Question

A private healthclub in illinois provides an unlicensed daycare (it's actually not a daycare but an activity center) where members may drop off their children while they workout on-site, with a maximum visit of two hours for the child in the activity center. Question is, if the parent is not on-site, lets say the parent sends the child with a nanny, and the child gets injured, who is responsible for the child? the healthclub, nanny, parent?

Answer

As a Franchise Attorney I can only say the following. It depends on how the child gets injured, first of all. Second, you can be assured the healthclub gets sued no matter what, as they represent the deep pocket. Consult with a good business or franchise attorney in your area for specific advice.
