I assume that you mean real estate.

You will not be able to get a title policy on real estate without both owners signing. Therefore, most people won't buy the property since they will not have a "clean" title. Most realtors won't work with you either since both sellers are not available to sign the paperwork.

The same goes for most other property since you cannot convey a "clear" title. Most purchasers want a good and clear title of ownership.

Per a court ordered financial agreement I pay $150/mth on top of current payments to go towards arrearages. I have not missed or been late with any payments. The child support agency in VA has put it on my PERFECT credit report as an "adverse-in collections" status and refuse to correct it even with proof of the court ordered arrangements. This is having a major negative impact in all areas of my life, including my career. What are my legal rights? Can I bring a civil action for damages??

It isn't prohibited by any law that I know of; you might want to check with the local medical association to see whether it infringes any of the rules of professional ethics. Still, it seems to me that this is a valid example of pay-as-you-go pricing and billing. A lawyer handling a lawsuit might start off by charging a client $6,400 to research, prepare and file a lawsuit in a fairly complex matter, then a month or two later bill another $2,500 for, say, taking or defending depositions. I suspect there has been a misunderstanding as to the timing, etc. of the doctor's billings and/or what was included.

Do you have evidence that the doctor agreed the payment would cover both? They then wake up my wife finally, and my dog (a 8lbs daschound/min pin mix) bites the officer because he just burst in, and he shot him dead. They're not sure if they can continue to search, so they call their sergeant, who I guess gives them the okay. My wife the whole time is making it clear that she's not giving them permission to search and asking if they have a warrant, they ignore her. After rooting around a while they find some illegally obtained prescription drugs. My question is, is this an illegal search? My public defender seemed to think so. I did not take it to trial, I just took a plea offer and served 120 days in jail. My question is civil not criminal. Would I or my wife have a civil case against the city for the illegal search, emotional distress, killing my dog, ect? I can answer any additional questions if needed. It was my understanding that if they're not invited in, and my Mom in Texas who isn't a resident or owner of my house can't invite them and only told them to inform my wife of my situation, and they have no warrant, and there's not emergency or imminent danger or crime in progress that they cannot just bust in and search. Love to hear some feedback on this.

I am a little confused so I will apologize if I misunderstand the facts. It sounds like you are saying mother-in-law to refer to your father's wife (as opposed to your husband's mother). If your father did not have any formal will, but left his assets in joint tenancy then those assets would have gone to his wife and then after she passed away they would go however she directed by her will or through any joint tenancy that she had for the accounts. You have no legal right to inherit from your parents; however, you should meet with an attorney to review specific facts regarding your father's estate. If he had a will leaving property to you then you may be entitled to a portion of his wife's estate. Similarly if your mother and father had a trust and your mother has died, then it is possible that part of their trust became irrevocable and that you should have been a beneficiary.

First, the correct legal terminology is "on title" rather than "on the deed" to describe co-ownership. As co-owners, the title will probably show the three of you as tenants in common, or maybe as joint tenants, with you and your husband possibly owning your share(s) as community property.

In legal theory, all co-owners of a property have the shared right to possess and occupy the entire property at all times, unless they have voluntarily modified that right by contract. This means, in theory, that the three of you are effectively involuntary roommates, and that you can move back in any time, even if mom has leased the home to a stranger.

In practice, the law puts the brakes on a co-owner's exercising the right of shared possession in order to avoid the turmoil that would result. When one co-owner effectively kicks out the other co-owners by taking full possession and limiting or denying the sharing of possession, this is called an "ouster," and the law expects the ousted co-owners to go to court to get their rights restored, rather than resorting to self-help. Civil Code section 843 discusses ouster and its remedies; you might want to look it up.

I think you are going to face two potential problems in January, 2012 (or before). The first is whether possession of the home is available -- maybe mom will have it leased out. The second, obviously related, problem is whether mom is going to make (co-) possession available to the two of you. Although you had an understanding to that effect, if it is an oral understanding it may not be enforceable. That brings you back to relying upon your rights of shared possession as co-owners.

The making of mortgage payments by mom does not have any effect on your right of shared possession and use. She probably has a right to reimbursement for contributions in excess of her ownership-percentage share upon any sale of the property.

The ultimate remedy for an unhappy co-owner of property is to force its physical division or, as happens more often in modern times, its sale and division of the net proceeds. Any co-owner can ask a court to order such a "partition" by filing a special kind of lawsuit asking for the same. Often, the mere filing of a partition suit causes a reluctant co-owner to restore the rights of the others, or to agree to buy out, be bought out, or cooperate in a private sale to a third party.

I don't have enough information to agree that you have to move that fence if it's been there for 20 years. You may have acquired that portion of the property by adverse possession. Also, unless there is a court order in place (the neighbor sued you and won) ordering you to move the fence, you don't have to. A certified letter isn't enough.

The grandmother, if she decides to leave the property to her granddaughter (your wife) and her son, she can make a will leaving the property to those people. Nothing will change in your living arrangements when the grandmother passes, assuming that there is enough money in the grandmother's estate to pay her other claims/debts.

If the house is owned free and clear, grandmother could also deed the house to her son and granddaughter, keeping a life estate for herself.

From a tax perspective, its better to inherit the property as the beneficiary gets a stepped up basis. So if the grandmother bought the property a long time ago and owns it free and clear there is going to be huge capital gains tax on it unless it is passed at grandmother's death.

Also, I don't know if grandmother lives in the house or in a nursing home and if grandmother may need Medicaid or is on Medicaid there are these considerations which would preclude a transfer of the property at this time.

I suggest that grandmother meet with an elder care/estate planning attorney. The attorney can review grandmother's situation and her assets and decide on the best method of transferring the property to son and granddaughter if that is what the grandmother wishes to do. The money for an attorney will be well spent and will ensure that grandmother's wishes are fulfilled and that the transfer is accomplished properly.

Typically, a financial guardian cannot freeze other people out of a Ward's healthcare information, and indeed, may not have access to the Ward's healthcare information himself. The questioner should inquire as to whether the Court granted the other party guardianship authority over the person of the Ward. If no one has guardianship authority over the person, the questioner may consider petitioning the court in NY. However, unless the nursing home inhabitant is of sound mind and body, I find it hard to believe that s/he would not have an appointed guardian over her person.

In order to properly notify the landlord, you should do so in writing sent certified mail, return receipt requested. Include that you will be vacating and that the lease is void if the problem is not resolved in the time indicated. Five days should be sufficient.

If you were in an auto accident and have now been sued, you should immediately notify your insurance company and set up a claim.

At the same time you should request that you be provided a defense attorney. After you set up a claim by phone, you should send your insurance company notification by certified mail confirming that you have given them timely notification of the lawsuit.

If you do not have insurance or have any legal questions, you have the right to hire you own personal attorney who practices in your state.

Why wasn't this in initial divorce decree? At the time parties file the divorce complaint they can request equitable distribution of marital property. Any pensions/401(k)s etc. can then be divided up even if one spouse is not yet receiving the retirement benefits. This is done by a special order called a qualified domestic relations order (QDRO).

So why was this not done? Once the divorce is granted you can't come back 15 years later and ask for benefits.

If you are talking about something like Social Security, that's a different matter. Social Security has its own rules but sometimes (usually a wife) can claim her former husband's Social Security if they were married for at least 10 years. There may be similar rules for things like Railroad Retirement.

Figure out what type of retirement benefits you are talking about. If its a private pension/401(k) etc. review your divorce papers or have a talk with your former divorce attorney. If its some type of government retirement benefit, then you might want to consult a lawyer familiar with these types of things or your family law attorney as he/she may know the answer.

You need to check the decree. Most provide that if a bill is not covered by insurance that it is allocated between the parties. If yours has such a provision and you are complying with it's provisions, then you can file a motion to enforce which will require her to pay her share of the bills.

As I was enjoying a meal at a small storefront restaurant (located in a gentrified up & coming neighborhood), I stepped out the establishment's front door to take a phone call 3mins. I returned to my table to continue my meal when 2 officers approached me and asked that I return back outside. With confusion on my face, I inquired why. I was informed that I had shoplifted from a popular nationwide drugstore located directly across the street.

I informed the officers that I've never even been on that side of the street today and have been sitting in this establishment for the past 15-20mins. He asked to look in my purse, I immediately refuse. By this time, I was totally embarrassed as the restaurant's employees and customers looked on.

I refused to leave the establishment. This officer conducted himself in a very unprofessional intimidating manner. I told him I fear for my safety and the accusing party would need to come into the restaurant and ID me. All the while, he never asked for my identification. The waiter brought my tab. I opened my wallet in plain site, exposing my checkbook, credit cards and Id, paying my tab. Still, I was never asked for my ID, so I passed it to him anyway. He radioed in my info.

As I was finalizing my bill, I heard him radio in that he was trying not to "1-4-something" me and to have the accusing party come across the street to identify me. I figured that meant handcuff or take me into custody. I was wondering if I was being held against my will. I began to grab my belongings to leave, the officer informed me that I was being detained and could not leave.

Minutes later, I saw a cop car pull up just to the side of the restaurant and a plain clothed man got out and walked passed the window where I was sitting. His eyes immediately zeroed from my face to the officers face, giving him an affirmative nod. I shook my head in disbelief and exclaimed that I am being WRONGFULLY ACCUSED and will be pursuing this matter to the fullest. The officer quickly interjected with attitude that this guy was a friend and he was just casually speaking to him.

Next the clerk, dressed in her smock, poked her head in the door and immediately shook her head and stated that I was not the suspect. She furthered that the suspect was about 150 lbs. This infuriated me cause I'm a solid 320 lbs. The officers turned on their heals and immediately left without uttering a word...not even an apology.

In the past, I've taken medication for depression and this episode has definitely exacerbated the state of my mental health.

What recourse do I have to file a claim? Against the drugstore? Against the police dept?

I can't say I agree with Mr. Wallin. Your experience was obviously unpleasant, but it didn't result in an arrest or charges, much less a conviction. I don't see how it could have much of an effect on your future, much less ruin it.

Police officers sometimes identify the wrong suspect. That seems to be what happened here. Maybe the first officer didn't know what the witness had said about the suspect's weight, or maybe he did and made an unreasonable mistake. Either way, the mistake was corrected pretty quickly.

I agree that the officers acted unprofessionally, but you are not entirely blameless. You had no right to demand that the first officer bring the witness to you. Telling him how to conduct his investigation justified treating you as uncooperative.

It did not justify his rudeness, but rudeness isn't actionable. A brief detention like yours normally isn't either, unless the police actually knew you were innocent. And even if they did, a single incident like this would justify only a token amount of damages.

I don't see how you could have a viable claim against the drug store, either. Making a police report is privileged and cannot be the basis of a successful lawsuit. Besides, I see no evidence that anyone at the store did anything wrong.

You should probably complain to the police department about the way the officer treated you. I'm afraid I don't think any further action would be justified.

I'm sorry you had to go through this, and I wish I could be more encouraging.

My Aunt has medical issues which basically bars her from being in high altitude. The neighbors won't give his items back and are claiming the place was put up for auction and sold however there's no proof on that and I've recently seen the place and its still in full mess with his belongings and no occupants. A third conviction for DWI indicates a significant problem with alcohol to the Court or jury assessing punishment. In some cases an in-patient, incarceration program (Substance Abuse Felony Probation SAFP) is ordered.

I would strongly urge your uncle to get help with his addiction. He should, at a minimum, be attending AA classes. If his license is suspended, be sure that he does not drive. At this time, driving on a suspended license would be a violation of his bond & could result in revocation of same. If he gets probation, driving on a suspended license could result in the revocation of his probation and jail or prison time. If he gets a final conviction, driving on a suspended license could result in jail time on a new offense.

There father has had limited contact with them since the divorce and no contact with the oldest. I have a 15 year old daughter that he has not seen in over a year. The general rule of thumb is that the divorce decree tells you what the court ruled and what you cannot do. If it is silent then it is not telling you not to do something. The only person to object would be your ex and he would likely have to go to court to object. You are also, as you said, the primary person looking out for the best interest of your daughter. You are (legally) expected to make decisions to ensure that her health, education and welfare is looked after. If part of your decision is that you have to seek a job in a state next door to you then that is your decision. I hope this answer helps.

I has recently taking a tow truck company to small claims court and I am having serious problems. The first court date was rescheduled because the tow truck company owner was going to be out of town. I wen to the 2nd pre trial hearing and they did not show up. The Judge awarded all damages in my favor. They told me to wait a few weeks to see the judgment so that I may take action. After a month I called the court house to follow up and they told me that the individual put the wrong date on his calender and walked in 10 minutes after I had left. According to the guidelines the court gave me a reschedule can not happen without good reason and prior court approval. This individual had neither and was allowed to reschedule, I had to go to court a third time and now a fourth. I was told even though the judge gave me a judgement that since it was entered in the system by the courts office that my judgment wasn't official. My court started at 9 am and I was dismissed by ten. The individual didn't supply a reschedule letter until 335 pm that afternoon. Is the judge allowed to do this?

Do yourself a favor and get an attorney. This is why you need one. This could have all gone in your favor at the very beginning. The judge is in charge. He is probably being lenient as the reschedule was due to some unforseen problem. You could have squashed it had you filed the correct papers.
