Sue them in small claims court. You can sue for up to $3,000 or $5,000, depending on where you sue. You have to pay court costs, but you will get them back from the defendant if you win. You want to sue either where the defendant lives, or where the work was done (where you painted the house). Look up the local Justice of the Peace and give them the address. Ask them if their jurisdiction covers that address. The process is easy and you don't need a lawyer.

He now wants to leave and take sole possession of the car without making any payments, because he knows that I have to pay or risk lowering my credit. It is hard to tell without reviewing all of the documents, but if your name is also on the vehicle's title, you have equal right to possession. If you think your husband will make trouble, you should talk to an attorney about the possibility of a partition action or other legal recourse.

I started name calling a girl today.She gets up and starts getting me from the throat and is choking me. I push her with my elbow as a reaction of her choking me (this was as self defense; i didn't just go up to her and hit her). It turns out she is pregnant (which i did not know anything about this). Can they press charges on me for hitting her even though it was as self defense? Can they press charges on me for name calling? My principal was telling me she can but i want a layers advice. "Name-calling" is not a crime. But it might qualify as harassment, depending on what you said and in what context. Harassment is normally a civil matter.

If you are attacked, you can use reasonable force to defend yourself. What's reasonable will depend on the circumstances. If your attacker is pregnant and you know it, that can affect what would be reasonable. But if you don't know it and it isn't obvious, then it should be irrelevant.

The girl can complain about this to the police if she wants to. Her version of what happened will probably be different from yours. Whether the police or prosecutor will take any action will depend upon what they believe happened.

But even if the authorities take no action, she can still bring a civil case seeking money and/or a restraining order.

If the incident was as minor as you make it sound, my guess is that none of this will happen. But if it was more serious, then you may be in trouble.

You need to provide a few more pieces of information to get an accurate answer. First, when did you give the security deposit? How much did you give? When did you, or when were you supposed to, move in? Was this an actual "security deposit" or was it prepaid rent, e.g. first month's rent?

A landlord is entitled to take a security deposit at the beginning of a new rental term but not in excess of one month's rent. That deposit must be returned within twenty days after the tenant gives proper notice, moves out, returns the key and provides a forwarding address. The landlord may only deduct from the security deposit unpaid rent and physical damages other than ordinary wear and tear.

I own a house in Mt. Vernon, NY, and I have had to install a recorded camera system due to the crime that was happening on the premises. I notified all tenants in writing and I put up a sign that let the tenants know that they were being recorded in the common areas and in the outside/yard area of the property.

Right now, I have three tenants who are all using the same common space (kitchen, mail area, living room, etc.)

Recently, Tenant A, who works for a Casino, told me that her mail was opened. This same tenant has told me in the past that she's been missing mail and that someone has been signing for her certified mail.

So, I went and looked at the footage on my camera's recording system and you can clearly see Tenant B look at the piece of mail on at least three separate occasions (so she knew it was not addressed to her) before she actually opens Tenant A's mail, looks inside at the contents and when she realizes it's nothing of value (it came from a casino), she puts the mail back, looks around and starts to call someone on her cell phone.

Tenant A was terminated from her job because she was out on disability and her job says they sent her forms to be filled out, but Tenant A says she never received the forms. And, so they terminated her employment. Now, although we can't prove that Tenant B took the other mail, but we do know that Tenant B has opened and read at least one of her pieces of mail.

Now, Tenant A wants to press charges against Tenant B. My question is: before I turn over the video footage of Tenant B to Tenant A, do I need to get something like a subpoena or copy of a police report from Tenant A first?

What do I need to have from Tenant A to provide her with the footage of Tenant B opening her postal mail?

Answer

I would not turn anything over. If you want to help Tenant A, when she sues tell her to subpoena the footage from you, at which point you will be legally obligated to give her copies of the video.
