Even if you don't have handcuffs slapped on, there wil likely be prosecution for Petit Theft Under $100, a second degree misdemeanor, provided that you have never previously been convicted of theft. If you do have prior theft convictions, the petit theft can be enhanced to a first degree misdemeanor or a third degree felony, depending upon how many priors. IF you are prosecuted with the second degree misdemeanor, the maximum punishment is either 60 days in jail or 6 months probation.
