The question does not make sense to me. From the date you become the actual owner you are entitled to collect rent from the tenant; the tenant only pays rent, property damage,late fees. If you mean can you collect the items you list from the prior owner that depends upon what the purchase agreement says and what his and your knowledge as to the tenant was when the sale occurred. If the prior owner told you that the tenant was paying the rent timely and knew that was not the case, but you could not know that and obviously was relying upon rent being paid, then the prior owner mislead you and you would be entitled to damages. What the amount of damages would be is unclear. Obviously you would have paid a lower purchase price based upon how much rent would be lost and the cost of evicting the tenant. If you would have insisted that change in ownership not occur until a rent paying tenant was in the house, and the former owner would have agreed to that, then what you list in your question would be a measure of your damages [plus the lost rent and eviction costs]. But would the former owner have been willing to sell to you at the same purchase price but those added conditions?

You need to go over the terms of the purchase, all the communications, what was said orally, etc and give that to a neutral third party for them to give an opinion if you have a case. If you give the information to an attorney, you will get a much more reliable answer and they can write a demand letter to the former owner and their realtor. A lay person would give poorer advice. You seem to be discussing something that is worth having an attorney look at and that you are not able to handle yourself. Honestly, there is not much you can do. All discrimination isn't illegal discrimination. Employment discrimination law states that an employer can hire, fire, promote, demote, or engage in any employment action it wants, good reason, bad reason or no reason so long as the employment action is not based on the employees race, sex/gender, national origin or ethnicity, disability, age if they are over 40 or because they were taking advantage of a protected legal right e.g. FMLA, FLSA, workers comp. etc. From what you have stated your employer is unwilling to pay you more for work you feel they should because they pay others who do that work more. Without more that doesn't rise to the level of illegal discrimination. If there is more to it then you may be better consulting with a local employment discrimination attorney to determine if what is going on may be covered under employment law.

Not that I know of. No bank is going to just let you take your name off. They will allow you to add a name (as it makes another person responsible for the loan) but they never allow a borrower to remove the borrower's name for the same reason - by removing your name, you are declaring that you are no longer responsible for the debt. When you took out the loan, the bank was induced to lend based on two names on the mortgage. Now with just one, its a different financial picture. So that is why you just cannot remove your name and why there are no other alternatives really. The only other options if your husband does not refinance are: (1) pay off the mortgage entirely in which case the mortgage would be cancelled or satisfied; (2) you can sell the home; or (3) you can file bankruptcy.

Why did your divorce attorney not mandate that your ex-husband would refinance the home? Can he refinance with his credit? The logical thing would be for him to refinance and buy your share of the equity in the home, if any, or at least refinance and get your name off the loan and deed. If that does not work, he can sell the home but if he does not want to do that and cannot afford to refinance, then you are stuck. I hope he pays the mortgage on time - any lateness will be reported on your credit.

Sue her in small claims court for return of your personal property and all documentation (receipts, bills, etc.,) proving you are the rightful owner. The court may or may not have jurisdiction to return the dog to you and may only provide you wih money damages. Second, by even asking this question, as a person assisting another person, you are asking us to assist you in practicing law without a license. Third, how to contact brothers in Iran is not a legal question. We have no idea how to find a dead man's brothers in Iran. Lastly, (finally) a question we can answer: if the man died in California and he has no living brothers, wife or offspring, then you have to look at who is still living. Brother's or sister's are a second choice after parents. You could also sue under a theory of estoppel, meaning you benefited the employer by working more hours than you were compensated for.

The mother, my sister is living from sofa to sofa, almost done with her probation for mis. assault and finally got her first job at walmart. The judge recommended we seek long term custody or guardianship, the court advocate suggested termination of parental rights and adoption. If both parents are willing how difficult would it be to adopt my nephew with the father being in jail and mother pretty much homeless?

Brakes- Early model cars used drum brakes in the rear and disc brakes in the front, even earlier cars used drum brakes for all four wheels. Now days disc brakes are standard on all cars and most are equiped with ABS (anti-lock braking system) that stops your wheels from locking up when you hit the brakes there fore stoping the car from skidding and losing traction. Modern brakes therefore don't require much skill to use effectively and they are much safer.

Engines- in the sixties most petrol engines used carburetors to mix the air and fuel whereas modern cars use electronic fuel injection wich allows more efficent and cleaner combustion in the engine resulting in more power. In the sixties all engine blocks were made from cast iron- a very heavy substance that was prone to cracking from high tempatures/ fast temperature changes/ hard knocks etc whereas most modern engine blocks use alloys that are lighter, stronger and generaly more resiliant to the pressure that an engine exerts. old engines used a distributer whitch was a mechanicly rotated device used for creating the ignition sparks for the engine, these were tuned simply by listening to the sound of the engine and slowly turning the cap in most cases all thou professionals used timing lights whereas modern engines use electronic ignition systems that allow extremly accurate spark timing resulting in more efficent and cleaner combustion and more power. Modern engines are equiped with a electronic control unit (ECU) that receives information from an aray of sensors on the engine and adjusts fuel/air ratios to keep them stoichometric, adjusts ignition timing as required, and activates warning lights to inform the driver of faults.

Gauges- most old gauges were mechanicly driven whereas modern ones are electronic meaning that they are far more accurate

Suspension- old styles of suspension were good for little more then attaching the axles to the car, modern suspension (the variants are endless) compromises between driver comfort (smoothness of ride) and traction. One example is fully indepentent suspension which allows each wheel on the car to move up and down indepentently of the others makeing it much smoother and creating better traction whereas older vehicles had a solid rear axle and solid front meaning no one wheel could move up or down with out affecting the oposite wheel.

Aerodynamics- ever notice how older cars were box like in apearance whereas modern cars are sleek and rounded? this is improved aerodynamics that mean the vehicle will not encounter as much wind resistence at high speeds, spoilers are all so used to create down force on the rear of modern vehicles therefore creating better traction

If there is as a custody order in place, you will need to file a modification of custody action. I am assuming you are paying child support. If so, you will need to include a modification of child support as well. You will want your order to pay child support to terminate, and have an order entered for the mother to pay child support to you. I am providing this information without knowing if you have maintained a bond, visited the children and have been an active father. There are a lot of issues regarding custody so I would advise you to speak to an attorney before filing a modification action.

The reason that I point this out is that California law distinguishes between the two and there are different rights and remedies affiliated with both. It sounds like your order for each other to request random drug tests of each other is not working. I've never personally heard of such an order that would allow one party to request another take a drug test whenever they want. It seems very intrusive, and can quickly be abused. I would suggest that you request that the court get involved to monitor or facilitate the drug tests so that it's not up to the will of the other party. You need to establish the means of how notice is requested for a drug test, if it is via text, or a phone call would suffice.

Either way, you have to respond to the court when your ticket says to go. If you can't afford an attorney, ask the court to appoint one to represent you. The attorney will negotiate with the DA and try to get the charge(s) reduced to a violation or perhaps an Adjournment in Contemplation of Dismissal. The ACD in a marijuana case is for 1 year. If you are not re-arrested during that 1 year and you follow any other rules like community service, the case is dismissed and sealed.

As to your first question, it's not clear if you are asking whether the change of custody de facto for your daughter violates the agreement, or her moving into the guest residence. I would have to review the language of the agreement to determine if the moving part is related to the custody part, or under what conditions she was permitted to return. As to the restraining order, unless there has been a recurrence of the conduct that led to the restraining order, such efforts on her part would be futile. These orders expire on their own, but if necessary you could file a contempt petition against her for violating the agreement with respect to seeking withdrawal of the order if there is enough time left before expiration to make this practical.

I have been charged for a reckless driving citation and have a mandatory court appearance. I am 16 years old and have an otherwise clean record. I do not believe I was ever clocked, and do not know my exact speed myself. I recently began driving a manual car (about a week) and was playing with the gears. I attempted to shift at high rpm, a considerably more difficult task to do smoothly than low rpm. Normally I shift from 2nd to 3rd at 20MPH and while playing with the gears i did not realize that red-lined in 2nd gear is around 50MPH. I believe i was traveling just under, or possibly 50MPH in a 25MPH zone. What I did was wrong and dangerous.. but is there a possibility that this charge may be reduced to a speeding ticket, which is an infraction rather than a misdemeanor.

I would definitely think there is a chance to avoid criminal conviction here. The law says that speeding is 'prima facie' evidence of recklessness; but that is far short of 'proof beyond a reasonable doubt'. If you are convicted of reckless driving, not only is it a crime on your record, but it also suspends your driver's license.

I think the plumber needs to find a new excuse. IF you are on a septic tank, use RID monthly in your commode - it will delete the problem. Impossible to answer your questions without seeing the paperwork. If the rental agreements are with the owner and the money is due to the owner, he rightfully is getting it sent directly to him and you cannot evict or claim non payment. If the funds are required to be paid to you directly, than you may have a right to notify them of non payment. Seek some legal help with all the paperwork.
