However, since I will be a student, I will no longer have any income. Additionally, while working in China, my income was lower than the federal poverty minimum income for two people. I know it's possible to have someone else sponsor her, but unfortunately my Dad lost his job during the financial crisis and my parents have had a low income the past few years as well. How can I meet the requirements of the K1 visa based on this information? Will student loans suffice for the financial requirements? I assume you are a U.S. Citizen. Student loans will not suffice for income. Ownership of property can work too. For example, if your dad has sufficient equity in his home. Note that for property to count, it needs to be 5 times the value of what actual income would be. Try finding another sponsor if necessary.
If she is able to get an alternative visa, such as a student visa, it will work somewhat. However, if Immigration knows she is planning to marry you, she will have a harder time getting a student visa because they will tell you to do the K-1. Make sure that her intent at the time of leaving matches the visa she obtains. If she gets a student visa, then her intent should be to come and study. That may change after attending a semester or two, but the intent should be she came as a student if she gets a student visa.

Although I have seen a civil case filed by a mother of a 15 yr girl get a civil RO because the accused was 23 yrs old and he was sending explicit texts to her. That was the entire allegation and the girl didn't care and could tell she was coerced to even be there by her mother.

I was in the intersection with a stop light that was green and waiting for traffic to clear so i could complete my left turn. Traffic did let up. the light chancge to red and i had to complete my turn or I would be blocking cross traffic. I proceded to make my left turn and a driver who was trying to beat the yellow light but didn't ran the red light and hit my truck in the center and back of the right side. I was taken away in an abulance and had no chance to collect witnesses, I paid my fines and went on with my life. Last week I got a letter from a company called Praxis saying that I own them money for property damage to the other drivers car. Praxis is a third party and not the drivers insurance. I havn't heard anything for the last 4 years and 10 months and now i got this letter saying i need to pay them. I read somewhere that the staute of limitations on property damage in Illinois is 5 years. Which is about two months away. Is this something I need to worry about? I dispute that I was completely at fault for the accident. I feel like i'm being intimidated in to paying for her damage. I have NEVER heard from the driver or her insurance company about damages. ignore the letter. unless something has drastically changed that i am unaware of, the statute of limitations is 2 years for the accident whether it be injury and/or property damage. if you do get a summons or complaint, contact a lawyer in your area. however unless that happens don't lose sleep! probably the other guy's insurance paid his damage under collision coverage and then sold its subrogation accounts to a collection agency. it then is sending out letters to whoever trying to collect whatever it can. good luck.

We are in the process of letting the bank take our small rental house in NC (we live in FL), and have been delinquent on the mortgage for over 6 months. We lost our shirt on this rental over several years. The bank has notified us that they will be foreclosing, but as of yet nothing has been filed and we are still waiting.
We just got a letter from the local code enforcement that the lawn is overgrown and needs to be cut or we may suffer either fines or possible criminal charges.
Is there really any danger of prosecution for us in this situation? Can we be affected when we live in a different state? We expect the bank to take the house soon anyways...and dont want to spend more money on it if it isnt necessary.

It depends on where the house is at. There are some areas where banks are refusing to foreclose and allowing the property owner to keep the property if the owner will pay a frarction of the purchase price to the bank and the bank will release the mortgage lien. So the bank may or may not foreclose.
Have you tried to do a short sale of the property if it is worth less that what is owed? Is this your only mortgage? If so, have you inquired about a deed-in-lieu of foreclosure?
I would explore those options as an alternative to foreclosure if feasible.
How much does it really cost to hire a day laborer to go and cut the grass? When a property is foreclosed upon, there usually are no bidders other than the lender. Out of the sale proceeds, unpaid taxes or assessments and the mortgage lien are paid. The law does not address fines or criminal penalties.
For little funds, I would do yourself a favor and pay somebody to mow the grass periodically until the date of the foreclosure sale rather than risk further more expensive criminal sanctions/penalties. While an arrest warrant will not be issued for you if your are out of state, you could be stopped for a traffic matter someday - a check is run and the law enforcement authorities will see the NC matter and you may find youself in jail. So I would not risk it for something small.
However, I have not seen the document you have received and I don't primarily practice in this area. Another attorney may have a differing opinion and if you get different views, then I would consult with a foreclosure/real estate attorney in the county where the property is located. Even if I am 100% wrong, it will be cheaper in the long run for you to just pay someone to periodically mow the grass than to pay an attorney to tell you I am wrong. ITs your decision.

I agree with Miriam, but caution that unless your daughter and any other children are named in the Will, even if not left anything, there could be claims made. My thought is that he likely wasn't paying any rent and since we removed him of his property manager status, it will be hard to show that he had a set rent payment and then stopped paying. If you purchased the building you should have obtained copies of all written leases from the previous owner during the purchase. If this person has an oral lease, then you may need the previous owner to testify to that and your unlawful detainer action would reflect that the lease is oral and month to month.

But nobody seems to be enforcing any of them .
Here is what it states .
All one story residences constructed shall contain not less than 1400 square feet of above ground interior living space . All multi-level residences shall contain not less than 1700 sq. ft. of above ground interior living space with not less than 850 on the first level . Interior living space shall be measured by exterior dimensions but shall not include decks, porches, garages, basements or other spaces enclosed by foundations and any other unheated or unfinished space .
Here is what is taking place . There were several bi-level & tri-level homes built in the subdivsion . I am confident to say these builders are not following the covenants and restrictions in this section above . I believe that they are including the areas of the homes that are enclosed by concrete in their lowwer levels, into the amount of square footage . My question is what can I do to protect my investment ? I would not of bought this lot knowing that these homes where going to be allowed to be built in this subdivision , and nobody enforcing the covenants and restrictions .

A living will is just a directive to your doctors that you do not want to be kept alive by mechanical means or given food/water if you find yourself in one of several conditions (you have a terminal illness, are in a coma/permanent vegetative state or have Alzheimer's or dementia). A living will governs how you wish to be treated by your healthcare providers while you are incapacitated but still alive. By comparison, a will only takes effect upon death. While you can change a will by codicil there are no codicils for a living will. Just make a new one. Many hospitals or other places have free ones. You can do an internet search and find them too.

You can try but depending on what the suit is for, you could be equally liable for her debt (especially if it is a "family necessity") and so moving it around could be useless. Alternatively, if you do and you are not otherwise liable, then if there is a judgment against her and the judgment creditor finds out she has nothing to speak of but everything was transferred out of her name to avoid her creditors, they can still come after you for participating in what's called a "fraudulent conveyance" of assets, which could result in your just having to undo everything. So see a lawyer, bring all the information, and get proper advice!!!

Freedom of speech lets her say anything she likes, subject of course to possible slander suit if you could prove actually false allegations. Prove, not merely your denial.
Not only 'can' the school, but they probably 'must', investigate any allegations of improper conduct by staff. You need to provide them all evidence and testimony available to rebut her allegations. I think its a closer question. Although I don't (and won't) sue lawyers, an attorney who does not take advantage of known legal protections against liability (or attachment), like the homestead, leaving the property unprotected like a sitting duck for attachment, has arguably committed malpractice.
While I agree the bank's lawyer didn't technically represent you at closing (and s/he should have ensured the homestead was filed so the bank's asset would be protected), if you hired your own lawyer for the closing and that person missed it, without legitimate explanation or excuse, you may well have a malpractice complaint.
Not too many lawyers sue other lawyers, but they are out there. This is a close case and, if you're inclined to bring a claim, contact the lawyer in question first prior to suit (or have your lawyer do so), and see if you can resolve this quietly and informally without filing a lawsuit.

Depending on the language of your lease, the resident manager likely does not have to accept your January payment if it's late. HOWEVER, the landlord CANNOT evict (disposess) you from your unit without first filing a dispossessory (eviction) action with the court. You must be served with papers informing you of the time and date of the court hearing. If you want to stay in the unit, I would suggest you bring all past due rent and offer to pay it at the hearing. If the court allows the eviction to move forward, you will be given a certain number of days to get your stuff out. If you don't, the sheriff can come and forcibly remove you and your stuff. Of course, if you can afford one, I would STRONGLY recommend that you hire a lawyer for the dispossessory hearing to represent you. Your chances of success improve greatly with a lawyer at your side.

Is it possible to learn martial arts by yourself without the help of another person?
Yes but it is extremely difficult; the majority of Chinese martial artists, are open to the idea that some people have uncommon "genius" for martial arts. However, such people are exceedingly rare. From a Chinese Kung Fu viewpoint, this is what mastery of martial arts requires;
1) Humility, and it is cultivated, often, through janitorial work. In the Shaolin temple, the children who first enter the gates spend the first 3 years there, doing nothing but sweeping, scrubbing floors and yes cleaning toilets, only at the age of 8, does any actual martial arts training begin. In the internal schools, specifically Tai Chi Chuan, janitorial duties last for a whopping 10 years, however I believe that during those 10 years, the Tai Chi trainee is made to stretch, and hold the Zhan Zhuang posture (google it) for long hours. The first 10 years of actual, serious martial Tai Chi Chuan training, involves heavy physical conditioning through janitorial work, which also serves as psychological conditioning to instill humility, in addition to develop a strong flow of chi, which requires flexibility and the constant practice of the Zhan Zhuang posture. The Zhan Zhuang posture, unclogs any blockages of chi in the body, and by the begining student's 10th year, all chi channels have been unblocked, and actual Tai Chi training can begin.
2) Physical conditioning which begins with flexibility, in most forms of Kung Fu, this is what usually follows janitorial work. All Kung Fu schools in China, demand total flexibility, roughly equivalent of that of a female Olympic gymnast. You are not taught any martial arts, unless you are that flexible first.
3) From flexibility, they move you on to strength conditioning, which involves a lot of stance work, "exotic" calisthenics like the kind you see in Kung Fu movies, they may have you do upside down hand stand pushups for example, until you can do 1,000 of them, and hold the horse stance for 2 to 4 hours. Some weight training may also be involved, specific to the muscles used in the martial art most predominantly. For example, part of the reason Bruce Lee was such a forearm fanatic, and emphasizes his forearm muscles so much, is because Wing Chun uses a lot of "trapping." That is, trapping an opponent's arms, so that they are open for a hit to the head. Hence, although Lee trained his whole entire body, he placed special emphasis on the forearms, muscles specific to his main martial art (Wing Chun).
4) Finally, Chi Kung, and Nei Kung, depending on style. All styles of Kung Fu, use Chi Kung, no exception. Chi Kung is known in the west as an exotic sequence of often circular movements, designed to promote better breathing, and to a point that's true, but, different styles of Kung Fu emphasize different things. Some styles of Chi Kung for example, send chi only to the bones, to promote bone health. In the Shaolin temple a form of Chi Kung known as "marrow washing" is used. In the Yang style of Tai Chi Chuan, abdominal Chi Kung is used. That is, while breathing in and saying "heng" with the wind passing through your vocal chords, you suck in your gut as hard as you can, and when you breathe out, you say "ha." That method of abdominal breathing, is designed to bathe the entire body with Chi, every single tissue. Different Kung Fu schools also, have different methods of Nei Kung. I'm sure you have googled the Zhan Zhuang posture by now, or seen it before, that "tree hugger" posture. Although the most highly regarded method of Nei Kung ("internal work"), it is not the only one. Take for example the Shaolin horse stance, that is, holding the horse stance for 4 hours; that qualifies as Nei Kung. Assuming the horse stance position, lowers the Dantian in a manner which circulates the chi to every single muscle in the body, in due time, making the muscles work in total harmony with each other, the purpose of the horse stance, is to harmonize the muscles so that they work as a single unit. Look man, a martial art can use Chi stuff a lot, and still be considered "external." How can I put this another way? In Shaolin Kung Fu, although Chi is used to protect the body, your primary weapons are your muscles and bones, and any way, you are trained to use them in self defense, in Tai Chi Chuan your main weapon is your body's own energy, hence why the Zhan Zhuang is emphasized, that is development of the Chi to the point where it is so potent, it can be used in a fight. Harmonizing the flow of Chi, causes the body to more readily absorb the Chi of the air itself without conscious thought (at the master level), and, it also has the effect of harmonizing the muscles. The Mabu (horse) stance, harmonizes the muscles through the use of Chi, and gets them to work together, however the Zhan Zhuang, it pretty much does everything but see, that is precisely why the Zhan Zhuang posture, although seemingly simple, even silly looking, is that much more difficult to master. That is the reason that, the truth is, serious internal martial arts work is in fact far more brutal. Assuming you have a strong work ethic, you actually stand better odds of surviving the Shaolin temple, than you do Wudang mountain.
The point I'm making here is that it is difficult enough to survive having a teacher there, much less studying on your own. Besides before you even learn any martial arts, you need to emphasize Chi development and flexibility, together, both having equal importance, and only after you have achieved superior health, can strength conditioning with martial arts moves training begin. If you do everything backwards like me, your moves will be sloppy, no matter how much you correct them.
First the body must be balanced and harmonized, then the training can begin, if you are planning on doing that stuff on your own, stretch, stretch, and keep stretching, until you're like an Olympic female gymnast, you don't need to be a contortionist, but you DO need to be that flexible. Also "pretty flexible" won't be enough; Olympic Female gymnast, or not at all. Also, as best you can you need to train in either the Mabu, or Zhan Zhuang, depending on what you want (internal or external). Between those two the Mabu stance is easier, believe it or not. I'm not kidding around here, the Zhan Zhuang, can be overwhelming, if you stretch before hand, to loosen the muscles, sometimes you may feel a potent flow of energy between your finger tips. On some days it may flow so strongly, you may even hear it; chi will actually make noise, if its flowing strongly enough. Remember though, just because you have those few "lucky moments" that does not make you a master. So long as good health, outstanding good health and being lean and physically fit as is proper for a man or woman, ellude you, as long as perfect calm and peace are not yours all the time, not just when you meditate, or shortly after you meditate, you are not a master.
The gold standard of what a "master" is, if anything, of any discipline, was set by Lao Tzu. A true master, has the following qualities;
1) Outstanding, almost unnatural good health.
2) Calm and peaceful, no matter their situation, a very small to non-existent ego.
3) The flexibility of a newborn baby, which is your actual goal when stretching, actually.
4) The body of a physically fit 18 year old minus the acne, and youthfulness, even into middle and old age.
Lots of people who practice Tai Chi and Nei Kung, have had moments when they feel their gut heat up, or they feel a potent flow of energy course through them, what means is not that you have attained mastery, but that you are making progress, that is the warning I read from an obscure Chinese gentleman. You must keep in mind that the mark of mastery is good health, but it is good health that is outstanding, almost unnatural. A man who is not lean, or at least lean far as they way he is built, is not healthy. In the western world good health is defined as not being sick, either with a long term, or short term illness however in the east, at least in olden times the way "good health" was defined, was someone possessing outstanding, glowing health. A healthy man, is lean, and his muscles are naturally, reasonably well toned, and if he so chooses to build strength, he will gain strength quickly, while a woman, a healthy woman will have the *cough* pliability of an 18 year old girl, and perfect skin.
Yes there is a gold standard, and Lao Tzu talks about it frequently in his Tao Te Ching; the Chinese believe, that different people require different disciplines to perfect the spirit, some require martial arts, because they are physically and mentally weak, and need self-confidence, some require caligraphy because they do not know how to be delicate or gentle, while some, require medicine, the study of medicine because they have little compassion for others and need to learn it. Whatever discipline has fallen on your lap, that is the discipline meant to perfect your spirit, at least that is what a Chinese Daoist would say. If your spirit has been perfected and purified, through that discipline, and you almost glow you are so healthy, then you have become a master.
Remember a strong flow of Chi, assuming you have studied that on your own and stretched hard, does not mean you have reached mastery so long as glowing health and good habits ellude you, you are not even close.

In 2008 we agreed on a 70/30 time share (father is custodial) due to certain circumstances at the time, which is still the current order, although I have my son much more than only 30% of the time. At the time of the agreement, it was understood that this matter would be revisited. Since then, my ex husband became employed as a police officer and has an irregualr schedule. I've has my son for weeks and months at a time, most times with a moments notice, due to my ex's work schedule. Last year I ended up having my son 60% of the year. Our son does so well when he is given a solid schedule, and I've tried explaing that to my ex, but he is hell bent on staying the custodial parent, even though it isn't to our son's benefit. He assumes I am on call 27/7 for his convinience if he has to work and our son is with him. I know the judge is going to do what is best for our child, since we are unable to work things out ourselves, but what is my LEGAL responsibility to serve as his "on-call" baby sitter? I always felt this moral obligation to help him out with his work schedule, but it's gotten to a point where he is taking advantgage and even becoming nasty if I can't take our son at a short notice (which is rare!). You need to consult an employment lawyer, but my experience has been that some of my workers' compensation clients are able to draw unemployment by certifying they are "able" to work "within their physician's restrictions". What is the difference between the Formula one racing car tyres and normal car tyres?
Formula 1 cars use tires called slicks. Likewise, Drag racing cars use slicks, and NASCAR uses slicks as well, the tires are just of different sizes. The difference between slicks and normal tires is vast. Slicks are soft rubber tires, with no tread. At first, this can be dangerous, as your tires have no traction, or they are "Slick". However after a few laps around the track, or after a long burnout (Drag racing) the slicks heat up, and become sticky, they stick to the track in hot conditions far better than conventional tires. Slicks stay warm all race long after that. Conventional tires are composed of many different layers of rubber and metal mesh, these layers are considered a "ply". If you have a truck with 8 ply tires, they have 8 layers of rubber and metal mesh in the tread. The higher ply, the better for hauling a load. The issue with using normal tires for racing is: One, normal tread tires are designed to grip the road to a point, but they will easily lose traction under a lot of power, especially with the amount of torque and horsepower a race car puts out. You would have to check with someone who knows or has the time to research L.A. rent control, but I would guess it is 99% certain that the corporation does not have rights under the rent control laws. That is not, however, the end of your problem. You still have a lease contract with the company, and you cannot just go changing the locks any more than if you owned a strip mall and wanted to be rid of one of the commercial tenants. You still have to have an uncured and/or incurable breach of the lease, after notice and opportunity to cure to the tenant, and then you have to file an unlawful detainer action for breach of the lease, possession and damages.

Even if the corporation is not covered by the rent control laws, the last rent paid might be calculated on what the corporation was to pay so getting them out might not increase the rents you can charge. Therefore, for one, the judge may require you to go to pay 50%. However, you should ask for a modification to keep your daughter on the other insurance. The court MAY issue an order that requires you to pay past payments, but moves your daughter to your husband's policy for the future.

It refers to companies who hire "temporary" employees for long periods of time and refer to them as temps to avoid providing benefits they provide to other "regular/permanent" employees. If you are doing the same tasks and working approximately the same hours as permanent employees, you may ask your employer to change your status to permanent and provide benefits or you can call an employment law attorney to discuss your case. I have read other message boards/posts and apparently, many attorneys aren't very familiar wtih the permatemp issue even though it has been a "hot topic" for nearly 20 years. The issue began when Microsoft was sued in a class action by temps who had worked for a few years and did not receive retirement benefits as permanent employees did. Microsoft lost the case and paid millions of dollars. After Microsoft lost, they changed their policy to keep temps no longer than 1 year and wait a few months before they rehired them. My advice is to wait a few months, then if you feel comfortable, ask your boss or HR about changing your status to a permanent employee. If that doesn't work, call an employment law attorney who knows about this issue. Many of us offer a free initial phone consultation. 949-481-6909.

This is a probate matter and should be handled by the personal representative. Who are the other people on the plan? Why can't they just agree to pay the bills for the life of the contract rather than this hefty termination fee? Any decision to cancel would belong to the personal representative of your father's estate. If the bill/cell phone plan was in your father's name and the plan was cancelled then a claim would be filed against the estate unless there is something in the fine print which says that the other people on the lines would become liable.

My son is still living in the house with the soon-to-be ex-wife and her daughter. My son works a part-time job and attends school. The ex-wife has no problem with him staying in the house, as long as he pays for his own food. She does have an attorney for the divorce. Without any existing legal obligation to the ex-wife in place, I do not see a claim available to her. The most obvious possible obligation that could exist would be a landlord-tenant relationship but she is not charging him rent, so at present this is just a future possibility.
Nonetheless, I believe that if I were your son, I would get the lodging arrangement in writing signed by both parties to protect him against any future claim.
