You say both parents died at the same time. Usually that does not happen and its possible to determine death order unless they both died in a plane crash or something like that.

You do not indicate where the parents lived at the time of their deaths or when the deaths occurred or if estates for each are pending. This matters because state law varies.

Most states have what are called simultaneous death acts or something similar. Basically, if the spouses die at the same time such that the death order cannot be ascertained, then each will be considered to have died before the other. The mother's property will pass to the mother's children in equal shares and the father's property will pass to his children in equal shares. Any jointly owned property, like land, will pass 1/2 to father's children and 1/2 to mother's children.

Step children do not inherit from the step-parent. The child only inherits from biological or adopted children.

And how do you know what the mother wanted? If the mother had wishes, she would have made a will. This was especially important as their were step-children involved and neither parent here acted very responsibly by having wills/estate plans made. Since they did not do that, any wishes the parent may have expressed verbally are irrelevant. There is no will so all of the mother's possessions must be split by the mother's children only and the father's possessions are split by the father's children only.

Once things have been distributed or tenatively distributed after the bills/debts of each estate have been paid, if the children want to make their own family settlement agreement that is up to them.

I would suggest that mother's children seek out a probate lawyer and father's children seek out a probate lawyer here because of the possibility of a conflict of interest.

Sounds to me as though this is an attempt to cheat you. My inclination would be to tell him that you aren't interested and that you'll be vigilant to look for infringing products. However, this advice would be tempered somewhat by evidence that the distributor was otherwise successful and that the deal he was offering would result in overall higher profits. It's a business decision as much as an I-P issue.

I don't know of any reason why it would be illegal, but I suppose it could be. That seems unlikely. The answer will depend upon exactly what the software does. UltraSurf was designed to circumvent the "Great Firewall of China" and other foreign censorship tools. My understanding is that the government helped develop it, which suggests that it doesn't inherently violate U.S. law.

But like anything else, it could surely be used in illegal ways. For example, there might be ways it could be used for cyber espionage, or to cover your tracks while you negotiate drug deals. Those acts would be illegal whether you used UltraSurf or not. The reason they're criminal is not because they could be done with particular software.

Only somebody who knowingly uses the software to commit an illegal act would be breaking the law. (To be clear, he wouldn't have to know the act is illegal. He would only have to know he's doing it.) Putting it to legitimate use would not be a crime, and neither would unintentionally using some improper features. Merely owning or installing it should not pose any legal problems.

This is a classic case of resulting trust. Resulting trust is a theory whereby you can get title back on the fact that the person to whom you've given title to acts as trustee for you for the title to the property.

The burden of proof is by clear and convincing evidence. If you have the proof showing you paid for the property, ie. proof of source of down payment. Courts want to see in fact you came up with the down payment for the loan. I hope you've kept some receipts for it.

You can stop the sale by recording a lis pendens. For that you need an attorney.

I disagree with the previous answer. Not only is this not a perfect example of a resulting trust, it is not a resulting trust situation at all. I think Mr. Tan mis-read your facts. A purchase-money resulting trust would arise if you paid the down-payment for the property but your sister took title from the original seller instead of you. Here, as I understand it, you bought the condo previously, then got into financial difficulties and decided to transfer your ownership to your sister. That's not a resulting trust. It's a gift.

Unfortunately, in all probability, it was also a fraudulent transfer. You should read up on fraudulent transfers of real property, starting perhaps with California's version of the Uniform Fraudulent Transfer Act, codified in the Civil Code as sections 3439 to 3439.12. The definitions in section 3439.04 kinda sound like what you were trying to do by transferring the property to your sister.

The difficulty with trying to figure out any kind of pleading you could make to a court to try to get your property back is that the possibilities are generally equitable, rather than legal, in nature, and the "unclean hands" equitable defense comes to mind. That defense basically says that a court of equity won't go very far to assist someone who has not behaved well in the same transaction. Of course, your sister may well be "in pari delicto" as to the possibly-fraudulent transfer of the condo; a knowing transferee can be as guilty as the transferor.

In sum, based on the given facts, I don't see a really clear theory upon which you can reclaim your condo against an unwilling sister. The fact that you gave it to her as a gift instead of selling it to her for full price isn't going to provide an argument, at least not one that'll get far. What is the status of the mortgage, and does the lender know you gave away the collateral? That won't affect it as collateral, of course, but it's probably a violation of any due-on-sale clause in your loan and might trigger a demand to pay it off.

Finally, don't try to record a lis pendens until there is litigation under way. A "lis pendens" is a notice of pendency of litigation; a recorded notice that litigation affecting title to, or possession of, certain real property is currently pending in a court. Even then, your lawyer can prepare and file one, but a self-represented party needs prior approval of a judge.

I agree with Mr. Whipple. You have two big problems. The first is that there is a presumption that a deed is absolute on its face. You have the burden of proof of showing otherwise. This is going to require some incredible proof on your part, and a separate written agreement between you and your sister would help, but I suspect that all this was oral, which means the whole thing is a "he said she said."

Second, it would appear that you engaged in a fraudulent transfer to avoid creditors. This hurts you in seeking equitable relief from the court, such as quieting title.

There was one case a while back that held that a license was restored by operation of law after expiration of the suspension but it was distinguished by a later case. The issue is very fact dependent. Before you try to clear up the driving citations it is very important to discuss the fact situation with an attorney. If you simply go back and plead guilty to multiple offenses it could and would likely result in a further suspension.

If I am following you correctly you received a Driving While Suspended in both Cases. It would pay for you to have your license restored for both cases. Why were you suspended? It is not a given that they will dismiss your case but it may help in potentially resolving one or both cases. The penalties are also fairly serious. A first offense for DWS is a $500 fine plus a possible suspension. A second offense carries a $750 fine, 1 to 5 days in jail and a further suspension of your Drivers license. Defenses? You should be looking for an offensive strategy. Your issue, if I understand your question correctly, is not so much that you want to resist eviction as it is that you may be able to assert an ownership interest in the home.

Your facts are a bit confusing in that at one point yo say the owners are terminating your tenancy because they have decided to sell, then later you say it is because you have quit as their employees. I suppose one is their stated position and the other is your reading of the facts.

Asserting any right to an ownership interest in real estate without a written agreement is an uphill battle. The basic law is that it can't be done, but there is a handful of exceptions. There may be a loophole that fits your situation.

You have to stop thinking in terms of defenses (we've always paid our rent on time; we've never violated any codes) and start looking for assertive theories by which you can claim an ownership interest, or, failing that, a right to be reimbursed for the improvements you made.

This field of law - property rights under an oral agreement not satisfying the statute of frauds - is worthy of thousands of pages in a legal treatise on the subject, and I can't begin to explain the (slim) possibilities you have to assert a claim for ownership against the owners on LawGuru.

Suffice it to say that there is at least a slim chance you can prevail, but a better analysis would require a face-to-face discussion and probably some research after the interview.

There are always dangers when you introduce a petroleum product into an orifice of your body. Even if you spit it out you will have a film of oil on your tongue and cheeks on the inside of your mouth. You will swallow some of the oil by letting it coat your tongue when sucking it through a straw!

The real question is did your tenant sign a Lease. If so, then the Lease should provide for this type of problem. Generally, a landlord must return the security deposit within 30 days after the tenant moves out, or provide an itemized list of damages, and their cost, to the tenant. In a situation where the tenant never takes possession, this rule would probably not apply. If she signed a lease, it would seem that you have an action against her for breach of contract, and would be entitled to damages for the period that you took the premises off of the market, less any money that you may recoup from a new tenant. Without a Lease, however, you have a much harder case. You should probably schedule a meeting with a local attorney to go over your options. Most attorneys charge nothing or very little for an initial consultation. This would be the only way to find out where you stand.

I am speculating that the judge forwarded the motion to the clerk as standard practice. Many times people who do not understand the court system simply send things directly to the judge. The judge's assistant then forwards copies to the clerk, state, and defense in order to be certain that there is no appearance of ex-parte communication. I doubt there is anything that needs to be corrected.

Epiphone guitars are good guitars. There are, however, some differences to consider. Gibsons are made in the USA, while the Epiphone is made in Korea, China, or Japan. Labor is cheaper overseas, so it saves costs. The electronics are also made overseas. They are, however, made to the same specs as their American cousins. The finish is a completely different process for both. Up close, the Epi is beautiful. The Gibsons are even prettier. The wood used on Gibsons is generally Honduran Mahogany, and the bodies are one piece. The Epi uses other varieties of mahogany, and the body is usually a three piece affair. All said and done, the Epiphone is a fine instrument. Some Epiphones I have played sound and play as nice as the $2,000 plus Gibsons I have played. If you are willing to do a set-up and replace some hardware, you can achieve the same sound and playability as a Gibson without the price. The Epiphone will lose value over the years, the Gibson will gain value. Most Gibson owners are aware of this, and see their purchase of a Gibson as an investment. The name means a lot. I have built guitars for two companies, worked at music stores, been in bands, and have played a lot of guitars. I have a very nice late 80's Epiphone Les Paul Custom which, after leveling the frets, and re-setting up plays and sounds every bit as good as most Gibsons. I won't be selling my Epi for $2000 down the road, but then again, I only paid $268 when I bought it used in 1991.

Not all landlords look at credit scores, or that is not their main source of information, when deciding to whom to rent. If you bring reference letters from current and former landlords who can say you paid your rent, this will be helpful. Also, you could get a co-signer or pay a larger deposit.

Your credit report is probably already keeping you from getting some apartments, but there are always people who will rent to you. If you decide that a bankruptcy is the best option for you, you should move forward with it. You could potentially have a credit score in the 600 range within 3-4 years after filing for bankruptcy, or so I have heard.

As my colleagues have correctly noted, it really depends on the landlord. Your credit report is already really bad, although I am not sure how much worse it could get with a bankruptcy. The key to getting credit and rental units after bankruptcy is how you conduct yourself moving forward.

I tell my clients to get their living arrangements lined up before filing for BK because of the potential impact on your ability to rent. I have a client right now who will be filing for BK and she is disclosing this to potential landlords (bad idea). They don't want to deal with her unles her BK is over (about 3.5 months for most Chapter 7 cases).

You should be able to find a landlord SOMEWHERE that will rent to you, but you should probably do it either before you file or after you receive your discharge.

The property is in a state of disrepair and of little value--an albatross. I would like to donate it for rehab so someone could get some value out of it, but have no way to contact my sister (or to determine if she is alive). You could not file a claim to quite title unless you have a viable claim that you own your sister's share, i.e. she died without children, living you the sole heir at law.

The better way to solve would be to file a partition action and ask the court to sell the property at a public sale. You could clear the title out of both your names that way. You will need to see a lawyer to do this the right way.

if it is front wheel drive, although many people do this behind rv's, if not a wise idea. unless the engine is running, and thereby turning the transmission, the oil is not circulated in the transmission. no oil circulation, no oil supplied to the bearings that will be turning as you roll down the road. you run the risk of burning you output seals and even you transmission. take the drive wheels off the road with a dolly or trailer. if you are referring to a rear wheel drive vehicle, simply detach the drive shaft, tie it securely up and have a good trip. if you have no mechanical savvy and you still insist on doing any of this without the proper precautions i spole about get a tow attachment on the front of your car to be towed behind whatever the tow vehicle is and have a good trip. just make sure you put the car in neutral. dont be surprised if you need a trans after doing this a couple times though.

I take it that you are upside down and you want to know if you can "walk away" from your mortgage. It depends.

In NC, the lender is allowed to seek what is called a deficiency judgment. Deficiency is the difference between what is owed less whatever the property is sold for. The lender has one year to seek a deficiency judgment.

NC has an anti-deficiency statute. However, this only applies to mortgages that are seller-financed, not mortgages that are financed by third-parties, like banks. The laws in NC are very pro-lender.

Will the lender come after you for a deficiency? It depends on your circumstances, what other assets you have, things like that. If that happens, you have a couple of options: (1) if you have enough resources, often a deficiency can be negotiated for a fraction of what you owe; or (2) if negotiation is not possible, then you can always file for bankruptcy. You can also defend any deficiency action by showing that the property sold was fairly worth the amount of the debt secured by it at the time and place of sale or that the amount bid was substantially less than its true value.

If the lender gets a deficiency judgment against you, it is like any other judgment. The lender can try to collect on the judgment. The judgment will last for 10 years and can be renewed for another 10 years. The judgment earns interest at a rate of 8% per year. And the judgment can be enforced against other assets that you have that are not exempt. Your bank account can be levied upon, but there is no wage garnishment in NC. Also, a judgment could be transferred to other states if you leave NC and can be registered and enforced in those states. The problem is that if you move to a wage garnishment state and the judgment follows you, the lender can then garnish your wages. So options 1 or 2 are preferable to allowing a judgment to be entered.

No, most likely in referring to "the original court certificate", this company is referring to what in Virginia probate matters is termed Letters of Administration which are normally issued by the clerk's office of the appropriate probate court appointing or qualifying you as your aunt's personal representatives to administer her estate (and which also acts as legal notice to third party holders of a decedent's assets that the holders of such letters have been properly empowered by the court to transfer assets to properly designated beneficiaries.)

A trial brief, normally filed at the beginning of the trial before the admissibility of documents is normally decided, can only refer to documents you reasonably think will be admitted into evidence. Citing material you know is not admissible will upset the judge who might then ignore the rest of your brief. If the trial is not yet over you have to see if there is a way to get the documents into evidence.

I signed a lease and paid part of the deposit in the amount of $2,600.-. The full deposit was $5,900.-. The agreement with the landlord was that he would take the property off the market once the full deposit would be paid. After 9 days I gave written notice of the cancellation of the lease.

The landlord first said I would be given the full paid deposit back, then said I would get part of it back, then said I would not get anything back. I went to small claims court. The landlord counter sued based on damage due to breach of contract. Since the amount the landlord sued me for is higher than $7,500.-, the case was not decided in the small claims court but assigned to another court. A court date is not set yet nor have I been served with the claim of the landlord yet.

Paragraph 2 of the lease says:

"The term of this lease shall commence ten (10) days following written notice from landlord to tenant that the Premises are ready for occupancy or sooner by mutual agreement and shall be for a term of one (1) year from the commencement date."

such a written notice was never issued. The contract was cancelled by written notice 9 days after signing of the contract.

Regarding damage due to breach of contract: Before signing the contract, the Studio had been empty for months. 2 weeks after having given written notice of the cancellation, the landlord forwarded a text from a prospective tenant in which the interested party said that they wouldn't take the studio since they had decided to move closer to her moms into a different area.

I am looking for a legal feedback on the case and a lawyer to talk to the landlord in order to settle.

The landlord can not have his cake and eat it too. He can not sue for damages caused by the breach of contract and at the same time keep your deposit for the breach of contract. He is trying to collect the same damages twice. If the contract has a provision for keeping your deposit, that can only be done because it represents the damages caused by the breach. The law does not allow the keeping of another person's money unless it is as compensation for the economic loss occasioned by the breach of contract. Some contract breaches do not result in any damages.

An attorney would have to seen the entire contract and any e-mails between the two of you, plus the complaint you filed and his counter-claim. The counter-claim is his complaint in Superior Court and you should file an answer to it. He will have the burden of proving his damages; basically what he will show is that you would have paid $X and that he has made a reasonable effort to mitigate damages by trying to rent it out to someone else but has not found anyone. You can argue that the premises would never be ready for occupancy within the year so there would be no rent due as the lease would not begin until ten days after he gave you such notice [that clause does not give you ten days to cancel -- but he may have said something else giving you the right to cancel without having to pay].

I would be willing to review all the paper work, give you a more detailed analysis of your legal position, try to reach a settlement with the landlord, prepare you for trial or appear for you if you want, etc. I charge $100 per hour. Contact me if you wish to further discuss the matter.
