I want to start a small claims actions against a former landlord for a dispute about my deposit. The house I rented from him is in Raleigh, but he lives in Roanoke Virginia. Do I have to file the claims action in Roanoke county?



Answer

If the landlord lives in Virginia, you cannot sue in small claims court in North Carolina. If you tried to sue in small claims in Wake County, you would only be able to do that if you used the North Carolina rental property address. If the property is vacant, you might not be able to get service of process - if the property is occupied by another tenant, you might still have problems getting the landlord served.

You can sue the landlord in district court in North Carolina. But why would you want to sue in North Carolina? Is the landlord a person or corporation? If a private person, then a North Carolina judgment will not help too much if the person has no real assets (other than the home) in North Carolina. Any judgment would be a lien on the real property but it would not get you paid.

Virginia has wage garnishment so that you will be able to enforce any judgment if you recover it. You might want to consider bringing a lawsuit in Virginia.

I was temporarily knocked unconcious due to hitting my face on something in my vehicle causing a deep laceration to my face. When police arrived on the scene they took my statement then sent me to a nearby hospital to asses my injuries. Because I was 3 days late paying my insurance my insurance company declined to pay any of the damages. For the next three days after the accident I was out of sorts and not myself. I did not recieve any more information on the accident until this month, September, when I recieved papers stating that the trucking company was sueing me for nearly $80,000.oo in damages, medical bills, and the expenses that the trucking companies insurance covered. I feel as though I have not been treated fairly because I did not recieve any information on the accident until 8 months after the fact and I was made to make a statement right after the accident when I had not recollection of what had happened.

It is a 3rd degree felony offense which carries a punishment range of 2 to 10 years in prison. Depending on the facts of the case, it could be pled down to attempted assault on a peace officer which would be a state jail felony (and carries 6 months to 2 years in state jail) or even possibly repled as a resisting arrest which is a class a misdemeanor and carries up to 1 year in jail. As a first offender, you are eligible for probation - even deferred adjudication probation.

There is no normal sentence because the facts of the situation can vary so widely. If the person was intoxicated & really just trying to prevent his/her own arrest but jerking & pulling, etc., then I would think it could possibly be pled down to resisting. But, if the person was actually attacking the officer, then that is a completely different situation.

The officer will have some input into what the punishment should be as the prosecutor will talk with him/her about the incident and any injuries the officer may have suffered.

Definitely need a good lawyer.

I am involved in a SACPR suit, both parties residing in Texas. I need a straight answer to a direct question. I have never been served any paperwork by a process server, constable, etc or signed a waiver of service. The ONLY thing with my name on it is a Rule 11 agreement exempting me from a TRO( the R11 agreement doesn't state anything regarding service of papers). The court hasn't so much as attempted to contact me or notify me of anything and proceedings appear to be unaffected by this. I have limited understanding of Texas Family Code, but I believe they are required to officially serve me paperwork

I think you've posted this on other websites and I've answered it. The issue of being served is now irrelevant. I recommend that you hire an attorney. All service does is notify you that you are being sued. You know that and have appeared in the courtroom. You entered into a Rule 11 Agreement -- you are now part of the case. Next time you are in court, mention your concern to the judge if you are pro se. I suspect he will say "move along" or something less kind then that. You can also call opposing counsel and ask to be formally served. I suspect the attorney will hang up on you -- but give it a try since you want to be served so badly. I hope this answers your question. If you don't like it or don't understand it, then hire an attorney.

After I finished it and only ice was left my wife (who was also sipping it from my glass) found out that there was a huge cockroach. And if you have ever been to Louisiana, you can imagine how aversive it is. We suppose that the cockroach was in the ice cubes. We took pictures and we do have witnesses.

On the other hand, if she has asked you to leave it might be wise to honor the request until you can get some legal proceedings under way. If she files for divorce in New Mexico the court will put a temporary domestic order in place that will set parameters for who gets access to the family home - and if she's been living there it will be likely her. She can very easily get a temporary restraining order to keep you away, which is a pain in the butt for you if it occurs. Returning to the home after she has asked you to leave could easily lead to a confrontation and police involvement that neither of you will like. If you need to get stuff out of the house try to make arrangements with her. You can ask a cop to accompany you to the house to monitor the situation wile you get your stuff.

I'd start by checking the coolant and look for leaks. I'd go further by seeing if the thermostat was good. You can grab hold of the upper hose on many cars and feel if water is flowing or getting hot.

I recieved a summons of Garnishment from a law office regarding a debt from 2007. It is from Ga because the debt originated in Ga but I am currently in Florida. In this situation are they violating the FDCPA by not bringing this to the county that I currently reside in? And if they successfully garnish my bank account and I just close it and hold out til 2014 wont the statute of limitations exceed the crime. Is the fact that the reason I never paid the debt in the first place because I don't feel like I owed it even a factor in this at all? It was an internet scam and they sent me a fraudulent check, the bank cashed it, I sent the money back to the sender and they said that I owed it back. Is it not the bank's fault for cashing the check in the first place being they are a financial institution? How would I be liable for a fake check wouldn't it be the person who wrote it? Either way this is a law office/collection agency im dealing with now so is any of that even relevant?

A garnishment does not happen until you lose a lawsuit. Once that happens, there is no statute of limitations. (Generally you are liable for the fake check scam, so that's probably why you lost the suit). You need to see a lawyer ASAP to determine if you have any defenses, and, if not, whether bankruptcy may be an option.

I have to agree with Attorney Ashman here. Not only did you make a bad decision in falling for a phony internet scam, you have gotten a little legal education and have gotten things confused.,

Neither the FDCPA nor the statute of limitations applies here. A judgment has already been entered in Georgia. Judgments last FOREVER. The ability to execute on judgments can be revived after 7 years. Judgments can remain on your credit report for 7 years. A GA judgment can be transferred to Florida or any other state in which you own property, registered and enforced as if it were a judgment entered by that state.

Regarding bank accounts, if you bank at a multi-state bank which has branches in GA, the writ of execution (called a FiFa) can be served on the GA branch and they can take money out of your bank account even though you bank in FL.

The only way to prevent them from levying on your bank account is if you do one of the following:

(1) don't use a bank account and get a pre-paid debit card;

(2) use a bank account, but only have exempt funds being deposited into it (like Social Security);

(3) if you have non-exempt funds and need a bank account, bank at an online bank like ING Direct, ready debit financial, ally or USAA (if you are a service member of the US Armed Forces or a military-dependent);

(4) failing that, bank at an out of state bank which only has branches in that state (like a Florida bank that is a state bank and only located in Florida) or at a very small community bank or credit union located 25-50 miles from your ho,me.

You do not indicate where you lived at the time the lawsuit was brought, when the lawsuit was filed or if you were properly served and what action you took, if any.

And you are wrong about not owing the money. If you deposited a phony check and used the money and then the check later bounced because it was phony, you have a duty to reimburse the bank for the money. You dealt with the thief so you are liable. Its not the bank's fault under the current status of the law (I take issue with that as banks could often protect less than intelligent people by refusing to cash the check but that is not how the law looks at it and you are liable). You should have worked out a voluntary payment arrangement if possible. You obviously did not so the bank or its assignee sued you. You then ignored the lawsuit, assuming you were properly served. You continued to ignore this so now the bank is attempting to recover on the judgment by seizing any assets.

While you live in Florida now, do you work as a W-2 employee or do you own any property still in GA? If you work, your wages are at risk as both Florida and Georgia allow wage garnishment. If you have property owned free and clear, it may also be at risk depending on value and how it is titled.

You should begin by doing what you should have done from the get go and try to resolve the debt. If you cannot afford to pay in full, then what about settlement in a lump sum? How much is owed? How much can you pay? If over $10,000 is owed, maybe you want to file bankruptcy if you can file a chapter 7. How long have you lived in Florida? There are time limits - you have to reside in the new state for 6 months if you want to file bankruptcy there. If so, you may want to consult a FL bankruptcy attorney or wait if your 6 months will soon be up. You also may want to consult a GA bankruptcy attorney if the 6 months are not up. Different states have different exemptions for bankruptcy purposes and while FL has a better homestead exemption, I don't know what all you own and it would be better for you to get educated on the bankruptcy process in each state.

The Aggravated Unlicensed (VTL 511) is a misdemeanor, so you are in criminal court rather than traffic court. Get an attorney! You will have to deal with the previous ticket before you can have any chance of having the 511 Aggravated Unlicensed reduced and to get your license back. You say 'private common' road owned by your neighbor. Which is it? Is it private or is it common? Sounds like mutually excluse, no? Anyhow, therein lies the answer. If the road is private and OWNED by your neighbor, then you trasspassed with your dogs. Hence you are liable. However, if you had the legal right to be there, AND there are no local ordinances pertaining to leash laws, you then may be in the clear. More facts are needed for more thorough analysis. It would depend on where she got the tax information. She probably got it from a listing or the sellers. So the answer is, probably not, unless she made them up to induce the sale, perpetuated some kind of fraud. Aside from that, mortgage denial based on tax information is odd. You can see the amount of taxes by searching public records on the city website. Or asking your attorney.

For the AZ part of things, you should get a certified copy of your AZ MVD record- that should have the court and a reference number (usually the citation or case number) to reference. You can get an uncertified copy of your record on-line for a fee, or get the certified copy at any MVD office (also for a fee). You could also try requesting a certified copy of your CA driving record (not just a phone call). Even if you never had a license there, most states will assign you a "record number" if there is an outstanding ticket. It is doubtful any out-of-state collection agency would deal directly with the court or AZ MVD to get the issue cleared up- it is better to go straight to the source (MVD) to get the information you need to follow-up.

I am not licensed in CA. so I cannot explain the CA procedure to be followed to contest an old ticket, but you may want to request an answer from a CA attorney on that issue.

You both own an equal interest in the house so yo can not sell without his permission. If you can not get him to agree to a sale of the house, you would have to file for partition, which could cost about $15,000 in lawyer costs and fees.

You could sell only your half interest. You could theoretically sell it to a member of the public, but in the real world nobody would be interested, so your market is essentially the other co-owner.

The serious exit strategy for an unhappy co-owner is a partition action, which is a special kind of lawsuit that asks the court to order the house sold and the net proceeds divided fairly. Although a contested partition action might cost $15,000 (or more), most are settled out of court soon after being filed and served, often one party buys out the other, or they agree to a private sale process. Any issues between the co-owners that can't be resolved by negotiation can be referred to quick, binding arbitration.

Yes you can do that. However, it is ultimately up to PA to decide what to do with a withhold of adjudication, but GENERALLY speaking most states will respect that withhold and not impose points in your home state.

As a healthcare professional in California (MD,RN,LVN...etc), will I be heald accountable for not helping in a medical emergency such as for someone choking or needing CPR? Does it make a difference if am in uniform or not? I know there is a good Samaritan law, but I recall in NY one would be required to stop and help if he/she is in the healthcare field. Of course this could lead to that person being involved in a lawsuit thanks to a few cracked ribs during CPR. With this fear, I know a lot of healthcare personnel willing to walk away in an emergency to avoid legal complications. Thanks for any answer you could give.

This is a real dual edged sword. Legally the best thing to do is absolutely nothing. Call 911 and walk away. However, that is a lot easier said than done.

As a healthcare professional you are not required, under the law, to render aid when you see a medical emergency. However that can change quickly. If you start to render aid and then stop you could be held liable.

The latest case is Van Horn v Watson. However the legislature has reacted to the California Supreme Court's decision and the law may change in the near future. However, at this time you are not required to intervene unless you have a legally recognized "special relationship" with the hurt individual.

It's been 3 weeks since arbitration and now I get a interim award paperwork from the plaintiffs attorney that she sent to the arbitrator asking him to sign it as the actual award. It says I have 5 days to respond after the arbitrator signs it. Is the response in reference to agreeing or disagreeing in the award?

You need to discuss this with an attorney showing hem the paper work as it appears wrong. If the arbitrator directly requested the winning party to prepare an award, then the normal procedure is that once the award is prepared it is sent to the other side for its agreement or disagreement with the wording of the award [does it accurately reflect the arbitrator's decision], with a 5 day or longer period of time in which to agree to the wording or not. You have thirty days from the date the arbitrator signs the award to reject it, without having to state a reason, and hen the case goes back to the court as though no arbitration occurred.

We are now divorced, and have recently divided up our joint property. Since we have joint custody of our children, the OFP had to be dropped. Since this was dropped, my ex has been more intimidating in general toward me.

While married, there were a few sex movies and photos taken of me. I was not comfortable with these being taken, but I felt coerced to do so.

I made it clear that those materials needed to be destroyed after our separation, and my ex-husband reassured me that he would do so.

I deleted as many pictures I could find off several old computers that he wanted. The computers were given to him as part of the property split.

There are two external hard drives where I could not find personal pictures, but I am very certain they are there. I told my ex-husband that I was uncomfortable giving him those 2 hard drives. For some reason, my ex-husband is very upset about this.

He has clearly threatened to have one of his friends who is a computer expert to go over the computers I have already given him to restore the compromising photos and movies, unless I give him the hard drives. I specifically have until Wednesday to comply with his demand. He has only threatened to recover the photos and movies so he has them, but he has made no other threats to distribute those materials.

Could this be considered extortion or blackmail? Is there anything I can do?

The photos and videos are as much his as yours. As a result, unless there is some language in the decree that precludes the conduct that you complain about, he has done nothing that violates the law.

If you had any arrearage it is quite possible the CSRU took the entire amount. If you did not have arrearage the payor probably made a mistake. The hard part is proving it.

I live out of state and I just received hearing notice from Virginia civil claim's court that an attorney I hired years ago is claiming unpaid debt. How can I challenge this without travelling to Virginia? I terminated our attorney / client relationship after only 6 months because the service was unsatisfactory. Write to the court that you now live in California and you have never been served with the complaint so the court lacks personal jurisdiction over you. First contact the attorney and point out it wold be a breach of legal ethics that you could report to the Bar Association there for him to try to get a default judgment without having served you with the complaint.

Well, I think so... I used to be a member of this site for quite a long time. This site was indeed an addiction to me, but one must accept the truth that this site is very biased towards certain religion, customs and race. I personally felt it and reported that to its moderators... But unfortunately they banned my user account and then the IP address, hence I am unable to participate there. To note - I have been very active on that forum for more than 3 years, and with a very higher level reputation as a very good poster.
I think they are too worried about restricting their members, those always cross their limits/forum etiquette, but belong to certain religion/race that majority follows. They are obviously worried about losing their members, those belong to the "Majority", hence easily ban the posters who notify this or rebel against them. Other than that, this is an interesting forum, all about Indian style bashing and gossiping.

You do not indicate whether the default judgment is for a credit card debt or something else. You also do not indicate why the default occurred or when it was entered. Depending on the answer, it may be possible to have the default judgment opened. I suggest that you see a civil litigation attorney to see whether this is a possibility.

What happens after a default is entered is that the judgment creditor may try and collect. If you have more than $300 in the bank, the creditor can freeze your bank account. If you have real property, the judgment acts as a lien and if you sell it, the judgment creditor will be entitled to receive any equity. You cannot refinance until the judgment is taken care of. I have also seen creditors try to sell a debtor's non-exempt property (his bed, tv and other furniture). Judgments on real property last for 5 years and can be renewed every 5 years. Judgments on personal property (like cars) can last for 20 years. Judgments earn interest at rate of 6% per year so the judgment will only get bigger.

Getting back to your bank account, do NOT commingle funds with another person, especially if you get Social Security or unemployment or something like this. You do not want to be in a position to fight to get money back so either get your name off their account or get your own separate account. Better if you bank online, at a very small community bank more than 25 miles from your home or at an out of state bank (again, at a small bank - nothing in multiple states like Bank of America or Wachovia/Wells Fargo).

If you can afford to pay the judgment, enter into an agreement with the creditor whereby they promise not to seize your property for as long as you make payments until the judgment is paid off. Get the agreement in writing. If you can afford to settle for between 50% and 80% and can pay in a lump sum or over 1-6 months, try for that. Again, get it in writing. If you do not have funds right now, save up until you do. If you have no money and no way to pay ever, then consider bankruptcy and consult a bankruptcy attorney. Many give free consults. Since I do not know what assets you have, your circumstances and if you have other debts, I cannot say whether bankruptcy makes sense in your circumstances or not.

I sold a 2001 GMC Sierra with 108k miles on it on December 4th, 2006. I did not provide the buyer with a smog check pass certificate from within 90 days before the sale. Since then, the new owner has driven over 5,000 miles on the truck and is now saying that it won't pass a smog check and it would if it had the catalytic converter replaced and he wants me to pay for it because I did not provide a smog check pass certificate at the sale. I know this is my obligation as the seller under the California Vehicle Code. Is there a statute of limitations on this case? Also, the new owner claims he never turned in the transfer of title paperwork (which is his duty to do within 10 days of the sale under the California Vehicle Code). Is there some way that I would win this case if it went to trial?

If you didn't submit your portion of the transfer of title notice to DMV at the time, shame on you and too bad. Get it done ASAP. Until DMV receives proper notice of transfer, you are still the owner of record and liable for any damage or injuries the 'buyer' causes.

As the seller, you are obligated to provide smog clearance, and can be sued for the cost of compliance. There is a statute of limitations on it, but it would be at least a couple years, maybe as long as four, so that is not going to save you from your errors here. Negotiate something with the buyer on the cost, and get out of this mess.

What you propose is not legal as you have outlined it. What Citi is doing is perfectly legal. You have a couple of options:

(1) Pay off the loan with Citi - either get a new loan or borrow the funds. Then when you get a free and clear title, you can sell the car.

(2) Make a deal with Citi pursuant to which they will release the lien on your old car and allow you to substitute the new car, provided that it has a higher value. You indicated that it does not. In that case, can you pay down the loan a little and let the new car be collateral for the remaining balance.

You cannot sell the car now. Why? Because, when you pledged your car as collateral or security for the loan, you took whatever rights in the car that you had and gave them to Citi to hold until the loan was re-paid. In essence, they now own the car and you cannot sell it unless you get rid of their lien by paying it off or substituting other collateral of equal value in its place. If you try and get a duplicate title and sell the car anyway, you are not only hurting the innocent buyer but you are committing a crime by disposing of collateral that is subject to a secured interest.

Do things correctly and save yourself a lot of headaches.

In Ohio, such automatic renewal provisions (requiring 60 days notice) are actually unenforceable under the case of Meadowbrook Dev. Corp. v. Roberts, 2001 Ohio App. LEXIS 5870.

Usually, the tenant is looking to avoid being committed to the property for a full year. In such cases, the the court will usually see you as being a month to month tenant thus being able to terminate the month to month tenancy pursuant to Ohio Revised Code Section 5321.17.

But if you want to stay for a full year and they want you out, at an eviction hearing you could point to the fact that the lease says that you were automatically renewed for a full year if you or the landlord did not give the 60 days notice. They will point to your 53 days notice and you can testify as to what they said about how they considered you locked up for another full year, and further testify that you made plans based upon being there for another year.

How it comes out is anyone's guess I'm afraid.

I recently learned about a local, non profit organization which I was happy to help spread the word about. The founder of the organization asked if I would say a few nice things about the organization, so I did. Later, he posted a video of our "interview" and an altered quote on his website with my name and work information. My work asked me to have it removed, seeing as how the way he altered the quote made it speak negatively about another organization. After this encounter I decided this obviously wasn't an organization I wanted to be associated with. I emailed, called, and messaged him on YouTube and Facebook to attempt to get this information removed. The conversation has now turned ugly and he has become intimidating and refuses to remove the information. In fact, he has changed the name associated with the quote but he has left my work information and my very specific job title. I did not sign a consent or release to use my information. Is my asking him to remove it enough? Do I have a case against him? Is this something that I could issue a cease and desist letter for? I don't know what further action to take and I am now fearful he will take action against me, or my employer will take action against me.

Power of attorney ended upon death so your sister has no authority to do anything with that. Your mother would continue to receive her Social Security or now that her husband has died, she can get whatever was paid to him, assuming they were married for at least 10 years.

Otherwise, your father's benefits would end. I suggest that your mother contact her local GA Social Security office or, as you have internet access, that you go to the Social Security Administration's website.

Is there a possibility that your sister has a power of attorney over your mother? If so, the Social Security checks are still paid to your mother unless your sister is designated as a payee. Your sister, if she had power of attorney over your mother, could manage your mother's bank account.

Regarding VA benefits, I don't practice in this area but again, you would go to the Veteran's Administration website and read the information there or contact them. I don't know what the VA benefits were for - if it was retirement and there was a surviving spouse option, then the benefits would pass to your mother. Otherwise, they would end.
