Question

My husband abandoned my son and myself and after 2 weeks he wants to take our son for a movie and dinner. I told my son that his dad needs to get my permission to even go out as he abandoned us. What are the laws as far as desertion in concerned in ga

Answer

Two weeks is not sufficient to be considered abandonment or desertion. Desertion must be for at least one year to qualify for a divorce.

However, you may consider filing for a divorce under irreconcilable differences and ask for full custody of your son with temporary and permanent child support. At this point, at least, both of you have equal rights to the child. He should also be paying some type of child support.

Answer

Absent a ruling as to custody in a divorce case he has as much right to see the child as you do.

2 weeks is not desertion or abandonment. He is required under Georgia law to pay support at least every 30 days.
