Are fords fix and repair daily car?
I have almost 196,000 miles on my 1995 Ford Explorer and have no plans
to change vehicles . ( although my cruise control did stop working recently )
I bought it new in August of 1995 and have always regularly checked fluid
levels , checked for any dripping etcetera , and have had regular oil changes
and other maintenance performed . So no , I wouldn't say it's a fix and repair
daily car , just keep on top of the regular maintenance and pay attention
for anything that seems " different "

I was attack by a customer at my place of employment. a customer slap in the chest. i want to know if the company i work for is responable for my safety by getting a restraining order on the person who attack me. and do i have any recorse on the company for the supervisor not call the police right away, but waiting 15 mins. she called corp first to see if it was the right thing to do by calling the police. the police office was kinda of upset because she waited 15 mins. do i have any recorse on this matter. i am scare the this person could come back and retalliate . people have been shot for less
Answer
Ultimately, you need to take care of you. Don't wait for the company. Their focus is on them, not you.
If you fear this person, apply for a protective order on your own.
As to whether or not the company has some liability, you need to speak with an employement attorney.

What is the procedure you used to set and check the ignition timing?
hook up a timing light to cylinder 1 spark plug wire. disconnect vacuum advance hose on distributor. loosen distributor hold down bolt slightly. start engine. point timing light at the balancer/pulley on the front of the engine. the flashing will make it look like the line marked on it is standing still. turn the distributor slightly until you line up the mark with the correct notches on the timing indicator on the block. tighten distributor hold down. hook up vacuum advance. when you plug the vacuum advance back in you can watch the timing advance with the light to verify that it is working. remove the timing light. The above answer is correct for distributor equipped cars with balancer timing marks using cylinder #1 refrence. This virtually all early north American built cars. All other cars have very different procedure's. Any request for this info must have year make and model to get a correct answer
I had my debt cancel last year and now collection agency are calling for payment. Can I sue these collection agencies for harassment?
I had my debt cancel last year and now collection agency are calling for payment. Can I sue these collection agencies for harassment?
Answer
Yes. If a debt collector misrepresents the status of a debt (i.e., says that an extinguished debt is not extinguished), they are liable for any actual damages (if any), plus penalties of, I believe, $1,000 per occurrance under the Fair Debt Collection Practices Act. If they falsely report the debt to a credit reporting company (transunion, equifax, etc.), they can also be liable for similar penalties under the Fair Credit Reporting Act.
Both acts are federal acts, but you can sue for violation of them in state court, even in small claims court, where you don't need a lawyer to sue. There is a host of information online from the US government (and others) about both acts.

Hello,
I am applying for a NYS PI /WGP /Support Staff license through a new job i am starting on Monday. The company that hired me said i passed their background check. However I am worried about the license. I have a misdemeanor conviction on my record. The original charges we a few felonies such as assault and robbery in the second degree. I did not commit these crimes but i pleaded guilty because i was 18 and scared to face jailtime. As part of the paperwork that has to get sent for the license i have to include a disposition, accusatory instrument(police statement) and a written explanation of what happen. I need to know if my best route is to Just say I did the crime and talk about all my accomplishments since then or Say I didn't do it and I just said I did so I would go to jail. Please help me out here I am very confused on what to do. Thanks.
-Gerald
Answer
Your questions confuses a little bit. First you say that you passed their background check which would be likely if you only have a misdemeanor on your record. If you only have a misdemeanor on your record, why do you say you pled guilty to a felony. Since this is important you might want to consult a criminal defense attorney to help you with this paperwork and your explanation. Definitely bring all these facts to an attorney and have them help you.

Can anyone other that law enforcement officers seize my AZ driver's licence (AZ identification)? Is my AZ issued identifcation my own personal property? I went to a school function and my i.d. was taken and kept for about an hour and a half and then given back to me. Something just doesn't seem right.
Thanks.
Answer
Honestly you would need to elaborate a little more. If your under 18 and the school function was a high school function you have substantially less protections. Second you choose to go to the school function so it's not really a seizing of your license. You could have chosen not to go in which case you never would have relinquished your license. When an officer seizes something of yours it can be done without your consent. Even if this was a college/university level function you still consented to their holding on to your license, so more likely than not there isn't much you can do. In the future you can always refuse to go to such a function. In some ways you can compare this to being searched at the airport. You can always choose not to fly and then you do not get searched.
What is the function of Air condition in Air craft?
For keeping cool during ground operations. However, in light General Aviation aircraft, during the takeoff roll and climb out, the air conditioner must be in the off mode. Generally small aircraft have a switch linked to the throttle control which automatically switches the a/c off.
In low level flight during summer months in places likes Texas and Arizona, a cabin's temperature can go as high as 140 degrees F.
Airliners use a/c for maintaining a cool cabin for the passengers.

I was given a ticket for making an improper U-turn in greenbrook. There is a no u-turn sign 100 feet before an intersection. I made a left turn at the intersection and then made a u-turn on that street within 20 feet of the intersection. Stopped at the stop sign and then took a right, so i was traveling in the opposite direction. IS this a U-turn since I completed a left turn and then abided by a traffic sign on the side road? Interested on your take.....
Answer
The no U-turn sign on the street where you were originally traveling does NOT prohibit you from making a U-turn on the street that you turned on to.
Good luck.
A.
http://www.marainlaw.com/index.php
Answer
I am curious, did the officer indicate on the ticket that there was a sign posted prohibiting U-Turns? There are two aspects to the No U-turn statute 39:4-125, one part of the statute prohibits a U-turn on any street where there is a sign conspicuously posted prohibiting U-turns. The other aspect of the statute prohibits U-turns on any street where your view is obstructed at/or near the grade or crest of such street within a distance of more than 500 feet basically in either direction. I have no idea if this applies, but if the street where you made the U-turn is on a hill and your view was obstructed for more than 500 feet in the opposite direction, that may factor into your argument. The No U-turn sign should only apply to the street that you were initially on. It is a 3 point ticket so I would speak to the prosecutor before you decide to potentially take it to trial. see what they may offer you to resolve it. It is therefore worth going to Court based on the points. please feel free to call with any questions (201)-342-5030, otherwise good luck

That's quite a little bit of fuel. In fact, it's such a small amount, that the fuel would not be able to enter the fuel lines to get to the engine, let alone start the car.

Am i able to change the locks on a home that my spouse and I shared?. the home is in her name but she moved out over nine months ago and left me stuck paying the mortgage along with other bills. I dont want her to be able to just walk in whenever she feels like it. neither one of us has actually filed for a divorce. I just need to know what my legal options are
Answer
From the limited information you provided, it sounds as though the home is marital property. As such, you both have equal rights to it. You can change the locks, and she can break a window to enter if she wishes to do so. The only way to get this resolved and to determine who can / cannot be in the house is to have the Family Court address it and issue an Order.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.SpartanburgLawyers.com). I wish you the best of luck.

How did Ferdinand verbiest invent the car?
While living in China as a Jesuit missionary he designed a small steam driven vehicle for the Emperor of China. It is thought it was just a toy, being only about two feet (32cm) long but there is no proof it was ever built but drawings exist. The design was basically an orb like steam chamber with a nozzle at the top that directed steam under pressure across a simple turbine.

I have a judgemewnt against me in a municipal court for credit card debt. i recieved a order to appear before the creditors attorney to look at my assets but it was taped to my door, it wasnt in an envelope from the court nor was it certified. the communication also read this is a communication from a debt collector. Do I have to appear on this type of a request or is this another tactic by the attorney to get me in front of him? it doesnt say summons on it neither??????
Answer
If you fail to appear for your judgment debtor exam you risk being held in contempt of court and a bench warrant may be issued for your arrest. This type of service (taping the documents to a person's door) is called "personal service" and is a valid method of service.

Can step-parent legally adopt the child of his/her spouse without permission of the spouse's ex husband/wife?
Can step-parent legally adopt the child of his/her spouse without permission of the spouse's ex husband/wife?
Answer
Yes, if grounds exist that would justify the termination of the biological parent's (ex-spouse's) parental rights. There are many ways to do this but none of them are necessarily easy. The best bet is to try to get the ex's consent. Depending on their relationship with the child (or lack thereof), this may not be difficult. It will certainly make the adoption less expensive, and you may be able to avoid the homestudy requirement, depending on the requirements of your jurisdiction.

I was divorced in 2002. The judgement decree was for a structured monetary settlement to be paid on a yearly basis. My ex-wife stopped paying me in 2005. She still owes me over $1K. Financial/legal & health issues have prevented me from getting this into court sooner.
I understand there certain statutes of limitations for different types of cases, but I don't know what applies to divorce in Illinois. My fear is that I may have waited too long to pursue this.
Can you clarify?
Answer
There are at least two possible theories. One is that a judgment is only enforceable for 7 years. But it can be revived during the 20 year period after its entry. the second is that your judgment may incorporate a written settlement agreement which is a contract which is enforceable for 10 years. The third is that you sat on your rights for so long your ex has a right to assume you abandoned your claim. Only a judge can determine which theory wins.

We have a client who has someone out on Worker's Comp. After how many months of not working should they take him off of their Medical Insurance? Or does he get to stay on because of the injury and since technically he's still an employee there?
Answer
Since you can not discriminate against an employee because of an industrial injury, they should be entitled to all employment benefits until at least their temporary disability runs out and it is shown that they can not return to their former work or a lighter duty job available in the company.

I was arrested in 2007 and charged with driving on a suspended license. In the same incident i was also arrested with something in my vehicle which they could charge me with a felony but I was never convicted of the felony and was informed I do not have to disclose the felony arrest to the BBS. I have sent in my application to be an MFTI and now they want the arrest report for that conviction. I do not want them to see what else is on that report and I want to know how I can not disclose it.
Answer
You cannot refuse to disclose it if you want to be an MFTI.

Auto Accident
I was in an auto accident and was not at fault. I received a neck sprain and am now in physical therapy. This occured about a month ago...what is a reasonable settlement amount to expect from the insurance company?
Answer
Re: Auto Accident
The reasonable settlement amount varies depending on a couple of factors. But probably the most important is whether you have an attorney. Unrepresented persons usually recover less than a third of what represented persons receive. That's why the insurance industry is so eager to settle claims before injured persons hire attorneys.
If you want to let me know more about your injuries and treatment I'd be happy to give you an estimate of what your case is worth.
Thank you.

My husband of 24 years and I filed papers for an uncontested divorce in the state of Florida. We have one minor child. We had a hearing before a Magistrate scheduled, but it was cancelled when my husband had to have surgery on the same day. Since then, we have agreed to some changes in terms and I would like to make some additional changes that he may or may not agree to. Is there any hope of making these changes or are we "stuck" with what we already filed?
Neither of us has legal representation.
Answer
You're stuck with what you filed unless you both agree to changes and agree to file a amended settlement.
Answer
Hello: As to your qest., you don't state what types of docs you filed already. If you filed a settlement agreement that was signed by both of you, that may be difficult, but not impossible to change. The easiest way to change such an agreement is for both parties to agree.
If he won't agree to changes, you can file a Motion to amend it...which must be filed before the Court has a final hearing and enters a Final Judgment. You would need to allege some valid reason for the change, such as, you weren't told the truth about assets or something, there was misrepresentation, coercion, etc.
If my office can be of any assistance, pls. give us a call. Tom Rosenblum
Answer
If you make changes to your agreement then reduce it to writing have it signed by both parties then present the changes to the court.

My oldest daughter has co signed on a car for my youngest daughter 2 yrs ago. My youngest daughter recently had a repo on the car due to financial problems. She got the car back in one week and paid all off the fees. My oldest daughter didn't know anything about it until she recently checked her credit scores. The repo is on her credit as well. Now that all fees are paid, can this repo be taken off of the oldest credit if anything? As a mother I am really hurting for the both of them, but more for the older one. I want to help her 750-800 credit score.
Help!
Answer
Tell your oldest daughter to contact the three credit reporting agencies ( she will be able to access them via annualcreditreport.com, which is a free, once-a-year credit report ) and explain in writing the circumstances and ask them to remove the repo from her credit report.

I am in the process of launching my own business. It will benefit military and first responders. One thing I was thinking was to mail a letter with a few business cards out to fire stations all over the country in all 50 states to help promote it. But then I got to thinking...would doing that violate some sort of solicitation laws? Please let me know.

No, I see no problem with it but rather than blanketi the country with your solicitations, I would advise you to start with a much more linted area (closer to home) to determine whether any significant (not to mention unanticipated) problems might arise from this activity.

My sister had a baby in January and the father of the baby did not sign the birth certificate and still has not signed it. He has verbally told her he does not want nothing to do with the baby, which includes legal responsibility. So we want to know 3 things...
1) With the above said, can she seek from him child support and receive full custody with no visitation (regardless if he changes his mind in court about wanting to be involved in the babys life?) Would this be difficult to obtain?
2) He has stated he will have a lawyer draft a document that will state that he absolves full legal responsibility to the child and in return she will agree not to seek child support. Is such an agreement possible?
3) If she decides not to pursue child support and he still does seek full legal responsibility to his child, will it hurt her down the road if one day he decides to take HER to court to prove paternity and fight for custody?
Answer
Your sister can seek to establish paternity and be awarded child support even if he wants nothing to do with the child or refuses to acknowledge paternity. Paternity will be established by means of DNA testing.

How is it possible to plead guilty to california penal code 311.2a (a misdemeaner) and be required to
register as a felony sex offender. I am in that situation now. Initially the first time I registered the california
department of justice sent me a letter signed by the attorney general saying that my offense was not one
requiring registration as a sex offender. I took the letter to the county sheriffs department to see what I
could do. The officer took the document to research it's validity while I waited. He told me that someone
at the department of justice had made a mistake that I had been sentenced by the court. Because I have
been homeless in the past I no longer have the letter. I am no longer homeless and have sufficent income
now to pursue this issue. I have researched the california law library and can find no requirement to register as a sex offender under the misdemeaner california penal code 311.2a. could you check this out.
Answer
The Attorney General was correct. The Sheriff should not be giving legal advice, but rather enforcing the law as it stands.
Penal Code section 290 lists the offenses that requires lifetime registration as a sex offender.
Although the other subdivisions of Penal Code section 311.2 are listed, a violation of Penal Code section 311.2 subdivision (a) is not listed.

I am terribly sorry to hear about your husband's health situation.
You can file form I-751, to remove the condition on your residency, within 90 days of its expiration. If your husband passes before then, you still must file form I-751, & then you will be scheduled for an interview. I don't see why USCIS would deny the removal of the condition due to death of the petitioner.

In which arts forms would you hear the term a cameo performance?
The art you are refering to is drama/cinema. Most particularly this happens in television. When a famous actor or entertainer makes a guest appearance on a television program, (usually this is just a one time thing) it is called a "Cameo." One great example of this is the HBO series "Entourage." One of my favorite shows being made currently and it features many "Cameo Appearances" from a wide range of celebrities such as Val Kilmer, Bob Saget, Ralph Machio, Jaime Pressley, Jessica Alba, Anthony Michael Hall, Pauly Shore, and Scorscese, just to name a few.

What does a solid yellow line painted on your side of a highway center line mean?
"they usally show you where you are on the road so you can tell your not off of it im just throwing out a guess! LOLZ!!! "
It actually means that you are in a no-passing area. You may only pass the car in front of you if the lines are dashes, not solid.
This typically happens on a two-lane road: one lane going in each direction. The dashed line tells you that you may pass if it is safe to do so. A solid line tells you that you cannot pass here....and in fact, would be issued a ticket if you try!
The traffic coming the other way may have a dashed line...and yours may be solid. This tends to happen as you are approaching a curve in the road that the opposing traffic has just driven through. They are now free to pass each other, but you are not.

Send one more letter giving her a certain date to respond by or you will sell the product and indicate you are returning rods by dropping off on porch. Even though she doesn't pick up the letters-the green card you received back, indicates she was served for court purposes.

Yesterday I had a verbal altercation with a neighbor. The neighbor is 18 and and had the police respond to his his house from calls to the police by other neighbors on at least three separate occasions. The house he lives in is is constantly full of young people that are drinking and smoking pot in the front yard. We have counted as many as 20 all in that same age range living in the in the house. There have been large parties and on several occasions, fighting. The past 2 or so weeks the kid that "owns" the house has taken to staring at me. Whenever I come outside this guy just stares intently at me. He doesn't work and we believe he is dealing drugs and a lot of them to afford this neighborhood. Yesterday I asked him if he wanted something of I could help him with something. He told me to get back in my house. I then took pictures of the salver cars that were parked in front of his house and all of the people that were outside with him. I then told if he had a problem that he had an open invitation to talk about whatever his problem was and he said, "no" so I called him a coward. He continued to tell me to, ".get in my house" . My wife called the police and he and all the cars and people that were there left before the police could get there. When they were leaving I yelled at the guy and told him to pack his bags and get lost. I also flipped him off and called him a Fucking Nigger." Bad reaction I know but am I at risk of getting in trouble for that? The police didn't say anything about it when they responded yesterday.
Answer
I don't believe that you are in the Dallas / Fort Worth area and therefore, it may not be cost effective for our firm to help you - due to the cost of travel for hearings - but that will be up to you.
However, you may be able to seek the help of a qualified litigation attorney who can file a suit against the person and home owner for harassment and nuisance and you may be able to get a restraining order against him.
You can't get a protective order as you have no familial relationship to the person.
If you are in the Dallas / Fort Worth area, and would like a consultation, please let us know. You can send an email through out website at www.lawyersdallas.com.

Civil Judgements - Homes Exempt from seizure?
I lived in Fla for many years and owned homes there. I now live in Ga and would like to know if there is any protection afforded to homsteads to keep them from being taken if you get sued in civil court and lose? In Fla your home is protected, best example is that OJ moved to Fla from Calif so as to be able to keep his home from being seized and sold.
Any protections in Ga. law?
Answer
Re: Civil Judgements - Homes Exempt from seizure?
You have a $10,000 homestead exemption in Georgia. Not close to Florida's.

if you are given instruction to give notice, is there a specific deadline to when this must be done ?
If you have ammended complaint. must it be served recorded just like a new summon or its ok to record and send by certified return receipt mal or by regullar firstclass mail. ?
Answer
You should give notice as soon as practicable, so that the opposing side can prepare for the hearing, or for whatever else notice is given.
Regarding the amended complaint, it all depends on whether the original complaint already was served. If so, then the amended complaint may be served on the same party by regular first-class mail. If you intend to serve an additional party, then you should also have a summons issued on the first amended complaint, and have the new summons and first amended complaint personally served on the new party. Of course, if the new party is out-of-state, you can have another person serve it by certified, return receipt mail.
Answer
I'm assuming by answering this that you are the person who was demurred to, and the demurrer was sustained. You need to give notice as soon as possible, and file the notice with a proof of service with the court. You serve the amended complaint on all parties who have appeared, by serving them by mail. If the party demurred, they have appeared, so you will probably have them served by mailing to the attorney. You can't serve by mail yourself, since you are a party. You are going to have to have someone over the age of 18, who is not a party to the action, do the mailing, and sign the proof of service. Then file your amended complaint with the court.
Standby to get demurred to again, and this time it will be doubtful if the court gives you leave to amend.
How do you wire electric brakes at the travel trailer brake drum?
It depends on the axel and brake manufacturer, but must of the wires on the magnet do not have polarity. They work like a common resistor. One wire will connect to power and the other to a ground. It is Dexter's recommendation that a common ground be run from the the trailer plug to the brake magnets. Do not ground each brake individually to the trailer frame or structure. Also note that the brakes should be wired in parallel, not in series.
So, simply, you run the wires from your electric brake controller (You do have one, right?) through your trailer light jack, to your chosen "positive" side, and back again through your chosen ground, through the trailer light jack again. Some states require the use of a breakaway switch. What you would do in that case is add a "breakaway switch" in between the trailer battery (obviously it has to be on the trailer.) and the "positive" of the electric circuit, and the negative will also have to go through the battery/chassis ground. the switch cable is connected to the tow vehicle somewhere other than the hitch! This way if the trailer hitch fails catastrophically, the breakaway switch applied full breaking force to the trailer, trying to prevent it from rolling through a minivan full of kids.
If none of this makes sense, you should take a good look at automotive electrics first. This is really dangerous, and you has a potential to cause severe, (totalling) damage you, your trailer, and everyone around you if you don't do it right. Make sure you follow all accepted trade practices and good work techniques. Test EVERYTHING vigorously before you take it out on the highway. It's also a very simple job, so, do it, but be careful.
You should also look at the axel manufacturers website and documentation. they are full of good advice, Dexter's for example, can be found at http://www.dexteraxle.com/products___literature

There is no written lease agreement. Tenant pays for utility every month and takes care of my animals when I am away. Tenant's boyfriend borrowed my car with my permission and destroyed it. He also willfully damaged a door in the basement. How much notice do they need in an eviction?
Answer
First you should give written notice to him to vacate as soon as possible. Generally, when there is no lease, and he pays your utilities on a month to month basis, the tenancy is deemed to be month to month. Therefore, you should give him 30 days written notice and then proceed directly to your local District court and file a landlord/tenant complaint for possession. The hearing will be scheduled quickly and he really has no defense. The District Justice should grant you possession, and if he does not appeal to Common Pleas court, you then go to the Sheriff, with the proper papers and they will physically evict him if he does not leave on his own. It appears that you live in Montgomery County, unfortunately, and the sheriff's Department has an unwritten policy of not taking action for at least 30 days. Finally, to navigate these various issues, you are best served by seeing a lawyer.

My brother pleaded No Contest to Sexual Battery with a minor. He is a first time offender... was never in any trouble of any kind before this. The crime was done back in the late 1990's, yet the girl only came forward 8 yrs ago. He was sentenced to 20 yrs, and so far, has served 8 yrs in a FL state prison.
Is there ANYTHING that can be done to have his sentenced reduced?
Answer
I doubt it since he only has 30 days to appeal his sentence. After 8 years he would have waived all his appellate rights. You should meet with an attorney from the area where he was convicted.

I was given a summons by a detective for NJS 2C:33-4A...
I had argument with a girl on the computer/facebook..She went to the police..They came to my home and told me just not to contact her anymore..Well she went on facebook and was telling everybody what happened and that she had the police come to my house etc..
When my sister called me to ask me what was going with her, i said you heard about this too ?? I sent the girl a one line sentence text, I said ''you're starting this crap again'' maybe i will go to the police now''
A judge said there was probably cause for issuance of complaint/summons...
I didnt swear at her, threaten her or anything...I basically just wanted to put her on notice that i might go to the police if she didn't stop...
Is that really probable cause for harassment ??

My husband and I divorced 1.5 years ago after 19 years of marriage. His aunt recently passed away and I had a good relationship with her. If Im mentioned in the will, is it mandatory that the executor get in touch with me? What if Im mentioned as husband and wife or by my married name?
Answer
IF the aunt was a NJ resident, AND she had a will, AND you were named in it...then once the will is probated, the executor must send you a "notice of probate" and a copy of the will.
Answer
If you are mentioned in the will as a beneficiary the executor must contact you. If you think the executor or executrix may not recognize you by your married name or know where to find you then you should contact the executor or executrix to provide your contact information. If you can find out who the attorney for the estate is you should contact him or her as well. The above information may not be considered legal advice as there may be additional information to which I am not privy. Should you wish to discuss the matter further or desire my assistance please feel free to contact my office for an appointment.

what the other attorneys wrote is correct. I would need to see a copy of the Will to tell you what is going on, and you should be given a copy of that if you were named in the Will.
I can also explain to you how you can get a copy of the Will even if you are not given a copy.
I can explain things in detail in person after we talk. I will explain what legal issues I see, and what I can do to assist you.
This will be a free consultation. After we talk, you can decide what you would like to do.

If the petioner goes to court on an ex parte show of cause hearing, does the respondent have to show up at all? And under California law, how fast can a spouse get alimony or temp. support?
Answer
1. The respondent only has to show up if they don't want the court to order exactly what the petitioner is asking for. If they want it denied or ordered differently, they have to file papers ahead of the hearing and show up. 2. Very fast, days or a week or two at most.
Answer
I agree with Mr. McCormick, however I would refine his response to the first question to point out that your failure to show up alone does not guarantee that you will lose the ex parte application. You just won't be able to get your side across or make an argument to prevent the application from being granted.

I recently loaned my ex $3000 for a down payment on a car. I have proof of this loan in the form of a check, but i never made her sign a contract, and now she refuses to pay. Can I take her to small claims court, and do I have a chance?
Answer
Yes, and yes. Your ex may claim that the money was a gift, or she may come up with some other reason why she should not have to pay you back. The judge may even rule in her favor. A written contract would have left you better able to protect your interests, but you can still take your ex to court and see what happens.

I was at my sisters house helping her with different things and taking to run erruns because she does not have transportation. she and I purchased a lottery scratch off and hit for 250.00 we split the money so I took her around to get items out of pawn. all thru out that day we purchased more tickets separate. I was on a pretty good winning streak. I was getting ready to leave and go home, when she became very irrated she then said to me you are not leaving here with any tickets. I got up out of my chair and was heading for the door that's when she assaulted me and eventully pulled a knife she natched my purse I ran to the door and got out. I called the police the police went in the house retrieved my wallet and other things but said they could not take any money, because she said it was hers. She did finally agree to give the officers some scratch off tickets and told them that was all of mine all of them were losers except one 3 dollar one the officers said they could not arrest her or charge her with anything because the only other person there said they did not see anything but it sounded as if I instigated the altercasation. Is that the way it really works? And If not what can I do?
Answer
That is often the way it works. Ask yourself why the police should simply believe your story, when your sister has a different story? If you want to do so, you can probably still request that charges be brought and your sister will probably respond by doing the same against you. Alternatively, you might just stay away from your sister,

My ex boyfriend is currently in prison, prior to him going to jail i lived with him. Two months after his incarrceration i moved out and wasnt able to bring all of my belongings due to my situation. I was assured in writing my things were ok and I could get them when I was able. It's been about 6months and for the last 2 I've tried to contact his mother as well as him to allow me to get into the house to collect my things. I've written via facebook, email, and letter, called both cell and house phones as well as texted. I just found out his brother and my cousin are living in the house so i called my cousins work he informed me my exes mother had put my things in a storage shed. That day i stopped by the house and left a note to please call, later that night the my exes brother called me screaming and verbally abusing me claiming that ghe lives therenow and his parents had gotten rid of my thins. My question is should I sue and how Fw: Interview follow-up do I come up with an amount? Everything that meant anything to me was there things that I can't price like a handmade quilt my great gran made my grandfather both deceased, me and ny daughters birth cert. As well as clothes, jewelry, and electronics ect.
Answer
The law provides relief for you. You can sue for return of your property or, if the property has been damaged or lost, for the cost of replacement. You can also recover the cost of suit.

Will there be auto drive in cars in the future?
Such a thing exists today.
Can you still drive your car if a few of the teeth on your flywheel your broken?
The teeth on the flywheel are only used when the starter is enguaged, and starting the engine. This means that once the engine is actually running, you should be ok. (Assuming the little pieces that broke off haven't lodged themselves somewhere that they can cause trouble) However, when you shut your engine off, you are gambling that the broken teeth aren't right where the starter needs to enguage. You should get it repaired as soon as possible. If your financial situation absolutely prohibits it, drive the car as little as possible, and avoid shutting it off as much as you can, because eventually you're going to get stranded when those broken teeth land in the wrong spot and the starter can't do its job.

I gave a personal check for $625 on Friday evening to a contractor to do some bathroom work on Saturday morning. The total job was $1400 and he said he needed it for materials. I received a call from Check Exchange asking me if the funds were available. I ask them if he was legitimate and they said yes he was a regular customer for a couple of years. He did not show up and will not return my calls. I called Check Exchange and they told me if I stopped payment they would sue me. If he had taken it to the bank the bank would have charged it back to him. Does Check Exchange have no responsibility? Should I stop payment anyway? I have also found out this sold called contractor has scammed others.
Answer
You learned the hard way that you NEVER pay contractors in advance.
If you do stop payment Check Exchange can sue you, so you have to decide if that is worth the risk.
Your options are few. If you have some information on the contractor you can try to sue, although that may chase good money after bad.
Some but not all police departments, with the above facts, might treat this as criminal fraud where you could seek a warrant for his arrest (others may tell you to sue).

If you are not charged with a crime within 72 hours and are released are you absolutely clear? Or can the authorities use evidence from arrest anytime in the future they see fit?
Answer
They have up until the statute of limitations to charge you. For most misdemeanors, that's a year and for most felonies it's three years. It can be longer on sex offenses and no statute of limitations on murder and some other life crimes.
You need a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard.
Please pardon any typos - posted via mobile device.
Answer
I agree with Mr. Dane. It is a good idea to at least speak to a criminal defense attorney and go over the details of the arrest. Don't wait until you are facing an arraignment on charges to decide that it is time to speak to an attorney.

My 6 week old. granddaughter was taken from her mother and put into emergency temporary child protective custody, in Calif. I live in Nevada (4hs.away) and would like to get the temporary custody. What do I need to do,provide or say to get temporary custody of my granddaughter, while her mother completes the recommendation of court ordered requirements? I do not want my granddaughter to remain in the foster home! Thank you, Kim
Answer
Contact the CPS assigned officer in California. Tell her that you can offer placement for your grandchild. Have the mother "nominate" you as a viable placement. They may have to do an ICPC (Interstate Compact for Placment of Children)--investigation before they place the child in your home--basically run a background check on you and check out your home for safety.
CPS will usually look for relative placement rather than put the child in a long term foster home. Contact them in California and let them know that you are ready to help.

I am my mothers wPOA and also her trust deed for after she passes I am to help split up he monies and property amongst us four siblings. Know my mother is 84 years and she has demention my 1 brother and 1 sister wants to take me to court so they can be it for the power reason she is being taking care of very well by my sister and me. Can they do that? If they can how can I protect myself?
Answer
Your siblings can argue that you have not acted in your mother's best interests and take you to Court in an attempt to prove that and remove you as your mother's Trustee and/or Agent under a Power of Attorney. I recommend that you hire a lawyer to fully evaluate this situation. It's likely that the lawyer's fee will be paid with your mother's funds. If you'd like to discuss this, feel free to call me.

I live in Virginia, I advertised a 1984 motorcycle and the gentle man came with several frieds and looked the bike over and drove it. After discussing of potential problems a deal was made and the gentle man bought the bike, the next day calls back and says he can not get the bike to start and has taken it apart. He wants a refund? Am I obligated to do this?
Answer
No, a private sale of a used motorcycle is presumed to be "AS IS"
and without warranties and unless you fraudulently
misrepresented the condition of this machine to the buyer, you
should not be obligated to oblige him with a refund of his purchase
price under the facts described (in my opinion).

My 14 year old son advertised in Youtube and sold an xbox to a man in Utah, supposedly for a b-day gift to his son. The deal was for $250. The buyer asked my son to ship the package. My son ask for a down payment. The man paid $100, and at the same time the package is enroute. When they got the package, opened it and tried to play it, somehow the hard drive got dislocated during the shipment. My son offered to walk them through to fix it, because it is fixable. The hard drive is just an accessory of the xbox. The xbox itself will work even wthout the hard drive. The buyer demanded replacement of the hard drive. My son offered to replace it with a new 20 gb hard drive, the same one it came with when it was shipped. The buyer demanded 32 gb . My son said there is no 32gb. The buyer up it to 64 gb, or no $150. My son refused and asked the buyer to just return the package. The buyer would not return the package wthout getting back his $100. My son returnd the $100. The buyer still refuses to return the package and is threathening to sue for damaged goods. What do you think is our best recourse in this case. We did not benefit from this deal and he has my son' s xbox. Thank you
Answer
Let him sue for damaged goods, he can't keep the x box, you have returned the money. The difficulty is that my guess neither party has enough minimum contacts to sue. For you to get the xbox or it's value, you would probably have to sue in Utah courts. He would have to sue you in California unless he could show minimum contacts. Send him a strong demand letter and start looking for a Utah attorney.

I am married to a British Citizen and have a daughter with a British passport. My daughter and I travel back and forth between the 2 countries as he is unable to leave the UK, he is military, and I have children from a previous marriage who are not allowed to leave the country. I have had difficulties in getting a US birth certificate for her but am able to get a US passport for her with the signature of my husband. He is not willing to give it. The reason for this email is as it stands right now, we are on the brink of divorce although it is not something I want. He, because he is angry, has decided he is going to come to the US and take our daughter back to the UK leaving me here. There is nothing filed with the court. No divorce, legal separation and so no custody arrangements. What recourse do I have should he show up in the US and demand our daughter? What can I do to prevent him from leaving the country without my permission? Do I legally have to give him her passport? What are my options?
Answer
Without any Court Orders, you both have equal rights. It is therefore best to get something filed. I wonder whether Arizona would have jurisdiction over him or the children. I would need to know more.
Please come in soon. We can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Paige or my paralegal Jennifer to schedule your free 1/2 hour consultation.

I'm a 52 year old SSA disabled man living in California with Medicare, Medicaid and Subsidized Housing. I've just learned my living father's will includes several thousands of dollars to me. I have been advised by another disabled person that my father's will should place the money in a "Special Needs Trust" in order to continue public assistance. If so, please elaborate. As I have no assets, the money gained is far less than the value of Medicaid and Subsidized Housing hence my needing to preserve these benefits. Also, my father lives in another state, so which state's law would take precedent? Any comments or information is much appreciated.
Answer
Your informant is correct that your dad should direct your bequest to a special needs trust for your benefit. He should hire an attorney in the state where he lives to draft the trust, although the "special needs" provisions are primarily governed by federal law.

Sorry, Ruth O'Leary is NOT his girlfriend. They are just plain simple friends or co-worker. Keith to date is still single. Beside, she is too old for him, I think she is in her 30's.

I have paid my child support every month, not including arrears which I intend to pay with my taxes. Paternity has been established, I have shared custody with primary physical to the mother. My order states that I can only see my son on Fridays by renting out a venue (little room at a therapy place) for 2 hours at $50 a week. This additional fee, which is on top of my child support, is $200 more than my gross monthly income, therefore I cannot afford to visit my child. I have an apartment, with roommates, but it is a safe environment. I have no criminal record, I am employed, and I'm an alumni of a university. The mother has remained spiteful since our pre-birth breakup and has refused to work with me on a separate visitation order that benefits me and most importantly our child. I do not have representation but she does. Do I stand any chance of getting a better visitation against a mother in the state of Virginia that has representation?
Answer
You won't know unless and until you try to modify the current visitation order.

I strongly advise against this. Pension plans tend to have requirements specific to their plans and will not accept those that don't meet those requirements. Hello, we had a couple renting a room from us for $400 a month + half of all utilites. Since, we had given them their 30 day notice. They moved out & there are damages on the carpet, urine stains from there dogs, burn marks, spilled drink stains etc. We got an estimate to replace the carpet, & they are still refusing to pay. We have the lease, they do not have a copy & never asked for a copy. I also have text from the harrasing me. If we took them to court, could we get the rent for this month, the carpet repair money, harrasment charges brought up, + make them pay all court cost?
Answer
As for the rent for the month of November, you haven't clarified when these
tenants actually moved versus when they were suppose to move so no determination can be made as to what you might sue for on this issue.
However, if there is damage to the carpet which they are responsible for
under the lease, then you should be able to hold them liable for that.
As for what you characterize as harassment, I do not see that as
compensable under these circumstances but you could hold them for
the court costs.
And, of course, you must also consider that if you in fact did win a judgment
against them in small claims court, would you ever be able to collect on it?

if one parent is illegal and undocumented is that parent able to get full custody of the child?
if one parent is illegal and undocumented is that parent able to get full custody of the child?
Answer
Yes. Family court is blind to immigration status. However, unless the other parent is totally unfit, as in Child Protective Services would step in if they were the only parent, neither parent is very likely to get full custody unless the other one agrees.
Answer
If there is a legitimate concern the parent plans to flee the united states with the child, that would justify restraining orders or a possible custody change.

I sold a puppy to someone and they signed a puppy contract saying that they would take care of the puppy ex.get shots on time, provide housing... I since found out the person lied about their age and they are only 16
I have spoken with the landlord of the apartment complex they are living in and the girl and her guardian have lied to the landlord and said they do not have a dog. Also found out that another tenent complained on them for leaving the puppy unattended with no shelter on the balcony all night where she could have frozen/fallen to her death. Do i have a legal right to take the puppy back and rehome it? I have the puppy in my possession right now. Also is she entitled to a refund when she and her sister were clearly not taking care of the puppy properly.

What steps should be taken in filing a suit when on 2 seperate occasions authorities either chose not to or did not submit a report after being called on a missing persons case because of prejidicial reasons, or taking it serious, or just plain out not doing their job, in which took them 2 weeks to even begin investigating and taking serious, in which has resulted in a cold case now, with no answers..and a cold case from the get go due to the lack of response by authorities.Does the family sue the police dept, county, state? On what grounds? And is there a statute of limitations on filing in such a suit as this? Thanx and God bless.
Answer
The first thing to do is go have a consultation with a local attorney. Set up a few consultations with attorneys in your area. Some might even give free consultations. When suing the government you have to give them notice 6 months before suit is filed. What are the damages? What was the natural and probable consequence of the action or inaction? There are many questions that an attorney will ask.

is it an arizona law requirement to get appraisals on cars and homes for the purpose of probate?
Answer
Appraisals for the value of assets vary depending on why you are in probate. I suspect that you may have a requirement to assess the value of an inventory to perform an accounting which must be submitted to probate administration, but I am uncertain whether you are dealing with a will, a conservatorship or a trust. In order to provide you with a specific answer for your particular situation it would be necessary to have more information. If you would like to contact us to discuss your particular situation, feel free to call Stephanie Coulter at 602 462 1004 to arrange a convenient time to ask your questions about your situation.

My dad passed away suddenly and didn't have a will. He did have an IRA, 401k, two cars and one re-built collector car. He does not own a home. He was married to my step mom for about 15 years in New Hampshire. After his death, my stepmom immediately sold his two cars and has not mentioned to me or my brother about anything. She told us "in New Hampshire, the wife gets everything" I don't know if she was on any of his retirement accounts or on the cars either. What should I do??
Answer
I don't know all the surviving relatives but the NH statute if you die without a will provides:
I. If the deceased is survived by a spouse, the spouse shall receive:
(a) If there is no surviving issue or parent of the decedent, the entire intestate estate;
(b) If there are surviving issue of the decedent all of whom are issue of the surviving spouse also, and there are no other issue of the surviving spouse who survive the decedent, the first $250,000, plus 1/2 of the balance;
(c) If there are no surviving issue of the decedent but the decedent is survived by a parent or parents, the first $250,000, plus 3/4 of the balance of the intestate estate;
(d) If there are surviving issue of the decedent all of whom are issue of the surviving spouse also, and the surviving spouse has one or more surviving issue who are not the issue of the decedent, the first $150,000, plus 1/2 of the balance of the intestate estate;
(e) If there are surviving issue of the decedent one or more of whom are not issue of the surviving spouse, the first $100,000, plus 1/2 of the intestate estate.
How this impacts your particular situation you will have to decide.

Answer
Each of these charges, in addition to likely probation and fines, carry points and suspensions of your driver's license. You need to find an attorney to go with you and mitigate the damage. You may have a way to get around some of this, and the money you pay to have an attorney navigate these issues for you will be more than worth it.
Answer
You can end up and probably will end up with a suspended drivers license, points, and a huge fine, plus a criminal record for life, unless you show up with a lawyer. Get one before court.

My father-in-law's 2nd wife died 3 years ago. She left their house to 5 of us (including the executor who is her son) How do I get her executor to disburse my 1/5 of the house left to me. Her attorney, Ted Updike of Mesa, AZ, will not return calls and/or just says that he's "working on it." and how the son is now trying to buy that house that he moved into 3 years ago without paying any rent to siblings. He bought the house from trust funds.
Answer
You must take action at once to achieve your goals, and you can do so by filing an action in the probate division of Superior Court to force the Personal Representative of the estate (Executor) to administer the estate according to law and to perform his fiduciary duties owed to each of the heirs. Similarly, if he is trustee of her trust, you would ask the court to enforce the provisions of the trust agreement. In each case, you would ask for an accounting of what he has done with the assets and income of the probate estate and/or the trust assets. He is not allowed "self dealing" or breach of his fiduciary duties owed to heirs and beneficiaries.
What are the different functions of layout?
Layout FunctionsThe term layout implies newspaper lay-out. Related terms are format and page design. The way news items are placed on a page. Mind you, it is not confined to news items; it includes advertisements, news photographs (also called pix). A Chief Sub-Editor, or someone else, depending on the newspaper size and staff strength, plans a page depending on the news flow. Prior to that, the advt section marks out the advt that have to appear on the page and send in a dummy. The remaining space is meant for editorial content: news stories, graphics like cartoons, pix, charts, tables.
Based on newspaper style, or the day's news mix, the layout can be vertical, horizontal, radial or circus. (Terminology may vary from time to time or clime to clime. Currently, the term modular make-up is in vogue in Indian English newspapers. Language papers have their own jargon).
The main function of layout is to arrange news content in a proper order that the whole look has balance, contrast and harmony. Its function is also to grade news, tell the or show the news effectively. The functional design is the best design (layout). Well, the layour should not be clumsy or jarring. Then it is no make-up/layout at all. Make-up and layout are interchangeable terms)

Hello...
I am a creditor in a Chapter 7 bankruptcy case. The (only) notice I received gave a deadline
for filing proof of claim forms. I began the process of filing online, and on the second page
there was a statement saying the case was ruled closed some 12 days earlier. There was
still a week left before the original (and, again, only) declared deadline. Calls to the court
and trustee resulted in fairly vague answers to the effect that the judge could close a case at
any time if the debtor was found to have zero unprotected assets. The "meeting of creditors"
was described in my notice as mandatory only for the debtor, optional for the creditors. I
was told one creditor attended and was awarded property and or goods at that time by the
trustee. The "meeting" was three months prior to the claims filing deadline. The case was
closed nineteen days prior to that deadline.
Does this sound strange or simply wrong to you?
The second part of my question is this: Both of two promissory notes I hold have a personal
guarantee along with the corporate promise. They are duly signed and notarized. Does this
give me options that go beyond the restrictions and/or rulings determined by the court in
regard to the chapter 7 case? The case is in
Florida.
Thank you very much for your help. (Sorry for the scattered format...that's the way my letter copied to this form.)

My wife and I are part owner's in a family business incorporated in Wisconsin but doing business activities in California. The other partners are all on her side of the family. I am considering divorcing my wife for infidelity and emotional cruelty. What are my chances? Can I expect to get anything? The business evaluates around $10mil.
Answer
It sounds as if you would get something, since you say you are both part owners. How much depends on how the shares are held, when and how they were acquired, and which state you are filing divorce in. Neither the state of incorporation nor the state in which the business is conducted will have much if any relevance to what you get. The grounds for the divorce, at least in California, would also have no impact on the division. If the shares are community property, then you would each get half the shares. Of course if there are other assets, you could give her all the shares in exchange for a larger share of the other assets so that the values even out. Alternatively, you could take your half the shares and sell them to the other shareholders, or the company might just buy them back. It's all open to negotiation once the ownership and value are established. If they are not owned as community property, then it gets complicated. You most likely would still have significant rights in the shares but the situation would be far too complicated even to make general recommendations in this kind of forum. If I can be of further assistance, please let me know.

An attorney was hired for custody of a child doesn't return calls or provide legitimate assistance, he was paid a retainer and then didn't even file the motion for a hearing..my friend had to file it as the attorney claimed he was busy, since hiring this attorney in January 2012, he has not returned calls and seeming avoids e-mail requests. My court date is this month on the 22nd and we haven't heard back from the attorney since July. The ex husband in the suit has several VPO's filed on him due to his violent behavior and has beaten, pulled guns on my fiance, let the minor child get molested while in his care, stalked and harassed many people in our social life, and limited visitation time under the guise of events and tutoring for the minor child
.while taking everything away from the minor child as punishment for made up issues. This child wants to live with me and his mother and is and has been subjected to injury and abuse under the care of his biological father. My attorney won't return calls and has all the documentation i need for this custody hearing...what can i do about this and my attorneys failure to properly represent and help us ?
Answer
There are a couple of things you might try. I would send him/her a certified copy of a letter stating your concerns. With that letter I would copy the bar assoication. It may the attorney has a reason for not getting back with you (health problems etc.) If that fails to produce any results you always have the right to fire a lawyer. It is short notice but a new attorney could get your file and information and if necessary ask the court to continue the court date.

Does my divorce lawyer have to handle my QDRO or can any lawyer handle it? Also is there a time limit on handling/finalizing a QDRO?
Answer
There is no requirement that your lawyer must handle the QDRO--any lawyer may do so. There are no explicit time limitations in submitting or finalizing your QDRO. However, you may run into difficulty, or perhaps even be barred by the court, if there is a substantial delay that has an adverse impact on the other party or on the pension plan.

Can a reposession company move other cars to get to the one being repoed?
Not by themselves. For this to happen, a sheriff, marshal, or police officer would have to let them do so and be present. The sheriff and marshal does not need a warrant; they only need the repossession order and/or a court order. The court order is dependent on the situation.

It depends on how wet the engine got. Answer
You need to contact the Industrial Commission of Arizona and see if a claim was ever filed. If not, file one with them. If it was, and the claim was either closed, or classified as "no time lost," you still have reopening rights. If the claim was closed less than 90 days ago, you should immediately request a hearing. If longer than that, then you must have a doctor's report that states that today you are suffering from a new, addition or previously undiscovered condition, and that the condition is caused or contributed to by the original injury.
The Industrial Commission website, www.ica.state.az.us has many valuable resources that may help you. Good luck!

I have a 11 month old son and I am wanting to change his last name from his fathers to mine. We were never married, he has not contacted him in over 8 months, and he is the only family member my son has with that last name. I believe that it would be better for my son to have my last name. He would not be confused as to why his name is the only one that is different, why it is different from mine. I think at a young age it would help him feel a better sense of self and family.
His father as stated has not contacted him in 8 months even though he loves with his mother who does occasionally see my son. He has never paid support (or been asked to) and initiates no converstaion with me.
I am wondering if I need his permission to do this. I know he would be informed and have a chance to fight it but I am wondering if I can go through the motions and fill out the paperwork and file without his consent in the state of Indiana.
Answer
if that name is not mentioned any where in the records you can change. if that person is not the father of child y did you insert his name to your son's name? that is my question.any way you can change no problem but whats there in birth certificate? you have not state that if there it is entered then you cant change you have to swear an affidavit that can be done with help of your advocate you can do so.

I was recently terminated from my position, and my bosses promised me severance. A week later, they changed their minds and decided not to give me severance, however, neglected to remove me from payroll, and paid me anyways. They wrote me an email, stating the discrepancy with payroll, and said they were going to withdraw the money from my account. I was able to stop them from doing this through the bank, but now they are moving forward with trying to procecute. What rights do i have? I was promised severance (have an email stating this, but no contract) but never paid, and would like to know if I really have to pay the money back.
Answer
First, you have to give that money back. It was paid to you in error, and does not belong to you. By depriving the employer of its funds, permanently or for an indefinite period of time, you may be charged and prosecuted for petite theft, or grand theft, depending on the amount. You may also be liable in civil court for civil theft, and could become liable for four times the amount you are keeping from them.
The severance issue is a separate issue. If they promised you severance, and you took some action in reliance on that promise, such as did not accept a job opportunity or did not apply for unemployment because you were relying on their promise to pay you a severance, you may have a civil cause of action against them. However, it is unlikely you will be able to make them also pay your attorneys' fees, so it may not be worth the lawsuit, depending on the amount of severance you believe you are entitled to.

do I get to keep my house if the house is in my name only
do I get to keep my house if the house is in my name only
Answer
You have failed to provide sufficient information to adequately respond to this question. All property and assets obtained during the marriage, regardless of title, are marital property. There are factors which play into each parties equitable share, but this requires more information than you have provided. I urge you to consult with a family law attorney who can obtain the information required to provide you the legal advice you need. I do not suggest moving forward with any action involving property without an attorney.
Answer
While Georgia is not a community property state, the trier of fact in a divorce case (either a judge or jury) is tasked with making an "equitable division of property". Several factors go into who gets what and why, and the fact that the house was owned by you prior to the marriage tends to be a big factor in your favor. However, there are several other factors which can come into play, so you need to sit down with a family law attorney and give them all of the relevant facts so that they can give you an informed opinion about what you are looking for.

if i get married for second time before my first divorce was final, what are the legal consecuences
Answer
If you get married while you are married, the second marriage is void. That being said, if you divorce the first spouse and continue to act as the husband or wife to the second spouse and you continue to live your lives as husband and wife then you will likely be considered married. Unless anyone questions the overlapping marriages, there will not likely be any consequences. If your first spouse learns of your second marriage he or she may try to have you charged with bigamy. Please meet with a local lawyer to find out if you have anything to worry about in your particular case.
