in a Civil case if important doc's are stricken because they were submitted wrong is it possible to bring it back into the trial brief.
Answer
Definitely not. A trial brief, normally filed at the beginning of the trial before the admissibility of documents is normally decided, can only refer to documents you reasonably think will be admitted into evidence. Citing material you know is not admissible will upset the judge who might then ignore the rest of your brief. If the trial is not yet over you have to see if there is a way to get the documents into evidence.
