid her testimony. Mr. Stone is right that, if you are getting close to trial and failed to identify your proposed witness in response to a proper discovery request, you should probably serve amended responses.

What can I do to get my photo off their website. they listed my photo and 2 other supervisors under the banner sanitation. As this is a try at humiliation, what are my rights.

I'm not sure I understand why the use of the photograph is humiliating, exactly, if the problem is only because you are no longer employed there, but they continue to have you listed as holding the position and using your likeness in promotional materials. If you previously gave them permission to use your likeness to promote their business, you might not have recourse, depending on what you agreed. If you never gave permission, they cannot legally use your likeness in commercial promotions, such as a website. Since they clearly aren't complying with your requests to remove it, speak with a local attorney. One letter to the webmaster from an attorney will probably resolve the situation.
