Question

Rental question- Duval county Fl. My long time friend living in Chicago, also ownes a house in Jacksonville. We agreed to rent his house via text, with me "in charge" agreed to anything over $1000. mo. I keep.. I rented it taking 1495. plus 2000. dep.

The owner asked I pay his boat dockage bill,, I gave the Marina 1200. (200.) out of dep. He wanted me to use more, I did not as I took the dep. from the tenant and want to know I have it if needed for return to them.. The tenant was to pay my paypal account each month being due today (5/28/14) But,, the owner contacted the tenant and they sent him the 1495. All still over text,, I said ok, now you can send me my share of the rent, no responce as he changes the subject,,

I asked why he doesn't want to pay me .. he says he didn't say he wouldn't.. but he's ignoring my request to be paid the 495. and making excuses he's busy.. he'll see me in Lauderdale..

Should I contact the renter to let them know as per our contract, they are late in paying,,, I know they have paid the owner.. The owner now making a pattern of taking from people,, may also want to keep their dep. as they did not pay the rent as stated in the contract and throw them out.

Should I hold them them to the contract they signed and say they need to pay as per contract..

Give notice to pay..

Make an arrangment for them to send 500. to my account and pay as agreed the following month minus the 500.?...

I'm in Hollywood Fl at this time. I want it to be made right as the owner was/is in the wrong, just not smart of the tenant to ignor the contract..

Thank you for thinking over and suggesting what I may do this best you can with the info I've mentioned.

Answer

Impossible to answer your questions without seeing the paperwork. If the rental agreements are with the owner and the money is due to the owner, he rightfully is getting it sent directly to him and you cannot evict or claim non payment. If the funds are required to be paid to you directly, than you may have a right to notify them of non payment. Seek some legal help with all the paperwork.

Where can I find a sample letter to request skip car loan payment?
You do not need a letter, you need to call or visit the loancompany and talk to them about this personally. Skipping a paymentcan result in the loan company
starting repossession proceedings on your vehicle. This issomething you do not want to happen so contact the loan companyimmediately if you are unable to make your payment on time.

Question

My Ex-Husband and I got a divorce in the state of TX. Since then I have relocated to CA and have lived here for over six months. In our decree it states that I can relocate wherever I choose to. I have sole custody of our children ages 3 and 1. In the decree it states if I move he has to visit with the children in the city which I live in and cannot take the children out of state. He lives in VA. Neither of us has resided in TX for over 6 months. He is able to take them for two weeks and it states he has to give me written notice. He has certified a letter he sent to my old residence in TX stating he will be picking up our children at my old TX residence. I gave him notice I had relocated to CA over six months ago. Can he legally con me into traveling to TX for the visitation?

Answer

Texas law applies to the Texas order. You should seek an answer from an attorney licensed to practice in Texas. Registering the Texas order in California might be available, consult with a local attorney.

Answer

It doesn't sound like he can do that, but Mr. White is right, this is governed by TX law. I should mention though, that based on the facts you give and the Uniform Child Custody and Jurisdiction Act, you have a good case to have your case transferred to California for all further proceedings and for California law to then take over.

Answer

If you feel there is a need to seek emergency protective orders concerning the planned visitation, it may be prudent to seek that relief through the CA cours. Crucial that you meet and confer with a family law attorney to explore your legal options. More facts may produce other legal directions and outcomes.
