I was recently a party to a Civil Action Lawsuit in The Superior Court of Newton County Ga, werein a judge defered child support payments for 30 days after the incarceration of the absent parent.

Prior to this decision the absent parents arrears were 14335,00. Over the course of 5 years. The absent parent had absconded to Alabama where he was subsequently arrested and extradited to Ga where his probation was revoked and said incarceration began. Is it legal for a judge to defer child support payments under these circumstances when the absent parent had absconded to avoid his obligation?

Basically, judges can do whatever they want in order to get to what they feel is a just and proper resolution of cases.
