i had bought an antique soda machine 3 years ago and sent it to a guy in Atlanta for restoration. The machine cost $3900 and $360 for shipping. He charged me $4000 to restore it and I gave him $500 to ship it back to me. I had other machines restored by him but this is the last one left and the most expensive by far.

He has stalled and stalled, I have every email from him plus have documents on the money sent to him. He now won't return my email or any correspondence. What can I do legally?

You posted this as a criminal defense question, but it's not a criminal matter. What you can do is sue him in civil court. I assume that, based on the dollar amount, it would be small claims.

Hire an attorney in that state to take legal action, either to settle or sue. If you sued in CA small claims court, you would haves an obvious problem with 'jurisdiction' over an out of state person.

Your entire matter would have to be reviewed by an attorney. It may be possible to assert jurisdiction over him here in California, but that is going to require review of documents and the underlying facts by an attorney.
